Question

I recently got pulled over for driving under a suspended license but however my license suspension was only 30 days period, and it ended 3 weeks ago before i got pulled over, but I just didn't get my license yet because i've been busy. So the officer gave me a citation with 4 reasons, 1: failure to show driver's license, 2: driving under a suspended license, and the other two are pretty much the same. I just want know what's the worse thing can happen to me. I have prove that my suspension was only 30 days and 30 days had already past before i got pulled over. I'm really worrying right now. I live in Maryland and currently holding a provisonal license.

Answer

An experienced criminal defense attorney can help you evaluate the prosecution's case, any defenses that you might have, and any plea offer that might be made, so that you can decide whether to go to trial. Consider seeking a confidential consultation.

Answer

We have a lawyer in the office with several cases, now, that are very similar to yours. You have deadlines to request a trial, and you also need a lawyer to look at your citation to determine if you have any jailable offenses (one of our clients plea bargained a driving while suspended to include a few weekends in the County lock up). Your disposition will depend on your driving record and circumstances. Don't wait!

Answer

This sounds like we may be able to get it dropped. I'd go to the State's attorney and show them how the suspension would have been over. Often times they're stupid and don't understand how the MVA works and we can sort of trick them. Call me anytime for a more detailed free consult.

Question

Copyrights

Ebay: Sellers are selling ringtones and wallpapers on a CD or DVD and claiming it is for educational purposes only. Can they sell these CD's Legally. Is there a way to sell a cd with this info on it so others can ultimately download the info to their phones. Sellers claim they are not infinging on any law breaking. Thank you.

Answer

Re: Copyrights

Sellers are simply wrong and are prime targets for an infringement action.

The way to sell such works legally would be to obtain the requisite rights from the copyright owners.

Best wishes,

LDWG

Question

I intend to write a play that takes the characters of an already famous play and shows them 30 years later. My play would lift no description, dialogue, or story line from the original. I would use only the names of the original characters. For example, if I wrote a play titled, "The Streetcar Doesn't Stop Here Any More," and the characters in the play were named Stanley, Stella, and Blanche and it was all about Stanley battling prostate cancer. Would I be violating any copyright protection of the original? Joan

Answer

By using another author's characters, your play potentially becomes what is called a "derivative work." Copyright protects derivative works under 17 USC 103, which reads, in relevant part, "(a) The subject matter of copyright as specified by section 102 includes compilations and derivative works...."

There are ways to create derivative works without running afoul of copyright. Please feel free to give my office a call to set up a phone appointment to discuss this matter.

Can a will be contested in the state of Texas before it has been probated if so, how many times?

Question

Can a will be contested in the state of Texas before it has been probated & if so, how many times?

Answer

Yes, a contest can be brought before a Will is admitted to probate. In fact, the odds of success improve when the challenge is brought at this stage. Obviously, doing so means that the contestant must be diligent and proactive. If you believe you have the facts and evidence to make a good case, get with an attorney near you immediately.

As for how many times, this question is a bit hard to understand. The law doesn't give contestants as many bites at the apple as they need to be successful. Losing means you lost, and if you left out a legal basis the first time, there's a pretty good chance that the Court isn't going to be more favorable when you come back around the second time.

If I decide to convert a C Corp to an S Corp, will all the assets and liabilities be transferred to the S Corp?

Question

If I decide to convert a C Corp to an S Corp, will all the assets and liabilities be transferred to the S Corp?

Answer

It is the same corporation. There is no conversion... The assets and liabilities do not go anywhere... the change in status is just an election on how the corporation is taxed. There are many ramifications to the change, including the issue in dealing with the built in gains tax. I suggest you meet with your CPA and go over all the issues before you make this election.

Question

I have an outstanding on-line payday loan with a company from California. I am from Indiana.

I had all intentions of paying the lona off, however, due to financial contraints, i was unable to pay. I have moved since the loan was taken and now i have been threatened to be issued an arrest warrant if i cannot pay bt 12pm today. I am a nervous wreck as i cannot afford to be in jail for a month. May i be arrested for this if i am not able to pay? I have tried to set up installment payments with the Investigator calling me and my family, however, they wont accept. Please advise.

Answer

In Indiana this would not be criminal, but you need to check with a California attorney also.
