Question

I recently received a phone call from a woman claiming she's from a law firm. She said that there are civil and criminal charges agaisnt me for non payment of a payday loan from three years ago. When I tried to research the firm she said she was calling from it is no where to be found on Google, White Pages, or YellowPages. I have a gut feeling that this is a scam and I would like any advice you can offer. I also researched that criminal charges cannot be filed for defaulting on a payday loan. Is this true?

Thank you!

Answer

Ohio Ethics Rules do not allow lawyers certified to practice in the state of Ohio to threaten criminal prosecution to gain an advantage in a civil case. If someone is calling up Ohio citizens and pretending to be an attorney and doing these things, your local bar association would likely be interested in getting any identification information you can on such persons.
