Can you be 13 years old to drive and then get a permit and then get a licence when you are 15 years old?
In some states, such as Montana, you can get your permit at 14 1/5 and license at 15. My Grandpmother had a "Farm License" in Colorado. At age 12 she could operate farm equipment, including registered vehicles, from ranch to ranch. Very limited use and that was 70 years ago.

Cars for big people?

Cars for big people?
Im 6'7" and wide like a linebacker, unfortunately most cars don't fit me. Either my legs are jammed into the dashboard, or against the center console. So ive been forced to drive large luxury cars. I currently drive a Cadillac DeVille DTS but im sick of having to use premium fuel so im buying a Lincoln Town Car. If youre not the luxury type, i hear the Scion xB is both a tall/big person friendly vehicle . . ill stick with my leather and traction control though.

In addition to what was mentioned above.

I am a large guy, 6'3 and quite broad. I have a Chrysler 300 and it is very roomy. I have about 4-5" of head room when the seat it at it's lowest. They are a very spacious car as well.

In addition:

I'm 6'4" but I'm pretty skinny (180 pounds as far as I know) but the 2006 Ram 1500 I drive is perfect for me. I still have to slouch SLIGHTLY but other than that it's a comfortable ride. I also drive a 2007 Mazda 3 from time to time and that car is the worst for me because I always manage to hit my knees on the dash and I really have to stretch in order to reach the steering wheel. I hate that car but it's a good gas-saver.

Is it safe to drive a car with a shaky steering wheel?

Is it safe to drive a car with a shaky steering wheel?
My steering wheel was shakey and worse when I hit my brakes. If this is your situation, it's alright to drive, but you need to have your rotors turned. They tend to warp when they're hot and the water from the rain hits them over a period of time.

Question

I have worked as a jeweler from a small jewelry company and would like to start my own jewelry business, will I be sued by or involved with any legal issues from my previous employer for starting the same kind of business by any chance?

Answer

No, unless you had a non-compete agreement as part of your prior employment. If the jeweler had proprietary designs, then you'll want to avoid designing jewelry that is the same or similar.

I want to rent out my house using a lease option. What are the laws for this type of arrangement?

Question

I want to rent out my house using a lease option. What are the laws for this type of arrangement?

Answer

I think an answer to this question needs to address two categories:

First, there are some legal requirements that attach to leases with an option to purchase; they include primarily that the lessor must make the same disclosures that a seller would be required to make, and they must be made before the signing of the lease. See Civil Code section 1102. This section makes the provisions of sections 1102-1102.17 applicable to leases with an option to purchase.

In addition, there is a broad category of legal concepts that should be considered and regarded in drafting a lease-purchase agreement for the benefit and protection of the parties. For the most part, these considerations are not based on laws, per se, meaning statutes passed by the legislature. Instead, these are practical matters with possible legal consequences which the lessor-seller (and the lessee-buyer too, for that matter) should take into consideration when negotiating, drafting and signing a lease-purchase. I would suggest that the parties either hire legal counsel, or at least look up several prior examples of lease-purchase agreements and select clauses that seem to fit your desired deal. One possible source of sample agreements is the paperback self-help law books put out by various publishers including Nolo Press.

Answer

I agree with Mr. Whipple, but I feel that your question requires a lot of in depth discussion that would not fit on a small bulletin board like this.

Answer

I agree with Mr. Roach. Lease/Purchase or Lease/Option agreements are notoriously hard to do right. Most real estate professionals agree that it is virtually impossible to put together a lease/purchase or lease/option deal that is not a bad deal for the landlord or the tenant or both.

What is the meaning of song 'Dog days are over' by Florence and the machine?

What is the meaning of song 'Dog days are over' by Florence and the machine?
From an interview that she did:

The song is about her struggle with giving up her favorite food (or one of her favorites), hot dogs, when she became a vegetarian. Nothing quite so inspirational, but it's the truth. That's what the dog days of summer mean. Hot dogs gave her a lot of happiness, but she had to run from them. And, I imagine with all the summer barbecuing, they "came after her" and tempted her quite a bit. She probably just started with the one line and and went from there.

Question

My question is this my father who is 71 years old and serving a prison sentence at Lompoc prison. Now my father who in total before bills per month in retirement and pension receives $4500.00 and owns a house. Now before he had to go turn himself in put my sons name on his banking account who is 23 years old. He puts him on so my son can pay the bills and to make sure my father has a house to come home too. In the beginning my son was doing what he was suppose to do paying the bills. Well now it is a year later and he has spent the money partying and what not. From the start my father never got a power of attorney for my son and I want to know how can I go about getting a full power of attorney granted to an accountant so my fathers banking account and house can be taken care of properly like my father wanted in the beginning. Now I know my father has access to a notary and he can sign forms via mail. Thank you for taking the time to read this.

Answer

You can send your father a blank Durable Power of Attorney and he can fill it out and name his Power of Attorney. The Agent will first need to go to the bank and take your sons' name off the account.

I can provide you a form POA or you can purchase one on-line through various legal document web sites.

What makes nurburgring track is the best one?

What makes nurburgring track is the best one?
The Nurburgring is an old track that has changed very little over the years. Because of the sheer length of the track (over 13 miles) the area it covers is able to house garages for many different car manufacturers, including Aston Martin, Porsche, and Nissan.
The old fashioned nature of the track means that it is the ideal place to develop track based cars. The amount of mechanical grip required to post fast times at the Nurburgring means that most cars developed here have very hard suspension settings, and are often very uncomfortable to drive on main roads. Some people even say that using the Nurburgring to develop a road car ruins the car.

Question

My lease ended on October 1st and I did not give my notice of non-renewal until September 1st. I am at fault for not giving my landlord a 60 day notice, but no where in my lease does it state that they can withhold my deposit for not giving a 60 day notice. Yes, my rent was paid up till the end of the lease, my utilities were paid, and there were no damages to the apartment. Can they withhold my deposit for not giving proper notice?

Answer

Unfortunately, they are not withholding because you failed to give timely notice. It is actually your failure to give timely notice means that they are now owed rent for the month of October since your lease does not end until November 1st. Now they do have a duty to mitigate their damages so if you can show that someone else moved in the apartment or they didn't take reasonable steps to try to re-let the apartment, you may be able to recoup your security deposit. They do have to provide you a notice as to what happens with your security deposit,

Question

My boyfriend who was in the u.s is now in jamaica because he got deported in 2001, he has legal documents, he got caught for reentry and they told him he could not return to the united states indefently unless he gets permission from the attorney general. how can i help him return to the united states? can i marry him in jamaica or can i file all over again for him?

