Question

My granddaughter and her 4 year old baby are being evicted from their home in 30 days. She has been living with her dad (we think he was her legal dad) for the past 4 years. He is a good man and has taken very good care of her. The house he lived in belonged to his deceased mother who had left a will stating that anyone that needs a home can stay there rent free as long as they keep it up, which they have done. The dad died last month, prior to his death his 4 brothers and sisters promised him that Jennifer and the baby could stay there as long as they needed to, less than a month after he died they presented her with an eviction notice. Her monthly income is a disability check of approximately $700,and as far as I know she does not own a valid drivers license, and she lives out in the country. She is scared and doesn't know what to do. We live several miles from her and we live on a fixed social security income and we are limited on what we can do. Do you have any advice for us? We are willing to do what we can to help her. Are these terrible people breaking the law by making her move? They told her they want to sell the house. It is an old mobile home, barely worth anything, but at least it keeps a roof over her head, now they are kicking her out. Please help.

Answer

Unless there's something we don't know, your granddaughter is out of luck. She needs to talk to her network of friends and find another place to live.

Nobody is breaking the law by making her move; not unless she has a written lease.
