Question

My father is having problems with the assessment that are been imposed to him by his HOA. He had requested documentations for the assessment and up to this point, they haven't answer any of his questions. What can my father do, and how much will it cost to have a lawyer request the documentation? It is my father believe that the assessment are been applied to a small group, and not every home owner. He also believe that assessment that were not part of his association were imposed to him even though he wasn't part of the other association. I personally requested the following information (Hi Mrs. Folkard,

More than a week ago my father and myself were at your office in order to clarify the origin of the many assessment that are been implemented to my father. I also had a conversation on the phone with the property manager and as per our conversation, he was going to send me a copy of the association documents which according to him, it does specify that my father property under special assessment can be charge more than other property owners. According to the law, special assessments are to be apply equally to all the property owners. Also, we need to find out unfortunately through you (since the property manager hasn't even bother to rite to me) who was assessed the $21.00 dollars per month that my father is paying for a special assessment. Delinquency special assessment that my father is paying right now, we need to know who is paying and the amount the each owner if paying in order for my father to know if he is paying more than other owners. My father will like to know which units are part of his association in order to determent why he was given an assessment for the repair of the balcony of the apartment buildings. Juan Jose Acosta 3221 South Palm Aire Drive Pompano Beach, FL 33069) and to this point, I haven't received the requested documents.

Answer

It will likely cost you an hourly fee with an attorney to straighten everything out. It will be well worth the money spent as you get dug in deeper to this hole.

Question

My husband divorced me in 2006. We were married since 1993. I never saw any paperwork, never signed anything, have no idea what the divorce decree says. I was very trusting of him and he told me that he would take care of everything. This is what happens when you fall in love at 14 years old and get married at 18. I totally trusted whatever he said was truth.

I'm now finding out that he signed my name on all the papers and also made some deal where I am responsible for all of our debt. He also made four times the amount of income I did. I realize it would be too late to do anything about this now, but would I have had some kind of right to spousal support? I was practically on the streets after our divorce. And I'm not joking. I lived in cheap motels for two years because I had nothing. He got everything. But since I'm sure that's a moot point by now, my main question is: Did he have the legal right to sign my name on the divorce papers? Now that I've gotten older and wiser, I wonder if he possibly told me to let him handle everything so that he could take advantage of my not being present. Now I'm hearing that if someone doesn't show up for a divorce proceeding, the one who does show up pretty much gets what they want. Anyway, sorry for the long-winded questions, but I am really concerned about this. I am going to my county clerk today to get a copy of the divorce decree to see what it actually says. Thank you.

Answer

Because it's been six years since the divorce, you are out of luck.

No, he did NOT have the right to sign your name on anything. That's called forgery.

You may be able to get an equitable bill of review - go see a lawyer about this; it is much too complicated to be dealt with in this forum.

If there is no custody order, there is no order to break. It sounds like you need a custody order ASAP. Why don't you have one already?

Question

My son's FATHER's SGLI was left to his mother who died 6 months after he did. Now what I believe is my son's rightful inheritance is in the control of her 2nd husband- of no blood relation to my son or his father (The serviceman)

I have been told, that according to MA law my son is entitled to an inheritance from his grandmother but not directly from the SGLI. I believe this to be not only illegal but completely immoral -as my son was 2 1/2 years old at the time of his father's death.

Should I sue him? Can I appeal to SGLI?

Please help me!!

Answer

We would need to review the way in which the SGLI was designated to determine whetehr a trust was created or beneficial interest for the child.

Are hybrid cars diesel?
While it would be possible to build a hybrid car using a dieselengine instead of the gasoline engine, I do not believe anymanufacturers are doing it. This may be because of problems withreliably restarting a diesel engine after stopping it that don'thappen with gasoline engines, but I'm not certain.

Question

I have someone calling my mom telling her that I owe money from a payday loan from 2011. I don't remember ever getting the loan and they wont send me any info. They say they already sent it two weeks ago which I never received. They are constantly harassing my mom. They tell me and her that if I don't pay the 1,400 right then and there, no option for a payment plan or they will contact the police in my area so they can arrest me at home or work and have me locked up. They wont give any information account the law firm just that they are in Texas and the number I have and the two people who my mom and I have spoken with but they have most of my personal info (SSS. email and birthdate) What do I do or what can I do.

Answer

Send your written demand to these predators for confirmation of

this alleged debt to be provided no later than 30 days from

the date of this letter.

Then do nothing further until you receive this information confirming this

debt (which probably will never be provided).

As for this threat of jail, fear not as debtors' prison was eliminated from

the American judicial system a very long time ago and folks these days

are not put in jail merely for their inability to pay their civil debts.

Question

I have lived in my house for 18 years. For most of that time, we have had our backyard fenced in and a shed in the yard. In July of 2004, we landscaped the back yard. Part of the process included moving our fence and shed to a temporary spot and then putting them back. Now we are trying to sell our house, and my neighbor, who has owned her house for approximately 16 years, is telling us that the shed and fence are encroaching on her property and she wants them moved immediately. I asked her why she waited 7 years to tell us and she said she was okay with our daughter using the land to play (8 feet of property)! I'm wondering if we are obligated to move them? Someone mentioned the possibility of "adverse possession". Thanks in advance.

Answer

If you're asking whether adverse possession COULD apply, the answer is a conditional yes. Adverse possession exists when someone's use of property is out in the open and obvious (which is presumably the case here). The question is whether you have met all the conditions in your jurisdiction for an adverse possession claim to apply.

There aren't enough facts here to figure that out. If you would like to chat about it, feel free to email me today at [email protected]/* */ and we can set up a time to chat if you would like.

Best,
