Question

I have a history of anger issues and depression but no legal charges. He has a drug felony and a history of depression. He has been unemployed and living off of disability for a year. I have had a steady job my entire pregnancy (8 months). I want my kids and money to help support them because I only make $600 a month. He doesn't want physical custody, only legal rights over the kids so he won't have to pay child support. Do I have a chance of winning custody of my babies? Even if I don't get money I just want my children.

Answer

If you have no criminal charges and the spouse has a felony conviction- of course you have an opportunity for custody. If he wins "legal rights" with the children he will still have to pay child support. You will need an attorney; you might want to contact your county Legal Aid office.

Answer

Yes you should win. Use of a lawyer is recommended in your case.
