The finance company is asking to me to send them the title because they say that I would be in breach of the contract because the contract requires that the vehicle be a security interest on the loan. I however, didn't breach it. I did make it a security interest when we (my wife and I) signed the papers when we bought it. They removed the security interest when they released the lien. Am I correct?

No. The lender screwed up but you knew they screwed up. They are giving you the chance to do this right - add the lien to the title and send it to them or else risk a lawsuit.

The only time a Judge HAS to rule in a certain manner is if the law or a higher court requires it. Say a million rullings in District Courts across North Carolina say the same exact thing. Nothing requires the judge in the next case to follow. If the NC Court of Appeals or NC Supreme Court rule a certain way then the Judge is required to follow.

My girlfriend moved out of her home with her father and step-mother about 1 year ago. Her father and step-mother received mail for her but failed to contact her and tell her she has mail. She asked numerous times if she had mail and they replied in e-mails that No, there has been no mail for her. Well, now her sister went over there and found out that actually yes.. there has been mail. Bills from doctors, dentists, etc. She is in college and cannot afford to pay a large sum of money in a short time and if the bills would have been properly forwarded to her by her father then she could have taken care of everything and there would be no problems. But because it has been so long and the bills have been sitting there unanswered... she all of a sudden has bad credit for 7 years and is in debt because of her father's lazyness to forward her the bills. Doesn't sound fair to me that she has to suffer all of this because he was too lazy to send some mail... Could you please let me know if there is anything she can or should do?

If you were represented by an attorney, the attorney would have to spend time (compensable) do legal research to determine whether the particular words spoken by this kind of defendant can be sued upon either based on some law or statute, or based upon residual common law rules. Then the attorney would have to formula a written response (compensable), which would cite relevant law, and file it with the court. The court then might order a briefing schedule and then a hearing date, beyond the next court date (compensable). Because you "fail to understand any of this" you therefore run the risk of having the case dismissed against you (do it yourself) even if a court may give you as a pro se plaintiff the benefit of the doubt and rule against the motion. So either you have to hire an attorney to take over for you, or start acting like one, but that doesn't mean you will win the motion. And if you lose your options become narrower.

An oil dipstick may not go completely into its sleeve if it is bent or damaged. It may be designed to only go in one way try turning it 180 degrees and putting it in. Also, if it is not the original dipstick it may be the incorrect size or too long.
Other possibilities that come to mind include: a damaged sleeve, foreign material in the sleeve, or part of the oil dipstick has broken off in the sleeve.

This is an interesting situation. In order to deal with this you will need to bring a motion to set aside the judgment from the eviction, even though it happened 12 years ago. The reason it is no longer on your credit report is because this happened so long ago. The information probably was on your credit report at some point in the past. At some point it fell off, since credit reports usually go back no more than a decade.
Your best bet is to consult with an attorney in the same county and state where the judgment was obtained for the eviction. If you are not personally served with the eviction papers then that may serve as a basis upon which to set the eviction order aside. Beyond that I don't have enough information to tell you more, such as what you may be entitled to in such a proceeding, or whether you're even liable for damages that might have been ordered against you at that time. It's hard to say with the passage of 12 years.
What I have written here should at least get you started and pointed in the right direction. Best of luck!

Over the years the property has been assesed for tax evaluation and no notice has ever been sent to us by the town concerning a property line dispute.The town of Bar Harbor did an extensive survey of there land while planning to install a boat ramp on the town beach which is part of the large portion of undeveloped land they own. They notified us that one of our camps is completly on town property as well as a portion of our other camp. This portion of the towns property has always been improved and maintained by the us. Over the years the town has been out to the property and has never said anything to us about this. Also we have always used an access rd that follows the waters edge across town property which connects to the town owned beach which has no restrictions of use, no gates and is accesible 24 hours a day 7 days a week. The town has also informed us that they intend on stopping us from using the rd from the beach to our property. This has always been our only access to the property. Thay even put a street sign up 3 or 4 years ago for 911 purposes.This sign says Hadley Beach lane Private. They said that we have 2 deeded right of ways to our property, so we will need to develop one or both for our future access. We have always used this rd for our access and have never been notified from the town that there was any problem. This portion of the towns land was improved 52 years ago by our family and has always been maintained by our family. We have always been aware this is town property and we have never tried to claim it as ours. Also for what it is worth about 28 years ago we installed a sea wall of boulders in front of our property to stop serious . This sea wall also extends across the 125' of town land that borders the road. This was done at our expense with the approval of the town. The town has told us we need to solve this problem. We had done nothing for a while.They gave us a deadline. We were not able to honor that time frame. The town manager went as far as printing an article in the newspaper about the issue and threatened to bulldoze our buildings down. What can we do what rights do we have.

