I am answering a petition... (can not afford an attorney)

the petition is related to beneficiaries of a trust for which I am trustee....

the trust is my mothers... due to issues with the beneficiaries, she wrote a new trust replacing an old trust.. old trust is (as an example) mary q public trust... new trust is mary public trust (two different trusts difference being middle initial in old trust "Q", not in title of new trust... everything was done in the new trust, however petition refers all to the new trust with the Q... all actions done were as trustee of new trust within terms of the new trust)... answer petittion with respect to old trust??? and not mention new trust??? the plaintiffs are aware and well informed of new trust.... lawyer refers to old in all references?? answer ending is proper place to inform answers reference different trust documaent and state all actions were in good faith and under terms of new trust. or answer questions of old trust with proper new trust answers??? any help is appreciated.

If they are suing you as trustee, and not in your individual capacity, then trust will probably pay for legal fees. You should at least have an attorney look at the Petition. Just giving a general description here, will not garner any useful specific information. You may have to answer as to both trusts, to clear up any miscommunications raised by the petition.
