Question

Can an attorney charge me by the hour for travel time to visit me in Jail and he visited another inmate at the same time.... I think this would need to be split....

5 hours were charged to me he spent 10 min with me and 20 with the other Inmate....

I got charged full price the other inmate was a court appointed and paid for by the state

Answer

Maine Rule of Professional Conduct 1.5(1) states, in part: (a) A lawyer shall not make an agreement for, charge, or collect an unreasonable fee or an unreasonable amount for expenses. A fee or charge for expenses is unreasonable when, after a review of the facts, a lawyer of ordinary prudence would be left with a definite and firm conviction that the fee or expense is in excess of a reasonable fee or expense.

Although it is reasonable to charge for travel time, it is not reasonable or ethical for an attorney to charge two clients for the same action. You are correct that it should be split.

Why cant i stop texting pleaseeee tell me?

Why cant i stop texting pleaseeee tell me?
Because you find significance in distancing yourself from real communication. It makes you feel uncomfortable to be around people so texting allows you to keep a social facade without ever having to really show your true self. Many people in today's society are suffering from this syndrome. Seek out people you really desire to be around and force yourself to have one on one conversations with them and stop texting them only. Eventually maybe you will see that PEOPLE are more important than technology!

Question

I have been with the company for six years never any problems. Well, about three weeks ago a coworker was upset with me cause she says i was talking about her which was not true. She was waiting for me in the front parking lot when i left work she wanted to talk so i did. We were ok after that. Well, i was off for three days i come to work and she walks in threw her purse and hit her pen twice in front of me loudly. So i thought something was wrong again. As i was walking by all i said was "whats wrong" she started yelling spit on me and was screaming at me very loud. She was using profanity and then she communicated threats of physical violence. As this was going on i was in shock another coworker was passing by and heard she had threatened physical violence to me. She said she was "going to hit me in the f..... face". I said "really your going to hit me in the face" she said yes. I told her i was going to report her right now. As i was walking away she said "watch your back" i said nothing. After all this i was told to stay home for 3 days then they called me in to terminate me. They did not give me a reason why i was being let go after 6 years without any problems ever. Then as i was walking out they gave me the other girls termination paper with all her information.

Question

My brother is executor of my mother's will.We three siblings are to split savings.Does he have the right not to distribute savings until sell of the house.

Answer

Yes, if the money may be needed for taxes, expenses, claims against the estate. etc.

Answer

It's not a matter of his right. He has a duty and responsibility, legally, as executor, to make sure that expenses and taxes and costs are paid. After that is done, the court gives him permission to disburse the remainder. However, heirs can request the court to allow partial distribution, before all costs and taxes are paid, if sufficient funds are left with the executor to pay the estate obligations. Therefore, you need to inquire of the estate attorney as to whether there is a possibility of a partial preliminary distribution.

Question

Wage garnishing

I live in PA, I am being taken to court by MBNA for two outstanding balances, one is 6,000 and other is 22,000. I am working with Debt Settlement USA to close out accounts, I have already closed out two accounts. Can the courts garnish my wages. I have no owned properity.

Answer

Re: Wage garnishing

Not in Pennsylvania but they can execute on your bank accounts so if you have direct deposit you may want to stop it now. As far as Debt settlement companies a lot of my clients have complained about them and one client who was in my office yesterday was very upset that she was making payments upon credit card bills where collection was probably barred by the statute of limitations. There is an argument that such partial payment restarts the statute of limitations and some arbitration panels and/or judges may accept that argument. Do not ignore the lawsuits. At least file an answer or have an attorney file one for you.

I dont think living with him is the best thing as he has no boundaries or rules for her

Question

In florida can a 18 year old date a 16 year old. I've looked around on the internet and i seen a statement that 16, 17 can have sexual intercourse with someone under 23 is that statement true

Answer

The age of consent is 16. There is a 4 year window related to age differences being legal. So a 16 year old can date a 19 year old, but not a 22 year old.

Question

"it seems likely to me that the neighbor may be using, not only the portion which lies on the easement proper, but also part of the driveway that is on your own lot. The neighbor cannot do this without obtaining an easement from you, because you are the owner of the underlying land from the boundary on back"

Actually our property line ends at the end of the easement, so technically they are not going over our property just the easement, but the curbing that was on the edge of the easement where they cut space out to put their gate in has now eroded all of the asphalt in front of our gate and there has been no maintenance agreement or anything. It just doesn't seem like it's legal considering she could give herself an easement on her own property to her back house. Do we really have no legal standing to deny her access to the private road easement we have in our deed from when the property was originally subdivided?

Answer

As I told you when you first posted this question, unless the grant of easement was exclusive, the owner of the house in front of your property had every legal right to grant additional easements in the same location and you have no legal standing of any kind to object. What you do have a right to object to and demand correction or sue for is the damage to your curb and asphalt. The one other piece of silver lining to this is that all legal users of an easement must share in the cost of repairs and maintenance, but the owners of the property on which the easement exists have NO obligation for maintenance or repair, so whenever the driveway needs resurfacing or other repair, the owners of the new house will have to share that expense with you, whereas before it would have been 100% yours.

Answer

I agree. You don't have an exclusive right to use the easement. The property owner, not the easement owner, can decide who else may drive over the easement. However, all users of a shared easement must contribute to its maintenance in proportion to their useage. Further, if a particular maintenance issue is attributable to the fault of user X, then user X is liable for the full cost of that particular repair.

I want to know if I can get my parental rights back. I gave them up 3 years ago under coercion and a desperate mindset. I was told giving my daughter up would help my husband get her back by DCF. Question

I am currently having a case, where I tripped and fell in a grocery store, and eventually got surgery in the hospital for my arm. Would I be able to change my lawyer since it has been 3 years since the case started?

