To answer your second question, if you are a party to the litigation you must comply with the discovery rules, which means answering interrogatories, providing documents, submitting to a deposition if scheduled. You obviously need representation, and if you feel you can't afford typical attorney fees, you may qualify for a reduced fee attorney through your county bar association's lawyer referral service. There are probably form interrogatories available on line or perhaps through a pro se program at the circuit court in your county, or you could use the one's served on you as a guide, depending on what you want to know in terms of your spouse's income, financial accounts, property, or other issues present in your case.

I recall back when I was a teenager just starting out building cars for fun, all the other teenagers would talk about putting a "three quarter cam" in their engines to make them run faster. This "three quarter cam" was ubiquitous. Everyone talked about them. Then one day I went to the local speed shop to ask how much it would cost to buy a three quarter cam. The guy laughed at me and said there was no such thing. It was a myth. That's what's happening here. The "change it 10%" or "change it 50%" is all a myth. There is no such rule.

So here is the real question: Is there a likelihood of confusion between your use of the words and the senior user's. If the mark is distinctive of the senior user's goods, would a consumer reasonably confuse your goods for those of the senior user. That is an incredibly fact-specific question. Sometimes two people can use the exact same mark provided their goods are sufficiently distinct. Other times you can't get anywhere near close to a mark if you are selling a competing product.

I am in Houston Texas. On Monday Sept 30th in evening when I went to a Mazda showroom i test drove a car, later they reduced the price and I decided to buy a car, but different color one not the one which i test drove.

Now out of the 18000$ down payment I paid 5000$ on Monday with credit card and remaining 10,000$ through cash on Thursday Oct 3rd. and remaining 12,000$ finance.

But on Wednesday on Sept 2nd I went to the dealer and said I don't want the car, but the dealer said I have signed an agreement and deal is finalized.

NB: On Monday I didn't take the car out of showroom (even today i didn't sit in that car its still in showroom). I haven't paid the down payment completely.

I called other showroom and asked they told as long as the car is taken out of showroom by customer or down payment is made in full the deal is not finalized and its void.

But the dealer where i was supposed to buy the car is saying there is no such law and its already 3 days completed(said on fourth day). On contrary i had went on third day to cancel the deal (I have recorded all the conversation with the dealer on my iPhone).

Please help I am not sure if the deal is void as I haven't paid the down payment completely also not driven the car outside the showroom I was supposed to buy.

If you signed an agreement then you are generally bound by the terms unless your signature was obtained by fraud or force. It seems as though you voluntarily entered into a contract to purchase the car.

If the contract does not have a cancellation provision then you are bound to buy the car and pay the purchase price unless you can work something out with the dealership.

I was driving in the middle lane, thinking it was a left/straight ahead lane, so i made the left turn and ended on the feeder in the right lane (as there were only 2 lanes). A cop was standing in the middle of the feeder and stops traffic, funneling myself into a narrow strip of dirt under the same highway and 3 other drivers behind me who made the turn. he gave me a ticket for making an illegal left turn, and i assume he did so with the other 3 drivers behind me.

Once a judgment in California it remains until it is paid or the judgment creditor files a Satisfaction of Judgment and is valid for 10 years and can be renewed every 10 years forever. Depending upon how long it has been since the judgment was entered, you probably do not have much you can do to remove it. You could always wait the 10 years, at which time the judgment disappears unless it is renewed.

His wife is his POA, they have been together for 24 years, married for 17 years. He is very ill, she is his caregiver. This house is a rental property. She will need the income from this house to survive after his death. She doesn't, want to upset her husband by interfering, but will need the money. She has been advised that she can just go down to the courthouse and put her name on the deed. Would she get the house then at the time of his death? His will leaves the house to his daughters. As far as she knows, his name is the only name on the deed. Also, does it have to be published in the paper, if she would add her name to the deed.

Your question was a little unclear to me. If only the husband's name is on the deed, his will controls the disposition of this asset (although the wife might be able to claim a 1/3 elective share if he cut her out of his will completely).

If both names are on the deed:

There are generally two types of deeds when a husband and wife own property together. The first type of deed provides that the survivor automatically inherits the property. (You can identify this type of deed because it is listed with the names of the individuals followed by either "husband and wife" or "with rights of survivorship".) In this scenario, the deed trumps what the Will says.