Answer

This is an immigration question. There are a number of options, and he has a 10 year bar to re-entry as part of his removal (deportation). Depending the facts, he may be eligible to apply for a waiver. He may also need to seek a waiver of his possible unlawful presence in the US. The approval rate for these waivers, vary, but in general are pretty good. I would strongly recommend you consult with an experienced immigration attorney for more specific advice. I would be happy to discuss offline further.

Can my employer fire me for not traveling for 2-3 weeks to cover striking union workers

Question

Can my employer fire me for not traveling for 2-3 weeks to cover striking union workers

Answer

Missouri employers can terminate employees for almost any reason (not discrimination for race, color, religion, sex, national origin). If I understand the question correctly, you are a replacement worker.

Because of the scope of your employment, you are in a middle-ground not covered by the collective bargaining agreement (CBA) and are not a contract worker. Therefore you could legally be fired for not traveling (or any "arbitrary or capricious reason).

Can I get charges brought upon me for not paying a payday loan?

Question

Can I get charges brought upon me for not paying a payday loan?

Answer

Yes, if the authorities believe you never intended to pay it back.

"Charges" refers to a criminal case, but you posted this under civil litigation. The lender can sue you civilly -- and even win -- whether you intended to cheat it or not. If you did, then you would be liable for fraud. And if you didn't, you would still be liable for breach of contract.

Question

1. In Florida, Hillsborough county when evicting a tenant may more than one type of evictions be processed at the same time. For example, issue a 3 day non-payment of rent and a 7 day eviction notice for noncompliance on the same day?

2. After issuing a 3 day pay or leave notice may the landlord refuse to accept a payment within the three day period?

Answer

1. Non payment and a violation notice can both be issued. Filing suit on both would be inconsistent and unhelpful. If rental is not paid, that is the best course to pursue.

2. A landlord can refuse to accept anything but full payment. A landord who accepts a partial payment will void the notice.

How can I force my X-husband to take my name off the home mortgage. He got the house in the divorce two years ago.

Question

How can I force my X-husband to take my name off the home mortgage. He got the house in the divorce two years ago.

Answer

Taking your name off the encumbrance (which is a deed of trust, not a mortgage) requires lender consent or a refinance. You may need to talk to a family law attorney who will want to review the terms of the divorce judgment.

Answer

I agree. Your husband can't just remiove your name. The lender has to. That is not easy to accomplish unless your ex refinances or sells. It is in the Lenders descretion, depending on the documents. You can put a statement in your credit report as to the factual circumstances.

Question

I was involved in a car accident about two months ago. The accident was not my fault. I suffered whiplash and some surface bleeding on my knees and arms ( I believe those were only minor scratches). I was able to walk away from the accident.(my car was a total loss)

I promptly contacted my insurer and I was told by my adjuster at my insurance company that they set aside a dollar amount for my medical treatments ( I believe it is the $10,000 maximum ) I also got contacted by the insurance company of the person who crashed into my car, they wanted to discuss settlement, but I told them I have to wait for the results of my diagnosis from the urgent care and from the chiropractor before I could discuss anything with them.

I went to an urgent care the day after the accident. Now I'm going to chiropractic treatment for my neck / back / spine. (I thought my neck and back was going to feel better with time, they never did, they actually felt worse as time passed.)

My question is about maximizing my settlement amount:

1. Does the chiropractic treatment cost come out of my settlement check? In other words, if my insurer set $10,000 aside for my case, the more I use the chiropractor the less amount I have left for my actual settlement check?

2. If the chiropractic treatment cost does come out of my settlement amount, should I stop the treatment (I'm feeling better at the moment, although not 100% healthy, I would not pay for the treatment any longer if it comes out of my pocket)

3. Do I expect a settlement from my insurer AND the person at fault's insurer OR I will only settle with the insurer of the person at fault?

Any advice and insight is greatly appreciated. Thank you for your time reading this.

Answer

1. Not sure what the set aside is that you mean. If you had PIP or no fault it will pay for 80% of the reasonable medical expenses you incurred including the urgent care. The chiropractor will be paid until the 10K is used up. Be careful as this occurs relatively quickly.

2. Settlements only occur if you have a permanent injury within a reasonable degree of medical probability. Sounds like you have some soft tissue injury for which you will receive a minimal permanent injury rating. Your case will be worth a relatively small amount of money. The 20% of the bills unpaid after PIP and anything over the 10K are your responsibility.

3.There are out of pocket payments Unless you had med pay coverage as well.

4. Your insurer should pay the PIP. If you had UM coverage that would pay if the underlying coverage is insufficient to cover your permanent damages.

5. Hire an attorney familiar with these types of cases, they will handle on a contingency basis and will only be paid if there is a resolution.

Answer

My question is about maximizing my settlement amount:

1. Does the chiropractic treatment cost come out of my settlement check? In other words, if my insurer set $10,000 aside for my case, the more I use the chiropractor the less amount I have left for my actual settlement check?

Correct. The settlement will be for a gross amount. Meaning the at-fault party's insurance company will offer you an amount that will go towards your past medical bills, future medical bills, pain and suffering and lost wages (if any).

2. If the chiropractic treatment cost does come out of my settlement amount, should I stop the treatment (I'm feeling better at the moment, although not 100% healthy, I would not pay for the treatment any longer if it comes out of my pocket)

This is a decision between you and your doctor. At some point, you will reach what is known as maximum medical improvement (MMI), where you may not feel 100% better, but more therapy would not benefit you either. At this point the doctor will assign you a permanent-impairment rating. A good personal-injury lawyer will negotiate down any medical bills you owe.

3. Do I expect a settlement from my insurer AND the person at fault's insurer OR I will only settle with the insurer of the person at fault?

It depends. If the amount of your damages exceeds the amount of coverage available from the at-fault party, and you are able to get the at-fault insurance carrier to tender their policy limits, then you can look to your own insurance company - assuming you have un/under insured motorists coverage.

Question

My Boyfriend and I wish to have a baby. I have a son from my previous marriage. If and when my son wishes to come live with me, could my ex husband, should he choose to, use the fact I had a child out of wedlock against me?

Answer

I don't know what county you live in so I can't address it since I don't know the judge in your county. I suggest that you might want to talk to an attorney that knows the judge in your county.

However, I assume that you are paying child support on your first child. If not, your ex can ask that you pay child support on your son. If you have 2 children, the child support on your oldest child would be reduced a little bit because you have a second child. However, you could also be required to provide health insurance (or reimburse your ex for the child's health insurance) for your son in addition to paying the child support. Can you afford this?

If you are not working, it does not matter, you would be ordered to pay minimum wage child support for your son, which would be approximately $200/month. If your boyfriend supports you, then he would have to pay this money. If you get pregnant and cannot work while pregnant, you would still owe this money. If you cannot pay your child support, you could be jailed for non-payment of child support. Plus, it would ruin your credit rating and the ability to purchased a house and/or a vehicle in the future.

