Accoding to my divorce decree my ex wife is suppose to pay 72% of the copays or deductible s on medical bills for my kids
Since i carry the insurance for them. The deal is, i had insurance with the military. I retired thinking that the insurance carried over 30 days. My ex made an appointment for my daughter when i had insurance. My insurance was cancelled the day before her appointment, we didnt know this. Is she still responsible for 72% of the bill or 50%. I have insurance on them now..
Answer
The bad news is that if your court order required you to carry insurance and that insurance lapsed, if left up to a court, you would likely be required to pay any cost that would otherwise have been covered by insurance. The balance would be divided pursuant to the percentages of the court order.

my 20 year old son was offered a plea to reduce a rape charge to cruelty to a child and then claim the first offenders act with a 5 year probation charge...my question is if he takes this deal can he still join the military with this probation?
Answer
Sure, he will have a problem just based on what you posted. The question should be addressed to military recruiters.
Answer
He cannot join the military with any active probation, AND in five years when the probation is over, the military may still not wish to take him. Recognize also that he may have to register as a sex offender. See website for my experience with sex cases: www.lawrencelewispc.com

My ex-fiancee and I bought a house a year ago with both of us on the deed and loan. He wants to keep the house, and I am fine with that, I just want the items inside. How can we turn the deed and the loan over to his name only? We dont have the means to buy eachother out, nor is that necessary since I dont want it.
Answer
You'll need a written release from the mortgage lender to let you off the hook on the mortgage note and mortgage. Once you get that and you personal property, you may deed your interest in the property to him.
This response is not legal advice, since I do not have all of the information that would be required, and I do not have a representation agreement with you.
* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.
* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.

My parents want to give away their house to me now through a deed. It is completely paid off. If in the future they have medical expenses and they were to receive the state's medi-cal insurance, would they or I have to repay the state when they pass away? I understand there are several types of deeds. Which is the best one, and is a deed the only way for me to inherit their house?
Answer
Your parents need to meet with an estate planning attorney to discuss the pros and cons of gifting the house now and other Medi-Cal planning that may be available.
Answer
I agree with Ms. Rouse. A transfer by deed is not the only way to inherit the house, and is probably not the best option for you and your parents. There are many factors for your parents to consider before simply gifting the house to you. You and your parents are smart to consider these pros and cons before they deed their property over to you. Your parents should meet with an estate planning attorney to discuss their medical planning options and estate goals.

I was convicted of Transportation for Sales of Marajuana inn1995 in the Eastern District of Kentucky and spent 14 months in Federal Detention, I"m a U.C.Law School Graduate took the Bar a few times and would like to try again .....Will this conviction stop me from taking the Bar and practicing...can I get this record sealed/expunged ?
thank you
Answer
Just make sure you disclose it. Don't hide anything. Be upfront and honest. That shows integrity. It sounds like you were convicted on federal charges, which means there is a different procedure to sealing the case, if there's a federal process at all. Consult a federal criminal lawyer, but meantime, pass the bar exam and disclose everything you are asked to. Good luck.
Answer
Your conviction won't prevent you from taking the bar exam. But passing the bar exam is just one of several steps to become a lawyer. You must also satisfy the Bar that you are morally fit to practice. A 16-year-old felony drug conviction won't necessarily kill your chances, but the examiners will look into it. They will want to know how serious the offense was and they will want proof both that you accept responsibility for it and that you have reformed your ways since then. There is a very good chance you will be admitted if you have done those things (and if you pass the bar exam). Be prepared for some delays, though. These investigations take time, and the investigators will likely put the burden of proof on you.
Good luck.
Answer
You'll have to ask in KY whether they have expungement or sealing available. However, it doesn't matter for purposes of the State Bar. ALL convictions MUST be disclosed on applications for law school and to the State Bar, expunged or not. The State Bar will decide, in their total discretion, whether you are barred from licensing because of the conviction. Call them and discuss it.
Answer
Agreed. You can expunge it if KY law allows it but you will still have to deal with it in your Moral Character evaluation and 14 mos in custody is no small matter. You would be best served by contacting an expert in Cal Ethics.
Is it ok for my store manager to tell me that I should get on medication for my ADHD. And that I can't do my job because of it
Is it ok for my store manager to tell me that I should get on medication for my ADHD. And that I can't do my job because of it
Answer
If you are diagnosed with ADHD and are telling the employer that this entitles you to some leeway in your job, you have a medical condition and are disabled under the ADA. That on the one hand entitles you to reasonable accommodation (leeway) for your condition, but you must also make a reasonable effort to control your condition through available medical means. That's a "thumbnail" and your specific situation may be different that warrants a different analysis or conclusion. See an attorney if you are still not sure. It may be a different issue.
Answer
First of all, you do not state that you have been diagnosed with ADHD. Second, your employer's conduct is troublesome if it is made because the employer "perceives" you to be "disabled." Do yourself a favor and ocntact a qualified employment attorney.

