If an employee was hurt at the work

site, but was not on the clock, does

the employer have to file a claim?

The employee clocked out and then

went upstairs to ask the owner a

personal question. He fell on the

stairs. The employer is paying for

the damage (broken teeth) through

their insurance, but is not sure if

they have to file a workers' comp

claim.

Most likely this will be treated as a work injury, especially if the question related to work. However, you may wish to consult a Personal Injury attorney to make certain no civil claim can be filed.

Fill out a notice of injury form and give it to the employer.