Before you have another child, make sure that you can afford the child that is already living. Your oldest child's needs come first before this new baby.

I know that having a new baby with your boyfriend sounds like a great idea, but many women do not understand the problems that can occur - especially when their ex has custody of their child.

I would urge you to talk to an attorney about all the financial and legal possibilities that could occur if you get pregnant. I've seen women end up physically ill due to the stress when their ex learns that they are pregnant and the ex decides to file a modification regarding the child they share. Some women have lost the right to visitation of their children because they were unable to come to court since they were hospitalized & the judge did not believe them. I've heard some really tragic stories in my 20 year law practice. Please don't let this happen to you. Talk to an attorney in person & think about your options before you move forward.

Merry Christmas! All the best to you and your family during this holiday season.

Question

I recently submitted a deposit to be able to have choice on a dog from a breeder. When the first litter of dogs came out I chose a puppy that I wanted, but the breeder declined my selection and offered me another puppy. I refused and decided to wait until the second litter, and the same thing happened. Frustrated, I decided to go with another breeder and asked for my deposit back. The breeder then offered me the dog after I said that I was going elsewhere. When I responded and said that it was too late, the breeder rudely said that I would not be getting my deposit back. There was no signed contract prior saying that the deposit was non refundable. So, the question is can I get my deposit back for the dog that I never received?

Answer

Send a written notice to this recalcitrant breeder, demanding the

return of your deposit funds, and, if s/he refuses, consider filing a case

with the local small claims court(would be my advice).

when you change jobs what can you legally take with you? Can you take business cards that you have acquired from clients over the years.

Question

when you change jobs what can you legally take with you? Can you take business cards that you have acquired from clients over the years.

Answer

You can, at great risk. There is a huge body of law, and a great deal of litigation surrounding what is a permissible use of client or customer information obtained while at one employer when moving to a competitor. Taking them is not illegal. What you DO with them may or may not be, and is WAY beyond the scope of an internet Q&A.

Answer

Absent a confidentiality agreement literally prohibiting this, the California trade secrecy law provides a definition of "trade secrets" as information, including a formula, pattern, compilation, program, device, method, technique, or process, that (1) derives independent economic value, actual or potential, from not being generally known to the public or to other persons who can obtain economic value from its disclosure or use; and (2) Is the subject of efforts that are reasonable under the circumstances to maintain its secrecy. I doubt that a collection of business cards you personally received would be included in this definition. This is public information and is not (I presume) subject to compilation by your employer or maintained in secrecy by your employer.

Answer

Mr. Beal clearly has not done any customer list litigation. Who is and is not a customer or prospective customer of a particular company is absolutely a trade secret, whether that information is reflected in a collection of business cards or otherwise. I can all but guarantee you that if you use those business cards to start contacting your former employer's client or prospective clients from your new employer, and the former employer finds out, you will be sued and almost certainly successfully. One can only hope Mr. Beal's E&O coverage is paid up.

Answer

I agree with Mr. McCormick and suggest you be very careful. The employer may be able to claim that the cards you collected were in the scope of your employment, and done on the employer's behalf, not your own private interest.

Question

Me and My boyfriend have been going out for 2 and a half years. I am now 17 and He is 19. I will be 18 in two months. We are a year and a half apart. My Mom is a drunkard and has Bipolar personality disorder issues and I want to leave and live with other parts of my family so i won't be exposed to this. But she says she will turn him in for dating me because He is older. will he be charged?

Answer

Based on your question, it would appear that the relationship began when you were both minors. Consequently I do not believe that this is the type of issue that would qualify as an age-inappropriate relationship. On the other hand, if your true issue involves the challenges you face dealing with your mother, then your options are to wait two months until your 18th birthday or consider filing a petition for emancipation.

Is it illegal in Arizona to be withdrawn from school because of lack of attendance, without contacting my legal guardian before withdrawing me?

Question

Is it illegal in Arizona to be withdrawn from school because of lack of attendance, without contacting my legal guardian before withdrawing me?

Answer

Not only is it not illegal, it is the law to withdraw you. Schools get paid Federal Money for enrollment. Does it make sense to you that a school should get paid even though they are not teaching you? As for contacting your legal guardian, they are only required to send the letter out notifying them that you have been withdrawn. They will require the legal guardian to come in with you to re-enroll you.

Stay in school. There is no substitute for a good education.

Question

I was out of state and could not attend my divorce hearings. I have moved back to were my daughter resides but my ex is not allowing any communication'''''What is the most effective way i can get to see my daughter?

Answer

While it is difficult to directly respond to this without knowing exactly what the judgment says, if there is a judgment in place which does not have a set parenting schedule or does not allow you to see or communicate with your daughter, you will have to file a Complaint for Modification to change the parenting schedule. You will have to establish that there has been a material change in circumstances since the judgment was entered to warrant a change in the parenting plan.

I suggest you consult with an attorney to discuss the best way to approach this, especially if your ex-wife is not allowing any communication.

Answer

There's insufficient information on here to accurately answer this question. However, generally, 1. If the other party is not abiding by the child visitation provisions of the agreement/judgement, you can file a complaint for contempt and 2. If there is a "material change in circumstance," (i.e. your moving back to the area), you may file for modification of the judgement and ask for a new visitation schedule.

Given there's little information provided, your best bet is a consultation to ensure you proceed correctly.

Question

My broker just discovered that the escrow officer never collected the buyers deposit due three (3) after the opening of escrow. 40 days later, and when we are due to close, the buyer has vanished and the escrow officer admits she never received the deposit. What recourse to I have?. Can the escrow officer be held liable for the deposit amount?

Answer

No. The escrow officer is not responsible for policing the terms of your agreement. The escrow officer's job is to RECEIVE whatever is deposited into escrow, and then when all the terms of the ESCROW INSTRUCTIONS, not your contract, have been met for the escrow to close, to then distribute the contents of the escrow as instructed. You'll have better luck looking to your broker, for not following up with the escrow to find out if that had been done and making a demand. Also the lack of a deposit does not mean the buyer is not liable to you if you fall out of escrow and subsequently have to sell for a lower price or incur more expense before you close at the same price.

Answer

I agree with Mr. McCormick. The escrow officer has a duty to act as a third party neutral and comply with the terms of the escrow instructions that you signed with the buyer. The escrow officer does not have a duty to enforce or make one party comply. The escrow officer must receive funds and account for them, but not chase people down and collect them.

Answer

Your broker is trying to shift responsibility to the escrow holder. The escrow holder's duty is to HOLD stuff delivered to it, like money, documents, etc., not to go out and tell the parties "Hey, your deposit is overdue!"