I am a lecturer at an institution of higher ed. My contract was not renewed for next year, not for cause but for "needs of the department". I have appealed the dismissal, but when I asked for the notes from my meeting (there was a note taker), first my employer put me off, then she only sent me the summary. I later found out she told the note taker to shred the original notes from the meeting. Is this legal?
Answer
Illinois is an "at will" state meaning you can be fired for any reason or NO reason, the latter usually referred to as a layoff but whatever. That is, unless there is a work contract of some kind that specifies termination rights and obligations, or some other uniform set of practices and procedures. Without that, even a meeting and/or note taker was totally gratuitous, and if you agreed to any parameters for the meeting, that's the end of it. The more important question is whether there was any illegal discrimination involved in the firing: age, race, gender.... If so your recourse may be through the EEOC or through private suit.

My 90 year old mother wants to deposit a tax credit check from Dept of Finance into her checking account, but bank will not accept it because it has my deceased father's name on the check along with her name. My father passed away 10 years ago. What to do?
Answer
Two basic options:
1) get the check re-issued
2) open an estate and process the deceased person's portion through the estate/Personal Representative or if an estate was opened and closed years ago consider re-opening the estate

Can I quck claim deed a condo that I am the sole owner of to my sister who actually lives there? I also own the home I live in. My sister lives in the condo alone and wants to homestead it since she pays all the bills including the taxes.
Answer
There are tax consequences to any transfers of real property. Speak to an attorney and an accountant to make sure what the impact is on you. The document is called a quit claim deed, in which you transfer whatever interest you have in a property to someone else without any warranties attached to it.

Answer
When you keep breaking the law you are likely to go to jail. You have already blown it more times than most people. At this point you badly need an attorney. Get one.
Answer
This is a funny story. Have you read it after you wrote it? If you want to stay out of trouble, remain in jail. Every time you get out of of situation, you manage to put yourself into another, and it seems that none of it is your fault. You have an excuse for every predicament that involves someone else being at fault. If you really want to get your life on track, sit the next time you are arrested (in about one minute) and contemplate what you need to change about yourself in order to remain out of jail. Promissory Note Hell
I have a promissory note on a business associate of mine. I lent him money to invest in Bail Bonds. He had been making payments as planned.
Everything was great then he passed away in a fatal car accident. I have the notes signed by him and that is all. I am afraid that the family will not return the money. Is there a way to secure my initial investment? Can I put a lien on some of his real estate or the real estate that is in his wifes name?
Answer
Re: Promissory Note Hell
No, you can't put a lien on his property. You should hire an attorney to make a claim against his estate.
Answer
Re: Promissory Note Hell
Liens arise after a court judgment for money or other relief is granted, and the judgment is recorded. Under the Constitution, our right to due process of law is guaranteed, so you have to file a suit or legal action in the court, follow the established procedures, and get a judgment.
In a probate, you can file a Notice of Claim, file a Demand for Notice if no probate is yet filed, and may have a claim against beneficiaries who recieve property automatically, such as by joint tenancy, but do not pay creditors.

I work in PA. I am a Full time non exempt employee. My emplloyer is offering overtime for what they are calling a "2nd job" but the "2nd job" is directly related to the job we are all currently doing. the problem lies within the fact that my current rate of salary is approx $17/hr.... instead of the time and a half for overtime being based on my normal hourly rate, they are trying to assign a lower hourly rate for this "2nd job overtime". is that legal?
Answer
I don't think so. I suggest you contact the Wage & Hour division of the PA Dept or Industry Labor or the US Dept of Labor. If this is being done with many employees, and you would prefer private representation, contact me at 610-584-9400 and I will be glad to give you the contact information for a Phila area firm that handles those kids of cases.

My mother is in a nursing home here in California. She has Alzheimers and has been there for 8 years. She still owns a mobile home, which is in the family trust. My sister and her husband currently live in it. We received a letter today saying that when she passes the California recovery Program will come after their portion of all they have paid over the years. Question, if her mobile is in a Family Trust, can they still come after this? We do not intend to sell her home. Thanks!
Answer
The state will be happy to sell it for you.
Answer
It is part of the deal you make with Medi-Cal or the State of California, that you will repay on your death. To apply for it, her assets would have been listed. It is not exempt because it is in the Trust. You don't get it both ways, letting the State foot the bill for very expensive skilled nursing care for many many years AND get to keep all of Mom's assets without a hitch. This is what is known as the 'hitch'. You should check with an attorney near you to see what can be done.