This is a very complicated question, and a review of the available documents including the deeds, survey and correspondence from the town will be needed to give a proper assessment. Unfortunately you are not able to claim prescriptive easements or adverse possession against town property. What you described is a violation of the Fair Debt Collection Practices Act( FDCPA) and possilby some KAnsas Cnsumer protection laws. The lawyer that sent that notice to your ex, may be liable to you for the violation(s). However, Kansas is a judicial foreclosure state, so foreclosure law suits are matters of public record. If the lawyer goes ahead and files the foreclosure petition, you may have a hard time shopwing any harm to you, from the mailing of the notice to your ex. But, if you may still have a FDCPA claim. Yu shoudl consutl with counbsel in yru area to examine the specifics facts of your case. Do so soon, as you have a limited time in which to bring your claim.

My parents had been married for over 40 years and had a joint will. This past year my father passed away and the will was released to me and my sister, who I do not speak to or associate with due to personal matters. To give you some background information my mother owns her primary residence and another house that she rents out, but it could be used as a commercial property. In the joint will, my father left their primary residence to my sister and instructions to sell the rental/commercial property and to split the money among the grandchildren. Given that my mother's primary residence is across the street from mine my mother decided to change her will after my father's passing and without my sister's knowledge. My mother signed over the deed to her primary residence (across the street from me) to me, so as of now, I own my mother's primary residence. My mother then decided to leave the rental/commercial property to my sister (this property is actually worth more than my mother's primary residence). I do not care that it is worth more. I wanted my mother's primary residence for my kids one day.
So this leads to my question. My mother's will is quite short and leaves the rental/commercial property to my sister and includes nothing about primary residence because I now own it. What I want to know is does my sister have any say about my mother's possessions in her primary residence? My mother did not leave any personal possessions (furniture, pictures, family momentos) to my sister in her will. The only thing in the will my sister gets is the rental/commercial property. I'm just worried that when my mother passes away, my sister will try to claim furniture, pictures, and other family momentos in my mother's primary residence (which I now own).

Blood test results are not immediately available. It may take weeks. If you did not complete any road side test perhaps the DA does not feel it has enough evidence to proceed a this time. If so, that is well within the time period to charge you.

He was negligent in allowing you to drive the car since you had no license, but it was not reasonably foreseeable, unless he knew you to be a very poor driver, that you would do something that would cause the police to stop you and result in the car being towed. I am not sure under what theory of law he could sue [or what the statute of limitations to file suit would be] and whether he could collect. But it will cost you time and money to defend against any lawsuit so you should see if you can work out some compromise with him.

Your husband is protected by California laws which prohibit changing custody orders due to solely the military deployment of military personell. The ex wife should not seek a custody change due to the fact that your husband is deployed because there are laws which prohibit it. If you are doing a good job of taking care of the children in his absence for him, then you should have nothing to worry about due to his military deployment.

Depends what the HOA documents say. If those are defined as being in the nature of "Common Elements" more likely than not. If they are defined as being "Limited Common Elements" then the responsibility for repair and maintenance MAY be imposed on individual unit owners - you must look at the HOA documents first. Then again, if there is a community-wide problem with roofs and skylights, the HOA documents may give the HOA the right to contract to get the problems fixed for all owners who have problems, but in the end everyone with the problem will probably have to pay a special assessment for the work on their units. So check the HOA documents first. If you can't figure out from them whose responsibility it is, then it would be a good idea to have an attorney take a look, especially if the costs of making things right are significant.....

In hindsight, I realize that I should have pressed charges when I found out he had sex relations with her, but they said they were in love and I didn't want to make fuss over what looked like a good relationship. She became pregnant and had a baby at seventeen this May. They lived at my house, but he could not hold down a job, so he wanted to move back to where his family lives. Against my will, he took her and the baby and would not tell me where they were living. She became pregnant again in the meantime (big surprise) and the situation has worsened. They have been away for over three months and no medical care for my daughter or my grandson. They have been living in different places and right now have no home of their own.
My question: Do I have any rights to bring her home due to the need for her to have proper care or will the court view my past consent as giving up those rights as a parent?