Question

Hi,

I was 24 hours from closing on a house when our bank identified that no permits had been pulled for a new pool, new office addition, and kitchen remodel. I was down as I figured it may take some time to sort through. My agent told me that the sellers agent had "contacts" in the city and would get them rushed through. True to her word, we received an email from the sellers agent stating "permits are in hand!". Being my first home purchase, I was shocked but assumed they were done. Fast forward 1 year (this summer) and we are starting a deck remodel that we were going to pull permits on when our contractor tells us we cannot start due to "expired permits". Shocked, I find out the sellers agent only opened the permits (paid initial fees) and was able to sell the house through a loophole and the permits expired 180 days later. I am looking at $500+ in permits, $2000 in engineering stamps and that is only if everything checks out and passes. Do I have recourse against my agent? I signed a contract with her to be my sole agent and she would absolutely know that permits cannot be opened-closed in 24 hours. I feel she just wanted her 13k paycheck. Now I liable for work that was never permitted.

In reviewing the sellers disclosure notice, they checked "no"next to if they were aware or had done any room additions/renovations that require permits. They then select "yes" under major improvements done citing the pool etc.

Please help on if I have a small calims case and who it would be againts.

Thanks!

Eric

Answer

Eric, you may have a claim against both realtors which may be covered by their errors and omissions insurance based on the facts and actions/inactions you discussed above. Not knowing exactly where the fault was 100%, its best to include everyone who was liable wish may also include the sellers.

Question

Is there still an applicable statute of limitations for a misdemeanor that was caught on video surveillance but reviewed after the statute of limitation to prosecute has passed?

Answer

The statute of limitations starts to run when the crime is committed, and stops when prosecution commences (when a warrant is sworn, a citation is issued, an indictment is returned).

So the general answer is no. Wait too long to commence prosecution -- twelve months in the case of almost all misdemeanors -- and prosecution is barred.

BUT, there are exceptions that stop the running of the clock, a process known as "tolling" the statute of limitations. These can include leaving the state, or willfully concealing the commission of the crime (such as hiding the video tape).

What is the importance of a library card in your life?

What is the importance of a library card in your life?
A library card enables you to borrow books, CDs, DVDs, videos, lecture series, reports, magazines, newspaper archives, books on local history, maps and other media from your local library for research or enjoyment. It allows the use of onsight computer terminals at most library systems. It enables you to receive help in locating materials that meet your needs.

In some areas membership in the regional library system allows the online management of your library account. In those systems, such as the one in Massachusetts, you can order material online from any library and have it sent to your own branch. The system sends an email when your material is ready to be picked up. The system also sends an email two days before your material is due back.

A library card is one of the most valuable free services a person can take advantage of.

i am not quite sure but i think it cost 10-20 million US dollars then there is research, prototypes, huge amounts of aviation fuel and stuff added in.

so probs all up around 200 maybe 300 million dollars.

then you also have to pay the workers (especially the driver as he would know there is an extremely high chance of blowing up.)

so i think in total around the 1 billion mark...

Question

I hit some hard times and I'm extremely late on some credit cards. What rights does the creditor have per a judicial judgement. What would be the basis to garnish wages for that?

Answer

In North Carolina, there is no general debt garnishment. Now, if you owe child support or taxes, you might be subject to garnishment, but for general credit card debt they cannot garnish wages.

Answer

There is no wage garnishment for credit card debt. That said, if this has gone to judgment, that is not the end of the matter. Judgments last forever. The judgment will get bigger and earns 8% interest per year. The judgment is collectible for 10 years after it is entered, but it can be renewed for another 10 years. So that is 20 years for this to be hanging over your head. While it is there, it remains on your credit report. Getting any kind of credit, with an outstanding unpaid judgment, will be difficult or next to impossible if you are looking for a decent interest rate.

So you need to think about how you plan on resolving the debt, if not today, in the immediate future. If you have a lot of debts, then maybe you want to file bankruptcy if you are relatively young and hope to obtain credit or acquire assets in the future. If you are elderly and on a fixed income and will not be needing credit, then bankruptcy is not an option.

You can pay the judgment directly or at the courthouse. In either case, keep track of your payments and be mindful of the fact that there is interest on the debt so you want to make sure that you pay enough to cover the accrued interest plus something on the principal. Depending on the assets that you have, this is not the option I would recommend.

You can also try to resolve the debt for less than what you owe. If you are disciplined, then try to save up as much as you can and when you have about 50% of the judgment saved (remember, the 50% will be on the judgment plus the accrued interest) you can try to resolve the debt. If they say no, see if you can use the 50% as a down payment and pay the balance over 1-6 payments. If they still want too much, keep saving and try again when you have more saved. Most creditors will accept between 50% and 80%, but it depends on your unique circumstances and why you have fallen on hard times.

If you would like to explore your other options and ways to protect yourself from execution, I give free email consults. I also can assist in resolving debts for a reasonable fee. Please contact me at [email protected]/* */ if interested.

Can a union or employer require you to live in a certain zipcode for employment/hiring within that zipcode?

Question

Can a union or employer require you to live in a certain zipcode for employment/hiring within that zipcode?

Answer

On its face, there appears to be nothing illegal about it, particularly if there is a business related reason for it (such as the need for workers to be close to a worksite). But if there were evidence that the intended consequence is to discriminate against otherwise eligible workers because of race, the practice could be questioned in court.

Answer

There are some situations where the employer MUST hire people from a certain location. For example, some government contracts give bid preferences to bidders who commit to a local hire quota. Also some redevelopment projects and urban development arrangements require businesses to "hire local" in order to qualify for tax breaks.

Question

I do not want to give my husband 50% of salaries that I got after divorce petition filing. What point should I raise in court?

Me and my husband are going through divorce. Before filing for divorce, my husband left his job and joined MBA school. We are living separately since the last 6 months. I am still earning. No children involved. He is delaying the divorce by taking unreasonable time on interrogatories. Now he is demanding 50 % of my salaries that I earned after divorce petition was filed and we started living separately. What point should I put before judge so that I do not have to give him 50% of my salaries?

Answer

Do you have a lawyer? Does your husband?

No judge is going to give him 50% of your salary. Your husband is an idiot.

Question

Georgia Child Support

I am a divorced custodial parent of a 13 year old. The non-custodial parent pays 250.00 a month in child support. The case is up for review/modification now and the non-custodial parent is trying to get an evening deeper discount on his support payment. Now that he is remarried, is his total ''household'' income taken into consideration for determining the amount of child support that should--name removed--paid. He wife is working a corporate job and he (the NCP) does benefit from that income. Also, how is his income from''contractual work'' from photography jobs calculated for consideration. Of course, he is not disclosing '' all of his income.

Answer

Re: Georgia Child Support

Modification of child support is not a do-it-yourself project. Although it may sound unlikely, there is a chance that the $250 payment may be reduced even further by crafty representation. You really can't afford to not hire representation.

Answer

Re: Georgia Child Support

You should consult with a local attorney. There is too much at stake to risk trying to do it yourself. All of the parties' financial positions need to be examined.