Answer

You have a right to change attorneys at any time. I am assuming that your current attorneys filed a lawsuit on your behalf already in this case, given the fact that three years have passed already. Assuming a lawsuit was filed, your new attorneys will need to arrange with your current attorneys to sign a Stipulation agreeing that your new attorneys can be substituted for your current attorneys, and the Court will have to sign an Order to that affect. Understand, that if you signed a Retainer Agreement with your current attorneys, probably on a contingency fee basis, that your changing attorneys, unless for cause, will result in your current attorneys being able to maintain a lien and assert a claim for attorney fees and costs from your eventual settlement or verdict. That is an issue to discuss with any new attorneys who you may retain in your case.

Question

I have a default judgement against a former tenant. They were nowhere to be found to be server so the courts went on without them. They recently moved to Orlando. (The judgment is in Indiana) I know that they only bring in around $1500 a month they have 4 kids and are on Public assistance. I dont want to have to go to Florida to get my money. But I was awarded garnishment in my home state of Indiana. I dont know the laws in Florida. I just want to know if its worth the $2900 I was awarded to go after them in florida. They also have no assests. Not even a car or bank account.

Answer

You would need to hire a lawyer in Orlando to conform the judgement and then try to collect the judgement. The cost may not be worth it. Maybe just hire a lawyer in Orlando to write a letter to them will be enough.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. Question

does the term "the plaintiff mortgagor waives and all rights to a deficiency against the defendant mortgagors and all other persons liable for the indebtness and other obligations, if any, secured by the mortgage" mean that the bank is not suing for any difference in sale of house and amount of mortgage owed in foreclosure? Thank you!

Answer

That is a correct interpretation of what you quoted. It is important to determine at what stage of the proceedings you are seeing this and follow the case through to the end. I would recommend taking the documents to an attorney to advise you to make sure there is not anything that creates any doubt.

Answer

This "sounds" like you are not in a foreclosure but instead doing a short sale or deed in lieu arrangement where the lender is willing to waive deficiency if it does not have to foreclose. If so this is only one aspect of those kinds of arrangements. For example, in a short sale situation if there are unpaid property taxes that the lender will not pay, then you may have to deal with this situation directly with the buyer, because if unpaid taxes show up on the title commitment and the lender will not satisfy them for you, you may still wind up having to come to closing with cash to cover them if the contract does not protect you or the deal could still fall apart. So you are still best advised to have an attorney involved to help make sure that you are protected.

Question

attorney's retainers

I recently hired an attorney and gave her a $3500 retainer for my 17 yr old son's infant's custody case. Within 6 weeks, the mother of the infant moved in with us and we asked the attorney to drop the case and refund that portion of the retainer which we didn't use (we never even went to court). According to her billing, she would owe us about $2000. After ignoring several phone calls, she now says the retainer is not refundable and her secratary said that she's in a ''bad'' mood and maybe she'll think about refunding some portion of the money in a couple of weeks. We have very limited contact with attorneys. Is this normal. Unfortunately, I cannot find the retainer letter we signed.

Answer

Re: attorney's retainers

In PA attorneys are required to have written fee agreements with new clients.

The PA Supreme Court Disciplinary Board enforces this requirement.

In addition attorneys are required to maintain an escrow account for moneies received and not yet earned.

The same board enforces those rules. You should be able to find them on the internet.

Good luck to you.

Answer

Re: attorney's retainers

Non-refundable retainers are not uncommon and most of the time that an attorney expends upon a case is right at the beginning. That reflects what her billing shows of the $1,500.00 expended within six weeks. It may be that the retainer agreement provides for a non-refundable retainer but that she is considering refunding a portion of it anyway. If it was a non-refundable retainer the question would be whether or not the retainer was clearly excessive. I don't handle custody cases and I'm not sure whether or not that type of retainer in a custody dispute would be considered "clearly excessive." But you should also know that since the case appears to have been filed, the attorney cannot just "drop" the case and that she will have to expend some further time to stop the court machinery that she set in motion by filing the case. It could be that she is just holding the balance to compensate her for her time while she does this but there is no requirement that a non-refundable retainer has to be deposited in the attorney's escrow account. But attorneys do tend to err on the side of caution and frequently place such retainers in their IOLTA or trust accounts.

In any dispute with a professional over fees, it is always best to submit the question to arbitration. If the attorney and you cannot agree on the amount that you feel should be refunded, it is best to resolve it with the Fee Dispute Committee of your County Bar Association.

can police come onto your property and question you if they see you drinking a beer while mowing your lawn on a riding mower? if so could they issue you a OUI?

Answer

You can only be charged with OUI if you are operating a motor vehicle (riding mower counts) on a public way (your lawn isn't) or a place where the public has a right of access (now we're in the grey zone).. is the yard fenced? Talk to a lawyer about the details.

No-one of the elements of OUI is public way-to which your yard is not.

Can you use a car 305 engine in a boat?
Yes, you can use a 305 engine on some boats however, you need to provide more info on the type of boat. Putting the engine on an inboard/outboard, style boat would not be difficult at all, as long as you already have a good lower unit, same goes for an inboard. An outboard, on the other hand will be difficult, if its even possible to run a horizontal engine vertically.

Question

when bringing your ex in for contempt for something like not paying his arrears in child support, (in ma.) what is the procedure for asking for attorney's fees? is one little line in the motion (or whatever it is called) saying something like "we request mr. smith to pay for mrs. smith's attorney's fees". is that enough or should you show the tons of proof you have that he was able and capable of paying it and chose to hide his money? and secondly if the judge does not address that issues one way or another, doesn't say he has to pay doesn't say he doesn't have to pay, does that mean the answer is automatically no he doesn't have to pay? because i repeatedly asked my overpriced, over billing lawyer to be more aggressive in obtaining me legal fees from my ex, when it was clear he could pay them and my lawyer made no real attempt in my opinion, to get them. it was not until i told him (after i paid him over 100,000.00 in legal fees) did i say that the only way he would receive his money this time was if he got it from my ex. my lawyer then wrote out this entire separate motion or request?? and included every reason why my ex should be responsible for my attorney's fees. if you could please answer that question i would appreciate it. thanks so much.