My daughter and I purchased property in 2004 on a land contract deal. The contract was a 10 year agreement at $300.00 a month. I recently came home from work and found a sheriff sale notice on my door. The lady had taken a loan out on the property years before signing a sale agreement with us and failed to tell us this. The house was in need of major repairs when we moved in. Since then we have made improvements on the house. The sheriffs sale property is claiming a mortage company that has the morgtage on the is claiming $45,059.35 is owed on this house. This is $15059 more then our agreement is. My question is " How do I keep from losing my home?" (Sue)
Answer
So you didn't do a title search on the property? Why not? Your daughter signed up to pay $36,000 for a property when she didn't know whether the seller had a clear title. Nobody though it was worth an hour of her tme to check the land records at the recorder of deeds?
Well now she can sue the seller but she's not going to get to keep the property. I highly doubt that even getting a judgement against the seller will get her much either.

Johannes (Jan) Vermeer (1632-1675) is a Dutchman best known for his paintings, of which only 35 or 36 are known to exist. For an artist with such modest output in such a short career, it is phenomenal how many subsequent artists he influenced; these include Gustave Courbet, van Gogh, Seurat, Edward Hopper, Salvador Dali and even Damien Hirst.

I've recently been going to physical therapy through worker's comp. I normally work from 9:30am to 6pm. I've been going in to work around 11 because of my physical therapy every morning. Is my work suppose to accomedate me for the hours I've missed while at physical therapy, or are they not suppose to? Do I just work my 8 hrs from the time I clock in making me stay even later than normal?
Answer
STOP ATTENDING THERAPY DURING WORK HOURS. NO, YOUR WORK HAS NO REQUIREMENT to pay you for hours you've missed in therapy. There's an Urban Myth that you get paid salary for attending medical appointments during work schedule...it's a myth, not true.
Unless and until an MPN (insurer list) Physician writes you are 'Temporarily totally disabled" during the hours of therapy, nobody owes you payment. If you prefer to work 11am to 7:30pm and the employer permits it, GO FOR IT.
A better option: ONLY SCHEDULE THERAPY before or after work. IF THE THERAPIST refuses, GET A NEW THERAPISt OPEN AFTER 6PM. you'll need the Medical Provider Network list for this Comp Insurer. Find a Physical Therapy center on that list and call and find one that can do the therapy from 7:30-9am or from 6:30-8pm.

My wife and I are seperated, but not legally, she is in the house. She got a roommate with a dog. Am I correct in saying I still have a legal right to enter the house at will to get my mail or personal items and the dog needs to be caged and I dont have to call my wife in advance before I go to the house?
Answer
You still have the right to enter the home until such time as a judge says otherwise. Contact my office for free consultation.
Answer
If you have left the house then the court may look at it that you have given her temporary possession of the home and furnishings - this would be just like a temporary order for needs. I suggest you change your mailing address and if you need to go to the house - call her first. I would suggest before you let this go to far that you start proceedings for a divorce. Florida does not have a legal separation option. If I can be of assistance please contact my office for an appointment.

My friend has been accused of continuing to receive her husband's unemployment insurance after his death. She believes roommates stole the card and used it. The roommates stole and pawned her jewelry during that time and served jail time for that. She reported his death by phone. At least twice after his death money was put in the account and when she called to report it they told her that it was money owed before his death. She used that money but she didn't know about the later amounts and didn't use them. She is being offered a misdemeanor, probation, and to pay restitution if she pleads guilty, but will face felony charges if she pleads not guilty. Her court appointed lawyer doesn't believe her and won't investigate. He says the only way she can be proven not guilty is if the other party confesses. Pleading guilty when she is innocent makes her physically sick, but she faces jail if she fights this and loses. Any advice on how to proceed?
Answer
Do not plead guilty to something you are not guilty of, go to trial, if unhappy with your attorney, ask the judge for a new attorney.

I signed a 12 month lease with 2 other housemates. The lease contains an "Early Termination Fee" which requires a fee plus a 30 day written notice.
My question is if I want to move out early, can I do that if the other housemates don't want to or will I continue to be held liable for rent? By filing this notice, can I force the other housemates to move out or do all parties need to be in agreement?
Answer
You cannot unilaterally exercise the clause. The three of you and the landlord need to work out an agreement for a new roommate to substitute in for you, or you remain liable for the rent.

m3 misdemeaner means i have to be tried within 45 days. I did not waive my right to a speedy trial. They set my pre trial at 48 days out. Is this basis to get it thrown out?
Answer
In Ohio the speedy trial act of 1974 does codify the 6th amandment's guarantee of a speedy trial with specific time limits within which defendants must be brought to trial. There are exceptions to the time limits though. If you or your attorney have filed any motions or requested discovery or have sought a continuance, that time does not count against the state while those matters are pending. Further, the court does have some limited power to extend the time limits if there is a good reason.