Question

How can a father sign a birth certificate after the birth of the child and can the child have the father's last name even if he doesn't sign the birth certificate

Answer

You have to file a petition with the court to enforce your parental rights. Contact my office for free consultation.

Answer

The father can file for paternity with the court in order to have rights to see the child. However, as to the name, this is really up to the mother. I don't see the court forcing her to add the father's name to the child especially if the parents are not married.

Question

I am on a "full-ride" scholarship at a public university in Michigan. I signed my agreement/acceptance of the scholarship when I was 17 years old. I will have sufficient credits next year to graduate early by 1 year. However, I just found out that I need an extra 36 credits to fulfill "Honors" requirements for my scholarship, which would push my graduation back a year and create issues, as I am already signed up to leave for the Marine Corps next May. If I choose not to do so, is it likely/possible that I could get sued? Or instead will they just withold my degree? Or neither?

Answer

Look at the terms of your contract - it's likely that if you don't comply with the credit/degree requirements specified in the contract, which apparently includes the honors credits, then you aren't entitled to a degree and/or the scholarship, and the school will withhold your degree. try to resolve it amicably. the contract may just encompass the financial terms of your scholarship - is the scholarship even with the school, or with another person or entity?

If the scholarship is not with the school, then the school may not be able to withhold your degree if you have completed sufficient credits according to the school's policy. It is the party who is paying your tuition that would have the beef with you if you violated the contract.

The scholarship contract is likely void because you were a minor when you signed it and you can't enter into a binding contract until you're 18 or legally emancipated. However, claiming the contract is void may not be in your best interests, as that could open up the door to them claiming you owe them all the tuition money. While that is a far reach, they could try to pursue it. whether or not a court would allow them to try to collect against you, and/or ultimately win, is a different story.

If a contract is found void, it's as though it never existed. However, there are other principals of law that come into play when a contract is found void (or where a contract wasn't in writing), called "equitable remedies." You received a substantial benefit as a result of the scholarship contract, which entitles the paying party to something if you violate the contract. How a court would exactly decide this issue can't be opined on - there are certain applicable theories of law that i explained above, but courts apply the law based on the specific facts of your case.

have you asked about a hiatus from school - like a 1 or 2 year break so you can go to the Marine Corps and then come back and finish school, without violating your contract and/or ensuring that you will still have a scholarship to count on? Even if that's not permitted according to the current contract, you could negotiate an amendment. If you do modify the current agreement, ensure that it's in writing and that you understand what you're agreeing to.

You may wish to retain a lawyer to review your contract and/or negotiate with the paying party and the school to ensure that you are fully protected and obtain a good result.

Good luck.

Thank you.

Question

I have a cabin on a lake in northern Minnesota. The last time I was there, my wife and I were having breakfast when out of the blue a Mn. conservation officer (game warden) barged through the front door of my cabin without knocking or announcing who he was.

I asked him what the "bleep" he was doing and to get the "bleep" out. He said he wanted to make sure it was me and not a burglar in the cabin and he had the authority to enter any time he wished.

The strange thing about this is my wife and I have met this warden at least six times before so he knows my vehicle and had no reason to believe there was a burglar.

I told him that I appreciated his concern but to never enter my cabin without knocking first.

He got mad and on his way out he said I would never know when he would show up again.

My wife and I have never been in trouble with the law and after this last encounter, we don't feel safe at the cabin any more.

My question is just how much authority does a Mn. conservation officer have?

Don't they need a search warrant to enter my cabin without permission just like a police officer? Do I not have any right to privacy and at what point do I have the right to protect myself and my family if I feel threatened?

Thanks so much for your help.

Answer

There are times when an officer can enter private property without a warrant and without consent. One of these exceptions applies if the officer reasonably believes somebody inside is in imminent danger. That does not seem to be the case here, but it is the exception that most closely resembles the officer's response.

Based on the limited information you have given, I don't think he was justified in entering your cabin. And that assumes a conservation officer has the same authority as a police officer, which might or might not be true.

Question

an 19 year old acquaintance committed a felony. does he qualify for legal aid- ( he doesn't work-) or are his parents responsible for obtaining a lawyer for him? they reside in brewster, new york?

Answer

Whether or not he will be assigned a free lawyer usually depends on the jurisdiction of the court. In New York City the standards are very lax and he would be given a lawyer. In some upstate counties, because of his age, they may require the parents to pay for the lawyer, unless he is emancipated and not living at home with his parents.

There are a number of possibilities depending on make and model. An unusual one I have seen happens mostly when there is less than full tank of gas. The fuel pickup tube is cracked and the sloshing of fuel can cause the sucking of air into the line. This same sloshing of fuel can happen shifting from reverse to forward. sometimes this will happen only when turning right but not when you turn left or vica versa. If left un fixed long enough the tube may eventally suck air most of the time preventing the car from running at all-Backyard Mechanic

Question

Search warrant in 2008 by postal inspector and Cook County,IL Sheriffs;seized ipod, dvd's,camcorder.I have never been arrested but when I apply for jobs background checks come back as "federal charges pending".How can I get my record cleared?

Answer

Hello. My response here is based on the information that you have posted on this web site.

You should immediately hire a lawyer, if you have not already done so. Attempting to do this on your own is counter productive. It may be necessary for a lawyer representing you to contact the office of the Cook County State's Attorney and the Office of the United States Attorney to verify that criminal charges are pending. Mistakes can be made and the information that there are charges pending when you apply for jobs could be inaccurate. There are additional comments and suggestions that I can make.

Answer

The fastest way for you to determine what's going on is to hire an attorney to contact the local and federal prosecutors to find out about your situation. If your items were seized in 2008, enough time has passed so that you should have some idea if any investigation going on against you. If you have no idea why you would be investigation it may be an error. This does happen occasionally and it is possible that your record has an error on it that was never removed.

If you would like to talk about your matter in greater detail or need help, feel free to contact my office at 773-791-9682.

What are the 3 main types of sculpture?
The three main types of sculpture are assemblage, in the round, and relief. In the round is what we usually think of when we think of sculptures; free standing solid piece surrounded on all four sides by empty space. Assemblage is a sculpture, free standing like in the round, but made of different objects put together. Lastly, a relief sculpture is a form or picture that projects out from or is mounted on a vertical surface.

Question

Is money transferred to an individual for an investment in real estate (land acquisition and construction) becoming that individual's property, or it remains my property, therefore that person is only managing my money? The money was wired per the provisions of a signed contract. I have a civil case against this individual, ONE of the causes being CONVERSION. Can I have a case of conversion under these circumstances? Is there any similar previous case on record?

The opposing party is seeking to get a judgment on the pleading granting the dismissal of the conversion claim, which I have to oppose.