Answer

There is a statute that requires a person found in contempt for not paying child support must pay interest and the complaining party's attorney's fees. Ask your attorney about it. Good Luck.

We have not paid ou mortgage in 2 1/2 years. How long does a mortgage company let you stay in the house until you get an eviction notice?

Question

We have not paid ou mortgage in 2 1/2 years. How long does a mortgage company let you stay in the house until you get an eviction notice?

Answer

Mortgage companies are slow in commencing foreclosure actions because of the volume of actions.

In the meantime you can stay in the house and not pay mortgage, taxes etc

After you are served with foreclosure papers, you should contact a lawyer immediately. He can either stop the foreclosure action, delay it, or reach a settlement with the mortgage company.

Another option would be to file a chapter 13 bankruptcy which would allow you 60 months to get caught up, if y ou qualify. This also delays the foreclosure.

After the Judgment of foreclosure, and title is transferred it can take less then a month for your to be evicted,

Why does starter only engage part of the time?

Why does starter only engage part of the time?
The starter in your vehicle works at a very low speed. It is only used to crank the engine enough to help it run from a standstill. The car's normal idle speed is +/- 700 - 800rpm. Even at this low speed it would be too fast for the starter to handle. Furthermore, keeping the starter engaged would cause unnecessary wear on the starter parts, as well as the flywheel gear (ringgear). It would also be another mechanical device the engine has to turn, thus decreasing the efficiency.

Question

I live in the state of Pa. I lent a woman in Florida $1200 in June 2012. After attempts to get my money from her still haven't received a dime. Is there a way I would be able to take her to small claims court by contacting her county in Florida?

Answer

Since the woman is in florida It would make sense to file an action there. I would file in the county where she resides. Perhaps they have a small claims court in that case i would file in the one with jurisdiction where she resides. I trust you have the paperwork to establish you lent her the money.

Answer

You do not "contact" the county in Florida. You will probably need a lawyer unless the forms are online to file a small claims complaint. You file in Florida in the county where the woman resides. After she is served, unless a default judgment is entered because she either admits or claim or fails to answer, you will have to travel to Florida and attend the hearing. Another benefit of filing in Florida is: (a) if she has assets, that is where they are located; and (b) Florida allows wage garnishment if you get a judgment and she works. There is no wage garnishment in PA for a debt of this type. Also, if she has no contacts with Pennsylvania, Pennsylvania might not have jurisdiction over her if you tried to sue her there. However, even if suit could be brought in PA, you would not be able to sue in small claims. Further, if you sued and recovered a judgment, it would not be enforceable in PA if she had no assets there and you would have to transfer it to Florida or any other state where she had assets. All of this dictates to you suing where she lives.

I suggest that you try re-posting your question and directing it to Florida collection attorneys as they may be able to give you more specific advice geared to Florida law.

Before you file a lawsuit, did you have a promissory note evidencing the loan? If not, do you have some documentation showing that this was a loan as opposed to a gift? Did she make any attempt to re-pay any amount? If so, how did she repay? If she did not re-pay, have you made a written demand on her for the money? If not, you need to do so. Again, you may want to hire a Florida attorney to write her a collection letter as the letter will have more emphasis coming from an attorney and may persuade her to pay if its strongly worded.

Where to find the vin in a 1967 VW?
the vin is under the spare tire up front and it will be a 6 digit number which is your chasis or serial number. the first 3 digits on your vin are the type and year. type 1 will be 11 and year will be 7 so you should have 117 then six digits after that and that will be the number your looking for.under the spare tire it will be a plaque there. there might be other places but im not sure where i just know of the one place. i hope this answered your question and good luck.

Question

I have a judgment against me for an eviction .

I want to know if I can take it back to court to get the amount changed?

The property management company first charged me approximately $1,200.00 and then jacked it up to $8,000.00.

They charged me for $ 350.00 for a garage door opener clicker and $7,000 and some change for new carpets.

Darryl

Answer

Depending on how long its been, you should be able to go back in and seek relief similar to what you are talking about. You can do a motion to have the judgment amended and can also utilize C.C.P. 473 and other Code Sections. You will need good grounds/evidence to support your request, and make sure your request and the statute you use to bring it under are not barred by the statute of limitations controlling them. You should definitely speak to an attorney experiened in this area immediately.

Question

unpaid support

There is a lien against my property for unpaid support (temporary orders) My paychecks were being garnished each week, but I was getting next to no credit because of the interest. I had signed away my parental rights, at my ex's request. I have given money directly to both of my kids and I have documentation, which are both grown and have kids. Is it possible to get credit in order to lower the debt? 75% of it is interest.

Answer

Re: unpaid support

I am not sure I understand your situation very well. There are only temporary orders in place, yet your kids are grown, with kids of their own? Did the case never progress to a final order? Is the AG involved? You might be able to negotiate your way out of some of this, but the interest, if computed correctly, is legal. Most orders state that direct gifts to the child are not credited against child support.

Question

can we pull out and get our money back on our investment condominium in philippines becuase the builder didnt sent the official receipt of our payments and didnt sent the contract to sell agreement.

Answer

Aside from the possibility that the builder or its agents have done some probably-illegal solicitation in California, your problem and your rights would be governed by the law of the Philippines, and California lawyers would generally be unable to assist you.

Answer

If the contract were governed by California law, and it was not a telephone solicitation, you probably could not void the contract as neither of these mistakes seems to go to the heart of the contract. If you have to sue the developer to get your money back, how are you going to get him served as a defendant and what assets does he have in California that you could collect against?

Since the land is abroad, California courts might not want to accept jurisdiction to hear the case as they have no control over the asset in controversy. You would have to show that the contract was made in California and you might also have to show that the California interest in protecting its own residents out weights the location of the property [does the contract say which law applies].