The second frequently used deed where both names are listed, is a tenancy in common. This means that each party only owns 1/2 of the property and they can do what they wish with their 1/2. Here, the Will controls as to that 1/2.

I would suggest showing a copy of the deed to an attorney to clarify the situation.

It also occurs to me that I should mention this: changing a deed by using a power of attorney could be treated as a fraudulent transfer. So if the wife does a transfer without asking her husband there may serious legal ramifications.

I agree with Attorney Pollock. If the property was solely in the husband's name as shown by the deed, then the wife cannot just use the power of attorney to deed the home to herself. She had better have the power of attorney language reviewed very carefully. Depending on how its drafted it may or may not allow the agent to make gifts at all or over a certain amount.

Why is her name NOT on the deed? What does the will say? Is the husband mentally competent? If so, he can revise his will. He could do a lot of things - he could give the wife a life estate in the property which would allow her to manage it until her death or he could make some other provision for her.

Further, there is no publication when someone is added to the property. If the property is conveyed, that fact is published in the newspaper. Who reads this stuff? I would wager very few people unless they have a particular interest or are Gladys Kravitz-types.

I also agree with Attorney Pollock's comment regarding an elective share. I don't know what else the will says or what else the husband owns, but if the will does not make adequate provision for the wife, she can claim an elective share of 1/3rd of the estate.

HOW TO PLAY THE PLAYER PERFORMANCE LIST COMPETITION

Members will choose a player from the playing field and a performance skills list will be shown for that player. For each skill, a choice of scoring options are available making allowances for a range of performance scoring alternatives.

Option A

1. A five point selection margin is available by utilising the margin range drop down list.
eg. Kicks 1 - 5
6 - 10
11 - 15
16 - 20
21 - 25
26 - 30
31 plus

2. The margin range varies according to the particular sport.
Decreasing the margin range increases the difficulty factor.
The margin range is primarily the point or scoring range selection feature utilised by the internet competition members.
This feature also applies to the player time on field performance list selection component.

Option B

The internet competition member will have the option of entering precise scores. Members are awarded bonus points when selecting this option, only if they accurately record the precise score, therefore the player accuracy percentage could be higher. Bonus points are also awarded for selecting the correct time on field, incident report and off field due to injury for the game.

Option C

Internet competition members are given the choice of utilising a combination of margin range and the precise score options when entering the player performance skills list competition.

Co-signing is NOT the same as co-owning a car. By-co-signing, you are saying in effect to the lender "go ahead and make the car (or other) loan because if the primary borrower does not pay I will."

If you are healthy you may need to renew it once in three years depending on the state in which you live.

I have homeowners insurance, but do not think it would cover any property except my own. This is Florida, and we have these "pop-up storms in summer, plus risk of hurricanes. You may be responsible for damages caused by your trees. You need to check with your insurance company as to what protection it provides. Homeowner's often has a liability coverage and the tree damage may be included. As for the maintenance of trees, they have to be trimmed for hurricane season and you may lose some shade during that time, but you protect yourself and others from flying branches. They do grow back. If they are as large as indicated, they wont likely fall unless they are sick and weak, and then likely need to be removed anyway.

Until the father's parental rights have been termianted. No Missouri judge will grant an adoption Petition. Being incarcerated, is not evidence of neglect.

Be careful, about pushing the need for the adoption, you may deem your self unfit, lose custody of the child. You cousin could get custody, leaving you and the father paying child support to her.

It is illegal to sell a child. Therefore, your cousin may hav elittel legal avenues to pursue other than trying to get custody, until the father's rights can be dealt with. Unless you defrauded yrou cousin out of some money in the negotiations, it is unlikely that her attorney will even try to file suit against you, beyond covering their fee. If any deals were presented to you, you should consult direclty with a civil practice attorney in your area.

If they are suing you as trustee, and not in your individual capacity, then trust will probably pay for legal fees. You should at least have an attorney look at the Petition. Just giving a general description here, will not garner any useful specific information. You may have to answer as to both trusts, to clear up any miscommunications raised by the petition.

Generally, treating employees differently because of their obesity is not considered discrimination and is not illegal unless obesity is either caused by a disability or creates a certain disability, which is a true reason for being treated differently. The work involves intercepting and reading communication traffic between the software that comes with the hardware and the hardware. This communication traffic is done unencrypted over the network and can theoretically be done over the internet.

the results will allow someone to connect without a password to the hardware due to a security design flaw in the hardware, although my intent has nothing to do with that.

