I live in TX and while riding his bike my son bumped into the back of a truck parked on the street. The owners were not home but when they returned my son went and told them that he had hit their truck. I am willing to pay the insurance deductable to fix the damage but they want me to pay out of pocket and have provided me with a quote I find excessive. Am I required to do so by law?



Answer

Generally, parents are not responsible for the torts of their children. So, as a friend of mine likes to say, NOT MY PROBLEM. Perhaps, your son can do some work for these people to pay off the damages for them. It sounds like he did the admirable thing in admitting to what he did. Let him offer to do chores in restitution. Pay if you want, but legally you have no obligation to do so.