You might be able to strike some type of compromise with the seller, but that will depend on how honest he/she is, what your reasons for withdrawing are, and whether the unit can be sold quickly to someone else. While you are dealing with the developer, see if you can sell the contract to another person.

Answer

Unless the developer is located in California, this is a matter for a lawyer in the Philippines.

Question

I am currently a tenant in a house. The house has been reposed by Fannie Mae and they are the owners of the property. The previous owner had told me that she will be here to take out all the appliances and fixtures that belong to her. I contacted Fannie Mae and the property manager assigned to this property and they told me that anything in this property is no longer her's. Is that true? So you know the facts as to what happened. The previous owner has not made mortgage payments in over a year, she was collecting rent from the tenants and pocketing the monies, and she had told me about three months ago that she was trying to get a short-sell on the house. I found out that once the house was foreclosed on that she could not have done a short-sell. She lied to me. The property manager said because I live her and the previous owner does not that I am the one that makes decisions as to what happens at this property. I have some friends that are in need and I told them that they can come over and take the refrigerator, washer, and dryer. Can I do this without getting into trouble with the law? If you could let me know ASAP I would be very appreciative.

Thank you,

Dan

Answer

Since you do not own the house, you do not own its "fixtures," such as those large appliances. Yes, you can get into trouble.

Question

Me and my wife just found out that a mechanic that we had owed money to, filed charges after he was paid in full. I have irrefutable proof that he has been long paid off. So now my wife has a felony - BAD CHECK: LARCENY >=$200 charge and is a fugitive. We live 11 hours away from where this all took place and she is 4 months pregnant. What are our/her options at this point? Is there a way we can submit the proof and get the charge expunged?

Answer

No, your wife needs a competent criminal defense counsel to represent her

in this matter and it is unlikely to be settled at this stage by merely "shuffling some paper" through the mails (my opinion).

Question

How do I obtain my mother's "original medical records" from the hospital where my mother stayed for four months. The hospital doctor certified that my mother had severe dementia so that she could not recognize familiar things and make informed medical decisions which was untrue. The hospital and my mother's public guardian refused to give me information about when and how the assessment of my mother's dementia was performed.

I lost my mother's guardianship because the hospital where my mother stayed reported to APS that I abused her which was untrue. APS forwarded their investigation results unknown to me to the Public Guardian Office of DMH. The hospital alleged that I did not have my mother's health directive and their doctor certified that my mother had dementia and could not make informed medical decisions, which were all untrue and I was not informed until I received the petititon one day before the court hearing. My mother's court-appointed attorney did not have time to talk to me and he was one hour late for the hearing. He orally summarized his P.V.P. report, all according to infomation from the hospital, just presented to the judge and recommended that my mother have a public guardian. The hospital's purpose was to kick my mother out of their ICU to avoid further incurring their expensive medical expenses which they could no longer get reimbursed from my mother's insurance. My mother was repeated transferred between their general ward and ICU for suctions of secretions and intubations due to their malpractice and neglects which resulted in my mother's long stay in the ICU for more than two months.

Answer

You will have to try and subpoena the records, but the conservator holds the legal authority to object to the subpoena since your mother is still living. And if you have not filed an objection in the conservatorship, then the matter may not be at issue which is required for you to be able to issue a subpoena. You should have an attorney assist you as there are specific forms that need to be completed and served within a specific time frame.

Question

I set up a trust fund for my daughter to receive upon graduation of college, she never graduated . I hired a local attourney over 25 years ago to handle the legal matters involved in setting up this trust. I cannot contact him and all i have been told is that the money went to international trust co in Florida . I have googled this company and cannot find much information. Where do i start?

Answer

You can search the California Bar's webpage and contact the California Bar to see who his papers went to if he retired. I would try there first. Good luck!

Answer

I agree with Mr. Reid. You are going to want a copy of the trust instrument, and then speak in person with a competent estate planning attorney.

Question

I carry health insurance on myself and my daughters through my employer. I am the subscriber. Any medical cost sharing obligations as a result of care received by me or my daughters is billed to me as the subscriber. I then contact my payroll department and they set up a payroll deduction to pay any outstanding deductibles, coinsurances or copays. My employer is a large hospital who employs the physicians that my daughters and I receive care from. My ex-husband has not been on my health insurance policy since our divorce 3 years ago. He is currently applying for a student loan and allegedly has been declined. He is telling everyone that I ruined his credit due to some unpaid medical bills on the children. I don't think that's possible if he isn't even on the policy. And also, can unpaid medical bills effect your credit rating? We live in pennsylvania.

Answer

If the bills have been paid, then they could not be the cause of your ex-husband's bad credit.

The real issue is what do you want to do about it? Who is "everyone" that he is telling? Have you suffered damages (damage to your business relationship or reputation in the community) because of this? He has obviously gone downhill since the divorce. He can say what he wants. If people really know you they will know that you are not the kind of person and will see that your ex-husband is just a bitter vindictive man. I think I would let this die and not make a fuss.

I suppose that if you want to try and put some fear into him, you could pay a local attorney to send him a nasty letter advising that the statements regarding you ruining his credit are untrue and demand that he either provide you with evidence or retract the false statements. The problem is he might become really unhinged mentally that he could do real harm. You do not want to make a bad situation worse.

This is just my personal opinion - you are welcome to seek out another. You know best what you are dealing with and if you know a lawyer who will send this letter then go ahead. I just don't think I would make an actual court case over it.

Question

Purchased a new car with extended warrenty thru dealer. If you don't use the warrenty you get your money back in full. I have this in writing from dealer. The problem is that in the fine print it states I have 90 days from expiration to get my claim in. Well I miissed the time line of 72 months by 3 months but I didn't exceed the 100k miles which is what I had my mind fixed on. Either way the dealer has no stake in this and won't give my money back. what can I do?

Answer

The fine print would seem to win out here, i.e., you 're without

a remedy (in my opinion).

