Question

A dependency case was open/closed and 2004 lake county florida can it be possible to reopen this case? The clerk of courts have all this case in a storage facility, and they say there is no such form to file motion to reopen dependecy case. In 2005 the mother came to my house and got pregnant with second child. Would second child be apply to the dependecy case that was closed in 2004?

Answer

Based on my understanding of the facts presented in your inquiry, yes, the case can be re-opened if there has been a substantial change in the factual circumstances which was the basis for the original court order. Regarding whether the "second child" case would be based on the first child dependency case, the answer is no. You are advised to discuss the matter with a family law agency, legal aid group, or family law attorney. Generally, clerks do not have forms for such legal procedures.
