Question

I wish to obtain my text messaging records from my verizon wireless company for the past few months. They told me I had to go through the police department or get a subpena went through the police department they said that it is within my rights to have my records sent to me or viewed and that a subpena or there department is not necessary and that if I had further trouble I should probably contact a lawyer. Is any of this true?

Answer

I agree, you don't need a subpoena to get your records. It is between you and Verizon. I don't see how a third person needs to be injected into the situation. That said, if they refuse, you can always hire an attorney for the limited purpose of writing to them and threatening to sue them and to subpoena them in conjunction with the suit and to ask for an award of attorney's fees for something that ought to be a simple matter of you asking and they complying with your request for fees.

Best of luck,