Question

My girlfriend is afraid that if my ex runs my background he will have grounds in their custody battle. He is a police officer and hasn't asked to run a background check but she is afraid to even let him see my car to run my tags although he knows she is seeing someone. The worst that might be on my record is somewhere between 8-11 years ago I was arrested for shoplifting which i believe was just a misdemeanor (paid a fine and a few weeks probation) and a another time was charged with trespassing (on my own apartment! - long irrellevant story) which again i just paid a fine but didn't do any time or anything serious like that. Other than that I'm just your average joe with no other trouble in the last 8+ years... pretty stable. Even been with the same company for the last 10 years. Should she be worried about her Ex running my background with my past history? Thank you.

Answer

Generally, when a parent brings up an issue of the other parent's boyfriend or girlfriend (a.k.a., "paramour"), the court will look at whether the paramour presents any risk of harm to the parties' children. Separated or divorced parents are allowed to date and, given a reasonable amount of time, introduce the children to their paramours. However, if a paramour has a history of drug abuse, sexual abuse, child abuse, or other extenuating circumstance, then the other parent may seek intervention from the court, and the court may restrict whether the children are allowed around the paramour. Without knowing any more facts about your case or reviewing the relevant paperwork, it sounds like a 10-year-old shoplifting misdemeanor charge isn't going to affect your girlfriend's custody and visitation with her kids. DISCLAIMER: Please be advised that this is general information for informational purposes only and does not constitute legal advice, nor does it create an attorney-client relationship. It is strongly advised that you contact a local attorney to obtain legal advice specific to your case.

Question

I was walking through a grocery store when I slipped and fell.. the first thing I noticed was my knee had a purple spot on it, it bruised very quick. the longer time passed I could feel my back hurting..my friend got someones attention. the first associate came over and looked at me and didn't know what to do, my friend asked her to get some ice, a tissue, and a manager to come to us..the next time I looked around there was 3 associates and they looked around and it seemed that they didn't know what to do... my friend asked again about ice and tissue and manager..then we heard on the intercom a page for maintenance to infants for a wet spill... not at any point did we hear code white..one manager showed up. it took them 7 minutes to get me tissue, 9 minutes to get me ice( ice from mcdonalds in a grocery bag).. then came a wheelchair shopping cart.. they helped me up into the wheelchair and when the manager was trying to shut it, the lock wasnt' working.. that is when the other manager said "this is how you close it..) they had jmmy rigged it to close.. I asked if there was a different wheelchair and they said no..the whole time I was there people kept saying " wow that is a big spill!" and " someone get a camera, go to photo and get a camera" to take a picture of the spill...the edge of the spill was sticky so it had obviously been there a while..my friend asked them that if they called an ambulance to take me to get checked out that I would not have to pay for it... they said that they didn't know... my friend said nevermind, went and got her van and helped me to get into it..I have not been in that store since the accident. I need to go to the chiropractor but I can't afford it and I don't think they are willing to pay for it.. what should I do?

Answer

You did not say how long ago this happened, but hopefully, it was fairly recently. The more recent, the better. What you need to do is start looking for a personal injury attorney who is local to your area. Usually, they will at least give you a free consultation to get the basic facts of your case and then tell you what they think they can do.

It is important to start right away so that they can move quickly to talk to witnesses, and file a claim with the store or at least write them a demand letter in regard to your needs. From there, it is possible a suit will be filed to keep things moving, or the store will quickly come to a negotiated settlement with you. If a suit has to be filed, the goal is still to come to a negotiated settlement, but it will inevitably take longer to get there.

Best of luck to you.

Answer

You'll want to apply for her adjustment of status to permanent residence, if you have not already.

You may find more information on the adjustment of status process here:

http://www.msclaw.com/adjustment-of-status

Answer

When a United States citizen petitions for a foreign born spouse who is in the United States after a lawful admission, the foreign born spouse is immediately eligible to apply for lawful permanent residence. The I-130 petition signed by the US citizen and the I-485 application signed by the foreign born spouse, along with all required supporting documents, can be submitted together to the USCIS.

A United States citizen must submit separate petitions for each step child, as these children are not provided a benefit based on the petition for their mother. The marriage creating the step child - step parent relationship must have occurred before the child turned 18 years old. The step children will also be immediately eligible to apply for lawful permanent residence if they were lawfully admitted to the USA and are under 21 years of age.

If you are an LPR (not all veterans are citizens), the process is different and you should consult with an immigration attorney about the situation and about obtaining citizenship for yourself.

Before filing any applications with the USCIS, you should consult directly with an immigration lawyer. The immigration lawyer will discuss the situation with you in detail and get the exact immigration/criminal/residential etc history of every individual involved to insure that they are eligible for the benefit and that filing an application will not result in adverse consequences. The immigration attorney will discuss different possible processes available, the expense and timing involved with each, and help you decide which process is most suited to your individual and family needs.

Good luck!

Question

Hi

Currently I am a partners in a multi members LLC since 2009 offering boat tours for up to 140 passengers .I use my salry and saved it to purchase a smaller boat

I plan on starting another business as single LLC running tours on small boat w business in Florida

How do I protect the boat that is free n clear worth 20k from my creditors since I will own 100 percent single member LLC .. Do I add my wife (bad credit lost house) or one of my young children ? Or setup trust ?

I have 2 judgements against me for credit cards for around 10k each.

My current truck which I use for business only has 2 payments left, then is free n clear . At this time there is no creditor trying to seize it

I was going to sell it to multi member LLC and then register it in the LLC name

Will this protect my truck ?

Eventually I will settle with my credit card since the amount is manageable er not worth file Chapter 13

Thanks

Answer

First off, do not form single member llc, worthless in protecting anything. A trust on its own or as the other member of the llc may be the way to go, but you may have issues, as you have 2 judgments and any transfers could be seen as fraudulent in light of the existing judgments. You may want to negotiate settlements with two credit card judgment holders before forming the business. I would recommend contacting an asset protection attorney and a debt defense attorney to discuss your options in greater detail. Remember, just because they have not tried to seize your truck or boat now does not mean once the last payment is made they won't attempt it.