Answer

What do you mean, "you have a case"? You filed a lawsuit by yourself without a lawyer? I can think of some other legal theories that might apply to your situation but right now your immediate problem is not losing your case on a motion for judgment on the pleadings.

Answer

Telling us you have a contract is a start, but we don't know what the contract says. We can't offer much guidance without that information.

Answer

Representing yourself in a case like this is swimming through shark-invested waters wearing a steak jacket. It sounds like you are way out of your depth here. There are several legal issues that pop out. The contract needs to be reviewed to determine whether the other side actually followed through with their obligations.

There are several possible causes of action that come to mind: breach of contract, misrepresentation (fraud), breach of fiduciary duty, breach of trust. However, without seeing the contract and discussing the facts it is impossible to know which if any of these might apply.

You really should have a discussion with an attorney to review the contract, discuss the facts and determine how to proceed.

Let me know if you would like to discuss it.

Caleb

[email protected]/* */

Answer

There are several possible legal consequences of the transfer of funds, and eliminating the wrong ones would require much more information about the circumstances and the language of the contract.

The possibilities include:

(1) The payment was due to the payee under the terms of the contract, and ordinary contract law must be applied to determine whether there has been a breach or not;

(2) The payment was an entrustment of funds to your agent, and agency law will apply. An agent is a fiduciary of his principal, and has duties akin to those of a trustee with respect to the property of the principal.

(3) A partnership was formed, and partnership law applies.

(4) The contract is a home improvement contract, and the provisions of the Business & Professions Code relating to such contracts will apply;

(5) The supposed contract is part of a fraudulent scheme, and tort law will apply, as well as the portions of criminal and contract law dealing with fraud.

If you are facing judgment on the pleadings, there may be something terribly wrong with the way you have (a) analyzed, and/or (b) presented, your legal claims, and the remedy is to give up your pride, and a few bucks, and get a lawyer involved before you suffer a judgment on the pleadings.

Question

I have court tomorrow, and I don't know what to do. I basically wrote a bad check for $100 2 years ago, not purpously but I know in the laws eyes, a bad check is a bad check, regardless. I moved and never even thought twice about it, I had closed the bank account due to fraud at that time and completely forgot about the check. Then one day, I get pulled over and BAM I have a warrant for it. I went to jail and got a bondsman to get me out for the bond of $358 and tomorrow is my arraignment. I am not sure how to plead or what I should say...can someone help me?

Answer

Many times the State will dismiss the case if you pay restitution (cost of the check plus the stores fees plus the prosecutors' office fees) up front. Also, if you have proof that you closed the account because of fraud, you should bring that with you.

Answer

A bad check is considered a theft case. Therefore, many times if you pay the check amount and the stores costs you may be entering a guilty plea. If you are concerned about the case becoming a part of your criminal record, I suggest that you retain an attorney and if you cannot afford an attorney ask for one to be appointed to you. You need someone to assist you with taking care of this matter without creating a criminal record or without disposing of the case in a manner in which you will not be able to clear your record at a later date. You must keep in mind that when you are negotiating with a prosecutor, you are negotiating with someone that is trained in the law and who is under no obligation to give you legal advice about what your best options are to protect your rights and preserve your future.

If you show up in court without a lawyer for your arraignment the Court will usually give you a continuance to hire an attorney or allow you the opportunity to apply for a court appointed attorney.

Generally, I usually set my client's theft by check cases for trial and have had a 100% dismissal rate due to the fact that I know what the rules of evidence are as it relates to these types of cases.

Good luck!

Answer

Do not try this without an attorney. There are a lot of options that can help you but the prosecutor does not have to discuss all of them with you. Actually, in most counties, the court will make you get an attorney. If we can help you, please let us know. (817) 336-8500.

Question

legal distinctions

If a Federal Appeals Court issues an opinion (precedential) with an order to Vacate and Remand back to the subordinate court consistent with their opinion, what is the legal effect or meaning of them issuing a followup ''mandate''?

Answer

Re: legal distinctions

The court's opinion is the explanation of its legal rationale for the ruling that it makes (e.g., reverse, remand, etc.). The "mandate" is the order to the lower subordinate court directing it to take action consistent with the opinion. Until the mandate issues, the opinion can be changed. After the mandate issues, the only way the opinion can be changed is by recalling the mandate, or by a higher court.

As you might imagine, there are a number of considerations involved here...such things as (1) did your father also sign the agreement or (2) did he provide verbal agreement to your signing the contract; (3) what is specifically wrong about the vehicle; (4) how much you stand to lose in simply not paying for the car...etc. So, a quick conversation with an attorney would be the best next step.

Is a court order from Romania to pay child support is valid in US?

Question

Is a court order from Romania to pay child support is valid in US?

Answer

It is valid if validly issued under the law of Romania. The real question is it enforceable. The answer to that is not automatically, but it can be made enforceable under the Hague Convention by a process that involves obtaining orders from the Romanian courts requesting the U.S. courts to enforce the order, and then going into the U.S. courts and obtaining enforcement orders that can be used in the U.S.

Legal AssistanceIs there any agency that assists women in getting a divorce when their husband sexually assaulted their child?

Question

Legal Assistance

Is there any agency that assists women in getting a divorce when their husband sexually assaulted their child?

Answer

Re: Legal Assistance

I do not know of any agency set up for that purpose.

However, sexually assaulting a child is a horrible crime, and would be a very clear reason to get a divorce.

It is MUCH easier to get a divorce with the assistance of an attorney. You may want to ask Legal Aid in your area.

If you would like, give me a call; I am in Hackensack (northern New Jersey). I will be happy to discuss

this with you; a brief telephone consultation will be free.

My contact information can be obtained from the links below, just click on the Attorney Profile link. Let my secretary know you found me through LawGuru.

and this law firm. You can not rely on the statements made by an attorney given over the internet. The

exact facts of your situation, including facts which you have not mentioned in your question, may completely change the result for your situation.

Answer

Re: Legal Assistance

You seem to be asking whether there is a group that will provide an attorney based on the violence against your child by the father. There are domestic violence groups who will provide an attorney which will eventually have to be paid. There should be such a group in Bergen County. You might call information or the domestic violence office at the court house.

Call me if you like.

Can My Daughters Mother TakE My Child To Live In Another State.

Question

Can My Daughters Mother TakE My Child To Live In Another State.

Answer

If there is no custody order in place then yes she can. If she leaves and you find out about it, you can file an emergency custody petition to force her to bring the child back. Once the child has lived outside of NC for 6 months or more, NC will lose jurisdiction. If you are concerned, I would not wait until the mother leaves the state. Be proactive and file for custody/visitation now to get a court order established. If you can afford it, I suggest that you see a family law attorney.

