Does an executor have to file a will in probate with a living trust?
Answer
If there is a will, it needs to be filed with the County Clerk (probate desk) within 30 days of death, whether or not there is a trust.
Answer
After a person dies, anyone in possession of that person's original Will is obligated to record it with the County where your father lived (in most circumstances).
Probate proceedings may be unnecessary due to a number of factors. Feel free to call me for a free consulation about all of this.