If you already work a position at work is it illegal to have to reply for the same position again because, they only change my job title but it's the same job?

Answer

Unless you have an employment contract, yes it perfectly legal. Louisiana is an at-will employment state and you have no right to force your employer to keep you in any particular position or to keep you on board as an employee at all, so long as the employer is not discriminating against you based on what the law calls a "suspect classification", such as race, gender, national origin, religion, age, or sex.

Question

Recently Workforce Solutions sent my information to a random stranger, including all my addresses in the past 5 years, as well as my social security numbers, and phone numbers. What legal action could I take? Are there any suits I could win? How would I protect my credit in a situation like this?

Answer

s a Franchise Attorney I can only say the following. It's not really possible to answer your questions without knowing more specifics and seeing all related documentation. For example, what is your relationship to Workforce Solutions? What documents did you sign with them and what do they provide? It seems like your privacy rights may have been violated, but you really need to consult with a good business or franchise attorney in your area for specific advice.

Question

An acquaintance of my Mother in law has recently convinced her to sign over a power of attorney to her without any knowledge of my wife. My wife is an only child an my mother in law has only known this individual for a little over a year. Additionally my mother in law seems to exhibit signs of the onset of dementia. This person also convinced my mother in law to sign over the tile of her car. What, if any, recourse does my wife have in this situation?

Thank You!

Answer

If your wife thinks your mother is unable to manage her affairs, she has to file a petition for guardianship and attack the validity of the power of attorney on the basis that Mom was not competent when she signed it. You will need to find a physician who is willing to examine Mom and will sign the required form for the court.

Answer

I recommend that you do the following ASAP.

1) Consult with an attorney that is experienced in Guardianship matters. That attorney can assist you in filing Petitions for Guardianship on a permanent or an emergency basis.

2) Make a report to your local Elder Abuse agency, and ask them to investigate this situation immediately. You can find them at: http://www.aging.state.il.us/eps/provider_list.htm

Question

My father recently passed. I am his only child, exectutor, and sole benefitiary. He had a seperate life insurance policy, that was not large, but was suppose to go to me. When contacting the insurance company I learned his decease wife was his benefitiary. He was ill and never changed it. Now it goes to the estate, is taxed, and creditors and attorneys want their cut. My dad worked his entire life for a meager home they are forcing me to sell and now they get my life insurance. Doesn't seem fair. I am his next of kin, not the State of Iowa. So frustrated.

Answer

Well, the policy didn't go to you. Not much you can do about your late father's failure to act.

Can the landlord of my warehouse space do quarterly inspections, just to "view" the property?

Question

Can the landlord of my warehouse space do quarterly inspections, just to "view" the property?

Answer

Yup. Reasonable inspections to assure lease compliance and look for maintenance issues are perfectly legal. Why wouldn't they be?

Answer

Read your lease, all those issues are covered in commercial leases. Even if not mentioned, the landlord always has the right to inspect any time, on reasonable notice, such as 24 hours.

Question

if probation is extended because of not paying off restatution and court fines what can i do to have it terminated as i have no money now to pay it off

Answer

You may need an attorney to try to make this happen for you. Depending on several factors and the way it is presented to the court, you could try to get the restitution order modified to "restitution per civil judgement.". But if you attempt this on your own and you are not successful, you probably can't attempt it again for at least another year or more. We have handled many modifications of probation over the past 20 years. While there never is a guarantee, the odds are much better with professionals. I wish you well............ David Wallin

Answer

Generally courts won't terminate probation unless all conditions of probation (restitution, fines, etc) are satisfied "in a timely manner." However it could be worth a try to convert fines etc to some other structure (modify probation) as Mr. Wallin mentioned. Consult a local criminal defense attorney in your area. Good luck!

Question

I'm writing and possibly producing a low budget film in which comic books are a major theme. Is it illegal for me to use the name or image of a specific comic? For example, can a character be reading an actual issue of Spiderman? Can she talk about the issue? Or do I have to create an imaginary comic to avoid copyright infringement?

Answer

To use a syndicated character (like Superman) in a movie, you need to get a license from the holder of the copyright and trademark rights for the use. That will cost you some bucks, but it is FAR LESS expensive than would be an infringement suit based on your failure to obtain the rights before you start the shoot.

Question

I posted a bad review of a company 50 weeks ago in California. The statue of limitation for suing for a bad online review is one year. However, they sued me and served me the paperwork about two months ago but on the lawsuit, they had a different online review that I did not write. I asked my attorney, "Well, can't we just stall until the statue of limitations runs out on the post they have proof (they have my IP) of that I posted?" She said that would not matter because all they would have to do is amend or revise the current lawsuit to add that information to it. I say BS. Is she right?

Reason why another negative review is on the lawsuit. They originally filed the lawsuit many months ago listing 'John Does' as the defendants, they did this while they gathered the IP's of who posted the negative reviews. None of which were me and they are unable find them, the person used a proxy to hide their IP or something. I came along a few weeks later and found the negative review and copied and pasted it to ripoff report but didn't hide my IP. So once they found my IP, they named me in the lawsuit they had already filed which does not list the actual post that I posted.

Technically, the post I made is not on their lawsuit and the statue of limitations is running out on them in two weeks but my attorney says that it doesn't matter.

Answer

Your attorney is right and you are wrong. The statute of limitations has to do with filing a complaint against the defendant, not on a particular post. The complaint can always be amended and can be amended to conform to proof at trial. If you keep up with your strategy, you will go a long way to proving your opponent's case against you.

Answer

You admitted on an open forum that you re-posted the bad report... You just made their case for them. You have an attorney work with them and stop posting on an open forum. You attorney will not be happy.