Around 10 years ago my sister and I (around 13 and 8) were goofing around and teasing each other verbally. At one point she said something that really rubbed me the wrong way and it made me feel hurt/sad/mad. Even though we started out teasing each other, I really took it the wrong way. However, my sister, even 10 years later, insists that I was trying to kill her. 10 years after I did this, could I get charged with any crime? Assault, battery? Is the statute of limitations out? Could my hands be seen as "deadly weapons", thus bringing battery with a deadly weapons charge and there being no statute of limitations?

The statute of limitations for a felony (other than murder) is four years, for a misdemeanor it is two years. I don't think you have anything to worry about but you should consult an attorney in your home town, have the attorney write a letter to your sister telling her to stop threatening you and try to reconcile with your sister.

What type of probation are you talking about? If the person is on supervised probation, then the State Department of Probation and Parole appoints a probation officer to supervise. In St. Louis County, if it is a County Ordinance violatin, for instance, the Department of Justice Services might be incharge. In other cases and in other places private probation services are used. I do not see why a "bondsman" would have anything to do with it.

I'm a little surprised by your question because you obviously work for a law firm that is seeking to probate the will in question. Clearly, you should consult with an attorney at your firm -- perhaps the attorney or attorneys to whom you report.

Take a look at any copies of the will and see if those copies were also done with one page upside down. Accidents happen, and it appears that this mistake occurred at the time of the execution of the will. The court, understandably, finds it odd that not only was a staple removed but that the will was originally put together incorrectly.

I think your next step is to ask for a hearing to determine whether you tampered with the will. Prepare Citation, get a Court date, serve the citation, petition and copy of the will on the beneficiaries and distributees and be prepared to testify about your mistake.

No. Even if they sue and get a judgment, there is no wage garnishment for this type of debt in North Carolina. I am assuming the loan was made in North Carolina.

First, the creditor must sue you and prove that they made the loan to you. Was the loan evidenced by a promissory note? Have they made a written demand for repayment?

Assuming that they have taken the proper steps and have sued you and recovered a judgment, then there is no wage garnishment in North Carolina for debt of this kind. There are only a few states where that is true. If you are in North Carolina now but move to a wage garnishment state like Georgia, the creditor can always transfer the judgment to your new state of residence and have it enforced as if it were a judgment rendered by that state. Whether the creditor would want to incur the effort and costs involved is another question. This may or may not be likely depending on the amount of the loan/judgment.

Is this some kind of a pay day loan where the lender threatened to call your employer and garnish wages? Or a private loan and the lenderr just has no clue about the laws? If the former, payday loans are illegal in North Carolina and its an empty threat. If the latter, its still an empty threat but if a friend loaned you money in good faith, you do have a moral, if not legal, obligation to try and repay that loan in good faith as well.

I agree with Mr. Slater. This issue is between the tenant and the lawn guy, if he is an independent contractor (which you suggest). If he is an EMPLOYEE of yours things could be a little different.

One suggestion is that when hiring independent contractors to do work (especially on your investment/rental property) ask if they are insured, bonded, and where applicable licensed. These criteria could save you in the future. Especially if someone is injured by their actions, or they themselves were to get injured on the property.

Yep, it's legal. They are in a public place, in plain view. There is no reasonable expectation of privacy. The photos can't be used for commercial purposes without consent. It doesn't sound like your outside practices constitute a nuisance, particularly since music is expected to be a type of noise typically coming from a school, the music isn't late or louder than a prescribed decibel level. No problem.

i am a 16 year old mother and my grandmother has gaurdianship of me but no longer wants me to live in her house and i am trying to get emancipated. my mother lives in a different state and my father lives in a different town. they both agreed to sign emancipation papers. i pretty much have an apartment i just cant move in because i am underage and i am not married and i wouldnt be living with my guardian. so, my question to you is if i can get emancipated through my parents and not my grandmother who has legal guardianship of me? and how would i go about getting emancipated?

You need to talk to an attorney. It's pretty rare to get emancipation.

Nothing in writing, no calls, but now they are trying to collect for this debt, and still have not sent me anything in writing. I cannot find the receipt for the payment. In Missouri the general limit is ten years in which to birng suit. There are many factors that effect teh determiantion of when the ten year period starts. PErhaps the time has alaredy run out. In that case , it is unlawful for any colector to call about an expired debt.