Sadly a friend of mine's Ex-husband sued her for non-payment of medical bills over a 9 month period (25 total). 90% of them were not necessary and never had approval from her or agreement to proceed. 12 of them were for a therapist. She had never had therapy and he had never brought the daughter to the doctor in her life prior to my friend leaving him. The ex is trying to bury the mother financially for no reason except she now met someone else. He has done vandalism, made threats, etc and continues to do so. He has a lot of money and spent at least $6000 to get $1400 from her and requested jail time. She hired a cheap attorney ($750) to defend her and he didn't address any of these issues and got lost in the process. I believe she could have done better defending herself. Her attorney served something on the Ex and has yet to provide the details and wants for money for the court date in January. She is in a bad situation. I have helped her pull together pages of information that any attorney could use for this ongoing manipulation to stop. She is broke and borrowed for the first attorney fee which was a waste of time. I don't think the judge would be have put her in jail anyway, but not she looks like a slacker and he is the good guy in the court's eyes. She needs someone that can articulate and communicate the truth. It is a sad case showing the system unjust if you don't have a lot of money like her Ex. I wish she could find someone caring to take the case and help her and her daughter get out of the control of this evil man. :(

Yes, you can appeal a judgment from a family court but you need grounds. Plus, it is expensive.
Second, it sounds like you want to be a really good friend. Unfortunately, you obviously do not know much about Texas law and never attended law school. You are emotionally involved in this case and, of course, are defending your friend.
Let me point out a couple of things that are Texas law.
1. A parent must pay for their child's medical bills. She did not need to approve of them before they were incurred. She is responsible for 50% of all medical bills not paid by insurance. If you read her current court decree, it should clearly state what her legal obligations are in this matter.
2. She would not have done better defending herself since she is held to the same standards as a lawyer. She probably does not understand the TX Rules of Evidence and how to prepare legal documents. Therefore, a cheap lawyer is better than no lawyer.
3. Unfortunately, what you have mentioned goes on all the time in family courts. I've been practicing law over 20 years and I could write a book on the subject. What you have written is what keeps the judges busy and the court dockets overwhelmed.
4. It sounds like you've done a lot of research but unfortunately it is not always possible to get this "research" into evidence. If you want to do so, you might want to pay for an hour of this attorney's time, however, be aware that doing so will violate the attorney-client privilege - something that might actually backfire on your friend. Then you could be called as a witness and you could be forced to testify as to what the attorney discussed with you since there is no attorney-client privilege with you since you are not a client.
It sounds like her ex was a bully in her marriage, divorce does not end his bullying. It also sounds like he controlled the money in their marriage. Divorce does not end that either.
I would encourage your friend to enter counseling to learn ways to get strong and learn to handle her ex. It will be a long, hard road for her but in the end she will be a much better person and a better mother to her children. Unfortunately, that is the best advice I can offer.

I own a small curbing company. I have one crew of three that lives together and are related. I have signed non-complete contracts and the contracts stipulate that all customer coming from my advertising or referrals are the property of my company.
These guys went out to estimate some curb. They came back and said the customer didn't want curb, they wanted a sidewalk and block wall. The guys wanted to do sidewalks and were always looking for an angle. But I let them do the job.
They represented themselves to be from my company, made a deal with the customer instead of using my contract, used some of my equipment to do the job and then had the customer make the check out to them personally and cashed it.
That was a few months ago. A couple of weeks ago they stole brand new sidewalk stamps from my garage valued at $350 at which point I fired them. Because this has now turned into a large bru-ha-ha, I want to know if I have recourse against them for that particular customer. Did I lose standing by letting that particular incident go?

I am so sorry that you are living under this kind of pressure. Unfortunately there is no easy answer. If she is not reasonable and cooperative, then you have to just be proactive for what is best for the children. It is hard to believe that children are unaware of this kind of pressure and tension - and the split may be what is best for them. You don't mention if counseling has been attempted, but at the least should be considered for the kids to get through the process of the split. You probably should file for divorce and primary conservatorship, and in the proceedings offer a generous support package and generous possession and access to the children. You should be cautious however, as the threats of harm may be desperate and real. You should first be certain that she is mentally stable. Until a third-party professional confirms that, your first obligation is to protect your children; not your wife. Seek an experienced family lawyer - to discuss the most efficient way to a quiet and sensible end to this. Good luck.

It appears that your wife has some mental problems. You need to consult with a mental health expert. Unfortunately, as a family law attorney I've heard this problem many times. You should NOT leave your children with her. I live in Houston where the woman drowned her children due to mental illness.
Ideally before you do anything, you need to get your wife to a doctor & if she won't go then you need to protect your children. I can't tell where you live in Texas but the Harris County courts hear this sort of problem all the time. The judges will do everything they can to protect the children. You are in a serious & dangerous situation.
Hire an experienced family law attorney in your county immediately & follow their advice. You have been living in an "abnormal" situation for so long that you don't understand how dangerous your situation has become.

What you care about and what they NEED to care about as health care professionals can be very, very different. Planned Parenthood has its protocols as does any "clinic". And if they are only doing what local law requires, they have to protect their own licensing.
Frankly, my best suggestion is first ask the people at the clinic whether it is just their protocol or they are following the law as they think they have to, and if you are not satisfied contact the nearest ACLU office.