I need to find out how to have a person who is deceased taken off of a property deed

Question

I need to find out how to have a person who is deceased taken off of a property deed

Answer

Names are not taken off deeds. The appropriate steps to accomplish what you want to accomplish (which is not in your post) depends on many more facts about the property, parties and the decedent's estate. See a real estate lawyer to discuss all these details.

Answer

Names cannot be take off deeds. Property is transfered in probate.

When someone dies, their estate must be probated. Depending on who the heirs are, whether there is a will, and other factors it may be via administration intestate, solemn or common form probate of a will, years support, no administration necessary or some combination of these.

It is not a do it yourself project and you need a probate lawyer.

Question

can i have the non custodial parents rights removed or limited if i havent heard from him in over 3 years? and dont know where he is?

Answer

You need to meet with an attorney in person and discuss the details of your case.

If he is not bothering you, then why open up this can of worms?

He will have to be notified of the lawsuit. If you don't know where he is then there can be substituted service & the court will probably appoint an attorney to represent him. I don't know how the judge would handle the paying of this attorney - you might be ordered to pay this attorney's fees as well as your own.

You need to talk to an attorney in person & discuss. Look on this website & on www.avvo.com

Good luck!

Question

my husband molested my daughter(his step) and i reported, he served a few months jail time. i am proceeding with divorce and asking for sole custody of the 2 girls(4 and 2) that we have together. would i be able to get their last names changed at the same time the divorce is being settled? he will not contest divorce, doubtful he will even show up.

Answer

I really hate to be the bearer of bad news, but this may not be over. You will not be able to change your girls' last names that easily. My experience has been that even in situations such as you describe, the Courts are reluctant to terminate a parent's right without allowing him to seek counseling and "rehabilitate" himself. They may even point out that he didn't molest his own daughters, although to me anyone who is willing to cross the line and touch a child would likely not be concerned about being related to the victim. Be prepared. Hopefully he will just drop off the face of the earth, but I don't want you to be blindsided.

Question

In a Notice of Removal - Employment Discrimination case, in discovery before mediation, is it common practice to disclose plaintiffs earned wages since termination date?

My understanding is that mediation is not testimony under oath and confidential so it would not be best practice to disclose the plaintiffs earnings since termination because it has the potential to reducing the settlement amount.

Answer

You are correct that mediation is not testimony under oath. Discovery, however, pertains to trial as well as mediation, and information as to plaintiff's earned wages is clearly discoverable in order to determine mitigation of damages and the correct amount to be awarded at trial.

It is not best practice to refuse to disclose any discoverable information when it has been requested.

Question

After a closing, affidavits signed between buyer and seller and the seller provides a home warranty is the seller responsible for the deductible of the home warranty when the buyer now owner uses it?

Answer

Read the warranty. Usually, unless there is a separate agreement in which the seller agrees to be responsible for the deductible, the seller's obligation is only to pay for the warranty.

This response is not legal advice, since I do not have all of the information that would be required, and I do not have a representation agreement with you.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.

Question

I work at a factory and a co-worker of mine brings his friends who are not employed with the company to "help him out" during his shift. The company pays my co-worker (legitimately) the co-worker turns around and pays his friends. Our immediate supervisors don't say anything because the friends helps with the daily quota. When I ask about it I'm ignored. It all sounds fishy to me and I want to report it. Can I be fired if I call and report this and is this even legal? Thank in advance.

Answer

The scenario you decribe is likely prohibited under a variety of state and federal laws. One law in particular, the Fair Labor Standards Act prohibits your employer from retaliating against you if you complain about a violation.

Question

Was getting eviction notice on roommate in my home, but they left a week ago,bow long do they have to be gone before eviction no longer necessary.Took just a few belongings.

Answer

If you were already in the process of evicting your tenant and they left before you could do so, I would continue on with the eviction process. I'm not sure why you were trying to evict in the first place (likely not paying rent), but you can also tell the judge that your tenant has now "abandoned" the rental as well. If you don't continue on with the eviction process, your rommate could come back at a later time and say you stole/sold her items, that you are blocking her from her rightful possessory interest in the property, etc. No reason to take that chance. Make it all nice and official, so if your tenant comes back and tries to make a stink about not being let in, you can call the police and show them the eviction notice. No problems.

Best regards.*****The above is for informational purposes and does not create an attorney-client privilege.*****

can I legally walk away from my house being so far behind on mortgage?

Question

can I legally walk away from my house being so far behind on mortgage?

Answer

Not without a lot of potential consequences. The bank could foreclose. They may (but are not obligated to) accept a deed in lieu of foreclosure. They may be able to force you into bankruptcy if it helps them. Your credit rating will be trashed. If they foreclose they may be able to get a "deficiency" judgment which is the amount you owe (which could include costs of restoration if you abandon and the place falls into disrepair, plus taxes, insurance, interest, attorney fees, court costs.....) less whatever the net proceeds may be that they get on a foreclosure sale, and while there are some tax benefits for you at least this year, if could become phantom income if the foreclosure is in a future tax year and then there could be IRS issues. You may be able to work out a "short sale" of the property. You may be entitled to a loan modiciation...... LOTS of open issues here. Time to sit with an attorney, review your particulars, identify options, and act on them.

What is the current MA law on hooka (smoking) lounge? Can I serve food and bevereges?

Question

What is the current MA law on hooka (smoking) lounge? Can I serve food and bevereges?

Answer

There is no law authorizing the creation of a Hooka Lounge. The only current use of marijuana is for medical purposes and as such it is not intended to be used in a smoking lounge.

The best you can do is open a bakery or restaurant next to one of 35 licensed retail outlets in the Commonwealth.

If you want to open a cigar club or a smoking club, you will need a special permit to obtain one and I sincerely doubt you can get one in Boston as someone tried years ago and could not get one. Moreover, the Club will not be open to the public at large but will need to have criteria for membership which would be included to the proposal to obtain permission for one. You would also have to seek exception under the state law regulating smoking in buildings.