Question

I am a Canadian citizen. I married a US citizen in 1999 and was granted lawful permanent residence in the US in 2002 (green card). After 11 years of marriage we divorced in 2011. I am applying for naturalization. The document checklist on the back of the guide states, "If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items" and lists documents for my spouse; tax returns, birth certificates, CURRENT marriage certificate. It also states "If you were married before, send: Proof that all earlier marriages ended (divorce decree(s), annulment(s), or death certificates(s))."

Even though I am divorced, and have been a lawful permanent resident for more than 5 years, I am still required to submit all of my (now ex-wife's) documents of proof of her citizenship, marriage certificate, tax returns, etc, AND proof of our divorce decree?

Answer

Hello:

Not if you apply under the 5 year provision.

Divorce

How can I file for divorce and be able to keep my home? The house was solely in my name until August last year, when I had his name put on the house he started acting crazy. On October he'd been drinking and we had some words he pushed me down the stairs to the laundry room and I broke my ankle in three places. I didn't file any charges because I have my grand daughters living with me and I'm afraid that I won't have any place for them to live. I want out but I'm afraid of losing my home.

Re: Divorce

Better see a lawyer appropriately knowledgeable and experienced in Virginia domestic relations law who will be able to advise you as to how you can go about keeping your home while simultaneously pursuing a divorce action against your spouse.

Question

I have4 children with my ex wife and I pay $546 monthly in child support, but every few days she calls or the kids call on her behalf asking for money for food, haircuts, cell phone bill. she has 2 other kids and currently married and her husband doesn't work but she does. They always cliaming that the 4 kids my I have with her needs food. Is there anything legally that I can do to find out what she spends the child support money on? Can the child support money be used for electricity or rent if she works? And also if he has the kids in the summer during the day 7 days a week can they lower the support?

Answer

Q. Is there anything legally that I can do to find out what she spends the child support money on?

A. No, so long as the children's basic needs are being met.

Q. Can the child support money be used for electricity or rent if she works?

A. Generally, the money is for the children. However, the custodial parent generally pools the money with her income and uses the money to pay bills.

Q. And also if he has the kids in the summer during the day 7 days a week can they lower the support?

A. The non-custodial parent would have to make application for a modification of child support. The modification would have to be from a unforseen change of circumstance. If having the children 7 days a week duriung the summer is an unforseen change of circumstance, then the answer would be yes.

Question

I am 17 years old i have no criminal record. I live in michigan. Me and my friend were messing around being stupid. My friend was laying across the hood of my car as i drove forward and backward at a fairly low speed. This happened in a completely empty parking lot at night a cop drove past saw what we were doing and charged me with reckless driving.also idk if this means anything but my dad is a cop coming up on 26 years. Is it likely that this charge will be reduced? because i really do not want this on my reord and im scared. Also is there any classes, proations, community service, or lisence suspensions that i can serve to have this charge reduced to carless driving or something else? Please tell me what you predict that outcome of this will be so i kno what to expect dont sugar coat it. I need to know thanks!

Answer

You need an attorney on board right away. You might want to check with your dad and his connections too. You should be ok without a record. Careless is often the plea from reckless. Tim Klisz kliszlaw.com

Question

I recieved a tax bill yesterday for unpaid taxes on online cigarette purchases. My question is, are we the consumers responsible for tax collection? isn't tax collection the responsibilty of the seller? I purchased cigarettes from these online vendors with the understanding that they sold cigarettes cheaper, not that they weren't collecting taxes for those cigarettes. Do we as consumers have any recourse?

Answer

The tax you owe is known as the "sales and use" tax. When an out-of-state seller does not collect sales tax, you have an obligation to report the purchase on your New Jersey income tax return and pay sales tax on the item. This sales tax is officially known as the "use" tax because you as the user must pay.

The state of New Jersey is bankrupt. They are doing anything they can to squeeze tax dollars out of citizens. This is unfortunate but true. My suggestion is that you move from the state like New Jersey that has high income, sales and use and property taxes.

I hope this helps!

Question

I was recently stopped while driving and my car was illegally searched. When I asked the officer what was I being pulled over for he opened up my door and told me to get out. My car was searched without my consent and I made it very clear that I didn't give permission for him to search the vehicle. I was not speeding nor do I have any violations. This is happening to me too often and I was considering suing the police department. Can you let me know if i have a right to do so. thanks

Answer

Under the facts you described, you may be able to sue; the officer, their supervisor, and maybe the governmental entity that employs them. You need to consult directly with a civil practice attorney in your area. After seeing the specific facts of your matter, they may be able to give you specific advice about your options.

Question

CPS had to come to our house because there was a dispute between my mother and I and my five month old son was in the room. CPS came and said everything seemed fine, but wanted me to file for child support and custody from my baby's father. Do I have to because she requested it?

Answer

You do not have to these things because CPS requested it. You do need to think very seriously about what steps you are taking to establish your independence from your mother and put your child's best interests first. You should contact your county's office of the California Department of Child Support Services to start the support proceedings and the Family Law Facilitator service to start the custody proceedings. By taking the actions that CPS is recommending you are protecting yourself from what may happen if CPS becomes involved in your situation again, and you have not taken these actions. If there are reasons for your not having taken these steps, you should discuss those with staff with the child support and family law services agencies. You should also consult with a family law attorney.

Question

I closed on a home in California in February and one month later our realtor disclosed that the house was involved in a class-action suit (seller as Plaintiff) with the builder, and was at the time of the sale. Are we now obligated to disclose this whenever we sell the home? Is there a time limitation on disclosures of certain information?

Answer

If you have knowledge that your home has a construction defect that would affect a person's decision to buy your house, you will have to disclose it, regardless of the amount of time involved.

Answer

Your disclosure obligation extends to anything of which you have knowledge, which reasonably could be presumed to affect the buyer's impression of the value of the property in a substantial negative way.

Dear Attorney,Am I required to provide screens on windows to my tenant? If some windows do not hold up then am I required to get them fixed?...

Question

Dear Attorney,

Am I required to provide screens on windows to my tenant? If some windows do not hold up then am I required to get them fixed? I suspect that the tenant has damaged these windows and they don't hold up any more.

Also, the tenant gave me a single cheque that says first month rent + security deposit. I asked him to give me two separate cheques. Since I can not deposit the first month rent and security deposit in the escrow account, I deposited the cheque in my Savings account. I thought it would be a violation to deposit money in security deposit escrow account unless the amount is only for security purposes.

So I treated the amount as first and last months rent and verbally communicated this to the tenant. Did I do the right thing or can the court find me at fault here?

Thanks

A landlord who is getting a hard time from the tenant

Answer

I would suggest you put the change in writing and have the Tenant sign the change as agreed. However, last month's rent should be put in an escrow account accruing interest.