When he first approached my car after I had pulled over I had my window rolled down between 1/3 and 1/2 way, at least 4 inches open, perhaps more. The first thing he said to me was to roll my window down. I responded that it was rolled down and that I'd rather not roll it down any farther. He insisted again and then said that I could either roll it down the rest of the way or be arrested for disobeying a lawful order from a police officer. At that point I decided to roll the window down the rest of the way as I was already running late to pick up the baby sitter because of this stop.
After the stop was over and he gave me his card which I had requested, I asked him to clarify why he wanted me to roll the window down all the way. He said that it was a matter of safety so that he could see my hands, see into the vehicle and see if there was anyone else in the vehicle. He also said that I was "this close" to being arrested for failure to obey a lawful order from a peace officer and that in the future I should obey all orders and that if I felt they were unlawful that I would have recourse afterward.
My questions are:
1- How far do I legally have to roll my window down if I am stopped for a traffic infraction?
2- If I have my window rolled down only a portion of the way, as long as it is sufficient to pass documents through, is the order of an officer to roll my window down more a lawful order to which disobeying would be grounds for arrest?
3- Does the presence of tinted windows change these situations at all?
I would love to be able to believe the officer, but sadly since it is legal for police to lie to citizens I wanted to check with you to clarify what the law actually says.

If your probation was a deferred adjudication and you are revoked/adjudicated, then yes.
There is a license suspension for any drug conviction. A successfully completed deferred adjudication is not a conviction so there is normally not a license suspension. If you screw it up bad enough to get revoked/adjudicated, then it turns into a conviction, and then the license suspension kicks in.

As you probably already know, you are each liable to the landlord for the entire rent. If you get behind on rent, and the landlord sues you, you can bring the co-tenant in the suit. The urinate would have to reimburse you for one half the rent. If you stay current on the rent, you can sure the absent roommate to get reimbursed for their share.
As for utilities, the person in whose name, the account is, will be liable to each utility provider. If one is in the name of the absentee roommate, they can probably successfully sue you fir recompense of one half. The opposite may not be so.

Grandparent rights in Texas are very limited and each time the legislature meets, grandparent rights are limited even further.
Grandparents have these rights:
1. If the child has lived with the grandparents for 6 months or more, the grandparents can file an original petition for conservatorship and posession & access.
2. If CPS has filed a suit to remove the children from the parents, the grandparents can intervene and ask to be named the conservators of the children.
3. If the grandparents can prove that the children's emmotional and physical development will be seriously harmed if the children have no contact with the grandparents, then the grandparents can prevail in getting access. However, "access" is not the same as "possession." Access can mean one phone call per year. This is an almost worthless statute, but this is where grandparent rights have wound up in Texas, thanks to the Texas Legislature.

It is illegal to give things away in order to avoid paying your creditors, especially the state. It is called a fraudulent conveyance and can get both the giver and the recipient in significant legal trouble. The only difference between other creditors and the state is the state is kind enough to wait until you die to take your home for medical bills. Unless your father and step-mother have other assets in their estate when they die that are sufficient to pay the bills, either you will have to buy out the state's lien, or the state will get the mobile home.

I am a Computer Programmer, working in Washington DC, I have been working for the past 10 years for the same company, initially came to the company as an independent contractor being paid hourly $86 an hour, the contract expired after the first year and was not renewed, but continued working with no contract, until now. Four years ago the company was purchased by a very large corporation, which did not want Independent contractors, my assumption is to avoid IRS liability, and wants only employees, and hence is putting a lot of controls like no pay for over 40 hours work but forced to take comp time and have made it very difficult to stay on board, I guess their main goal is for me to leave, them not having a contract in place to either fire or terminate. My questions are, given the fact I have no other clients, and they control my hours and place of work, and assignments, and feel as if I am an employee fully controlled, but have no benefits as all of my other friends at work. I have done a lot of reading online but still have a lot of questions not answered:
1.Would this qualify as Independent Contractor misclassification ? In the court system would I be awarded compensation for taxes and benefits ? What re my legal rights and potential monetary legal compensation ? Is my case covered under the health care reform in regards to me being covered by health insurance ?
2.Given my hourly rate, I read the DOL acts which seem to apply to minimum wage hourly earners, does any of the fair labor acts apply to my case ?
3.Lately I have been forced to sign an independent contractor agreement backtracking to 4 years ago, not sure why ? I have not signed ? What to do ?
4.What are my choices other than just leaving ?

This is not a tough question at all. If the employer controls the method and manner of work, as well as the location, more likely than not you will be able to make them recognize you as an employee. This is especially true where there is no contract between the parties.