In fact is becoming difficult to find an apartment or a condo that will permit smoking inside the units.

Answer

Hi,

Your naturalization application will not be negatively impacted due to an absence from the U.S. after filing. The biometrics, when scheduled by the USCIS, can be rescheduled for when you will be back in the U.S. We have general information about the naturalization process here: http://www.h1b1.com/citizenship.htm

Answer

You can travel so long as you do not miss your biometrics appointment, or miss any requests for additional evidence. If you are unable to attend your biometrics appointment, you will need to send in the appointment notice with a request for rescheduling. If you do not have an attorney already, you may wish to retain one to monitor your case while you are gone. Question

after 18 years my husband told me hes not happy and didnt know why he thought it would be best if one of us left so we could have some time what exactly are my rights and what am i entitled to

Answer

That's not enough information on which to base a full answer. However, in a long marriage such as yours you have substantial rights, and you should discuss your situation in detail with a local divorce lawyer.

Answer

You have rights to equitable distribution and possibly maintenance. If you have children, and are the custodial parent, you have rights to child support.

Question

I live in New Mexico and I think my wife is having an affair with an old boyfriend. She texts him over 40 times a day. We have an eight year old son together and I want joint custody but primary residence with me. She is visiting her old boyfriend in Alaska right now and wants to move our son there with her. Our son has a stepbrother and other family members here in New Mexico. Do I have any chance of keeping our son with me?

Answer

There is no direct answer to your question. If you are a normal every day get up and go to work kind of guy the answer is probably yes. But, if your wife is cheating on you because you do mean and evil things to her on a constant basis then the answer might be something different. The best bet for you is to go and sit down and talk with a lawyer there in your town. I know the fella that runs the Legal Aid office and he may be one of the first people to see about your situation if you don't already have a lawyer or know a lawyer. If you do not qualify for legal aid then he can also give you several names of lawyers in your town to go and talk with about getting a divorce and custody of your son. I would suggest you do this quickly while she is out of town. You will still have to serve her but since it appears she has abandoned the family home and the children you can suggest to her that she go & find somewhere else to live since she is now taking up with another man.

Hope this helps.

Question

My father passed away and his sister assumed next of kin instead of it going to me his daughter. Because of this I have no access to any of his belongings or personal items. Who is responsible for the wrong person being listed as next of kin?

Answer

You, and only you, are responsible for protecting yourself in our legal system, with the assistance of your lawyer. If you do not care enough to protect you own rights, believe me, nobody else in the system will either. In this case, your lawyer could easily file a request for formal administration of the estate, which would allow you to file a proof of heirship correcting the record as to who may be the next of kin. If a probate file is pending, your attorney can file an objection to the proof of heirship on file. However, if your father left no property behind, this may not be worth the expense. If you are a minor, you might also be able to get the court to appoint a guardian ad litem attorney for you. Question

I allowed my daughter to move into a property that I own, but do not live in. I have allowed her to live free of charge for the last 7 months. (She had intended to help with the payments but ran into tough times so I allowed her to stay without paying me anything. The electric bill is in my name and she initially kept up on that but has stopped paying that the last few months) I have now fallen behind on the mortgage payments and can no longer afford this property. I advised her that another family member is purchasing the property from me, as I would be facing foreclosure on it, I verbally asked her to vacate the premises in two weeks. She advised me that she would not be leaving without legal action and that her plans are to stay there until the property is foreclosed on (which she believes will buy her 6-12 more months of free living) I am trying determine if I have the right to give her a 7 day notice to quit? If she is considered at tenant at will or tenancy at sufferance? She believes she doesnt fall into either because she is a family member and had no verbal or written lease agreement-which is true, at this point she is over staying her welcome. The family member who is prepared to buy the property the day of or prior to the day that the bank has demanded payment from me-April 4th. This family member has also asked me when he does make the purchase, if she has not yet vacated the premises will he have the right to pursue her eviction from the property. I have looked at several of the sample 7 day notice to quit forms and more refer to non payment of rent-which is not the case, she is just interfering with my selling the home and preventing the family member who is purchasing it from moving in. I live in Maine and this property is located in Maine.

Answer

Your daughter is a tenant-at-will like any other tenant. Unless her name is on the deed, she does not have any right to stay.

Since you have not asked for rent, you likely cannot evict her for failure to pay rent. You can give her a 30 day notice to quit, which does not require a reason for the eviction. If she does not move after the 30 days you can begin an eviction proceeding. You may want to consult with an attorney to ensure that you are doing the notice and eviction properly.

Question

When a spouse dies and the widow checks the state court records and find out she is never divorced and their marriage certificate is still valid, but the spouse says he was married again to another woman, who is legally responsible for any property or assets the deceased has remaining?

Answer

He CANNOT remarry if the widow was still married to him. Your post however is bizarre. If a person was in a divorce case she already knew if she was divorced or not. It sounds like you are asking for her and she has left out more of the tsory than she told you. She should see a lawyer.

What is the Gvw of international 444e truck?

What is the Gvw of international 444e truck?
The 444E is the engine installed in that truck and it has very little to do with GVWR.Under the 444e there would have been the model number (e.i.3700,3800,4300,4600 etc..) This would help answer with your question, but the GVWR can be affected by many different things (number of axles, type of axles, type of frame, gauge of frame. Etc..) However the 444e in normally installed in lighter duty trucks. (11000lb-18000lb)Hope this helps.Markus310,310T,ICE-P

Question

Hi, I had filed divorce petition in Arizona. After that the respondent has moved to a different address. In the divorce default decree, is it ok to put the respondent's new address even though it does not match his address in the petition? If I put his new address in the default decree, will the court be ok with it?

Thanks.

Answer

Perhaps it is best to list both addresses and explain the basis for doing so. It is best to err on the side of caution to avoid confusion or giving the other party a basis to try and set aside the decree in the future. Best of luck!