If the current tenant damaged the windows, then they are responsible for the repair. This is assuming the damage did not occur as part of normal wear and tear. If the Tenant calls the Health Dept, they will require you to provide workable screens for the windows. I would provide working screens and/or repair the windows so the old screens work.

You could deposit the money into a savings account or operation account, making a copy of the check the tenant gave you and deposit the security or last months rent into an escrow account and give the Tenant the required information on where the money is being held.

If you go to Mass Trial Court Libraries online, there is a very good article on how to be a good landlord. Check out law about Landlord-Tenant.

Good luck

Question

I received a Notice of Motion for a foreclosure on property in Illinois that I sold in the mid to late 1990s. I was listed as one of the defendents after the current owner. I do not have any interest in this property and do not hold any property motgage. Are all previous owners listed as defendents on Illinois foreclosure paperwork along with current owners?

Answer

I think you asked this differently the other day. If so, again, please note before a lender files for foreclosure, they get something like a title insurance commitment which, for purposes of foreclosure cases, is called "Minutes of Foreclosure". For some reason your name must be popping up. If you do not know why and you may still have some kind of interest in the property (and you may not be able to determine this on your own) you should contact the attorneys for the lender and ask what's up, or have an attorney do it for you. This would be especially true if you took back any kind of owner financing when you sold the property; that could be wiped out in a foreclosure.

Question

We had a restaurant in N. Alabama .We decided to close it after the landlord told me they had a person interested in moving into the building and leasing our equipement as part of the total lease. She would then pay us our portion after she received the total rent every month .It went well for five month. The landlord called yesterday and advised her they would no longer include the equipement in the rent payment. She was told there were some issues with some of the equipment .

This is the first we heard of these issues. We did not include a warranty except we would have everything in working order, which we provided.

My question is who is responsible? The landlord put together the lease. The lease is for one year with options. They have paid us 5 months. This lease includes equipment dishes pans hoods etc.

Where do I stand?

Can I remove my items at once?

Answer

As a Franchise Attorney I can only say your narrative is confusing. But, bottom line, it seems like everything is based on the lease. That document needs to be carefully examined before any advice is possible. Your equipment is in someone else's possession and on their property You can't just walk in there and take it - unless you want to face criminal and civil charges. Consult with a good business or franchise attorney in your area for specific advice.

Why is there no heat for a 1994 mercury grand marquis?
It could be a couple of things, but check the easy things first. Check the anti freeze level with a anti freeze checker, if there us more water in the radiator than anti freeze the water will evaporate and the heater will blow cool. next check the thermostat, you have to take it out and heat it up in hot water and see if it opens up when it reaches the right temp when heated it will open up,those are usually the two most common problems.

What is a one movement musical work called?

What is a one movement musical work called?
This answer pertains to western classical music.

There is no singular term for this. Sorry.
Many musical forms are in one movement. To further complicate things, a particular form may change definitions over time. Thus, was was a multi-movement work in one period may be in a single movement 100 years later. Still more, as composers' individuality became more and more fore-fronted, they could individually violate standard definitions if they wanted to.
All that said, symphonic poems and tone poems often come in a single movement and they are often "through composed." Many through composed music is in a single movement (fantasia, fugue, for example), although they don't have to be. Many sectional works (in binary form, ternary form, strophic, etc) can be single-movement, although they are often joined with other sectional forms to form a multi-movement work.

Question

A judgement was made to award me a percentage of my husband's 401(k). I don't have a lawyer. I've been flying back and forth to court for over a year and a half. My husband's lawyer entered a QDRO in my divorce. I saw the cook county clerk's website. I was not there because I live in Los Angeles and it is a hardship for me to travel back and forth. He filed a motion and mailed it to me in L.A. I gave his lawyer the account number to my new rollover IRA account that I set up. How and when will they distribute my husband's 401 (k)? What do I need to do to have it rolled over to MY IRA account?

Answer

You need to make the arrangements yourself. You are acting as your own attorney and it is not your husband's responsibility or his attorney's to set up the rollover.

Can an aluminum throttle body withstand exhaust heat at the point where the muffler is... its for an exhaustmuffler bypass project...?

Can an aluminum throttle body withstand exhaust heat at the point where the muffler is... its for an exhaustmuffler bypass project...?
The temperature at which Aluminum melts is 1220 F. The exhaust manifold could easily reach 800 F. Further down the line where most mufflers are located, is between 100-300 F. Aluminum would definitely stand up to those temperatures, however the challenge is going to be attempting to weld Aluminum, to mild or stainless steel because they two metals don't mesh. There are different methods which make this union possible, but they are not something a hobbyist should attempt, seek professional advice on that one. I would suggest using an exhaust cut out instead.

Question

Had a painting business for 25 years stoped doing work about 3 years ago closed the corporation 1 year ago received a law suit in the mail for 18 homes that we did the job had a wrap insurance policy the general contractor wants us to pay 25000 dollars that is what the deductible was since the corporation is closed down was wondering what to do thanks troy

Answer

Well, once sued, you need to file and serve a response (usually, an answer) within 30 days, or face default. However, a suit against a corporation that legally no longer exists because it has been dissolved will face tough sledding in court. Giving you an answer that is both safe and legally responsible would require additional information, including (a) whether only the corporation is named as a defendant, or whether the suit names you (or others) as additional defendants; and (b) whether you "closed" the corporation by following the prescribed procedures that cause it to cease to exist under the Secretary of State's rules, or merely shut it down without official action. Please feel free to contact me with a few more details (at no obligation) but by all means don't fail to respond to a lawsuit filed against a legally viable corporation.

Question

My GMC Truck is being declared a Total Loss by 21st Ins. I have informed them the Brakes failed, and want inspected. (GM Recall thru 2003,problem still continuing) they have already transported to Salvage yard, even tho I have Aftermarket parts and wheels I want off of it. I believe as I have signed no release...the truck is still mine, and I have Ownership no matter where it is stored, and noone else has right to deny me,or my son access. Is this correct ? Also I have recvd no responses or updates as to other parties involved in accident....CAN I Hold off on signing over to 21st ? and demand moved to area where I can remove MY Parts: rack wheels tool box, etc... Salvage/Auction has no legal rt to my vehicle...

Answer

Go get your vehicle and store wherever you like. You don't have to accept the insurance company's offer and you don't have to release the vehicle to them. If there was an accident due to mechanical failure and the vehicle is disposed, you will not be able to prove your case. You must preserve the vehicle.

Question

I want to know how and what paperwork I need to file in order to petition the courts in Louisiana for custody of my cousin. The mother is deceased and there isn't father listed on the birth certificate. The child currently resides with me in another state. I dint have enough money to hire an attorney and I don't qualify for legal assistance.

Answer

In almost every community there is "Legal Aid" (also known as a Legal Services Corporation). Go speak to them. If they cannot help you, they should maintain a list of lawyers who would work at reduced rates.