Federal law says that the government can deny the issuance opf a passport for failure to pay child support. A person is entitled to notice and an opportunity to contest it. There is nothing I know of in Federal law that can automatically revoke a validly issued passport on account of child support.

You may need to advise the court the attorney has been dismissed and send notices to you. You may be better off retaining a new attorney/

My Wife's Father is on a Ventilator and is expected to pass soon. My Father in Law is married, however his wife is not mentally capable. With that said, I would like to know what my Wife's (The Daughter's)rights are concerning keeping her Father on the Ventilator or taking him off to let him pass away. We are in the State of Georgia.

That depends on whether he has a living will or directive, and many details not in your post.

My husband and I own a 50/50 S Corporation and have had the business for 8 years. We are currently seperated and situation has become very difficult to work there al day with him. I decided to work from home to prevent any altercations. With this said, he has taken over my desk, changed password to computer and database system, is withholding sales and monies. This is my only means of income, being that I am also a mom of 3 and handle everything with the children. This cannot be right and what can I do about this?
Answer
You need to confront your husband and tell him that if you divorce, the business will go down the drain, unless you and he come to an agreement that you may work at home, he will ensure that you are not locked-out of any computers, e-files, emails, correspondence, etc.
If he does not agree, you need to file for divorce. Your divorce lawyer should be knowledgeable about derivative suits, where one shareholder sues another shareholder or the company. You need to ensure that your share of the company is paid to you, because he has "ousted" you from the firm.
You should immediately consult an attorney. I would charge the consultation to the company because you are 1/2 owner.
If you stay with husband or ex who remains your business partner, prepare a shareholders agreement which outlines what happens in situations where your fellow shareholder acts more like an ass than a man.

I am within 2 months of losing my rental property due to back taxes. I am paying the mortgage on time. I can't come up with the taxes should I use my mortgage payments to pay the taxes, if not I am going to lose it anyway. I can play catch up with the mortgage company.. I just don't want to lose my property to the city for taxes...will I still be liable for the Mortgage...I am in panic mode right now. Please help
Answer
I suggest that you contact the city tax department immediately and ask if you can enter into a payment plan for the taxes. Beforehand, figure out what amount you can pay monthly towards the total tax bill and not jeopardize your ability to make the mortgage payment. Communication is imperative - the sooner you initiate contact with with tax authority, the more likely you will be able to reach a solution in time.
I wish you the very best.

My car was hit by a company 18 wheeler truck while it was parked waiting for the hotel vallet service to park the car while I was on vacation in New Orleane LA, What can be done?
Answer
If you know who the trucking company was, you can pursue a claim against that company for the damage to your car. In addition, please be careful, as, unlike Texas, Louisiana has a one year statute of limitations on tort claims such as yours. Sincerely, Carl Weinkauf
Is it true that they're bringing back Beavis and Butthead?
Apparently there will be new episodes of "Beavis and Butthead" but this lacks verification/confirmation : "On July 14, 2010, the return of Beavis and Butt-head was confirmed to the New York Post by sources at MTV. Mike Judge will create the new series and once again provide the voices of Beavis and Butt-head. The new series will feature the duo still in high school and will feature current music videos for the duo to comment on and make fun of. The animation will still remain traditionally hand-drawn." How do i go about getting sole custody of my daughter. My ex lives in a different state and still receive child support?
Answer
To get an accurate answer you will need to provide more detail. Assuming that your daughter and you are both in NY, you can bring a custody proceeding in NY. As for child support, to terminate a child support obligation where the order was initially issued in NY and you still live in NY, you can bring a support modification or termination proceeding in NY family court even if your child lives in another state.

Answer
Sue them in small claims court.
Answer
A suit for the tort of "conversion" seems appropriate at this time. Whether you go to Small Claims or Superior Court depends upon the value of the car. Obtain and read the Nolo Press guide to California Small Claims procedures.
Answer
Sue in small claims for the value of the car if under $7500, and report them to Calif Automotive Repair Bureau immediately.

paid 1000.00 to escrow 250.00 inspection, 500.00 for appraisal, after few months, deal was cancelled because one of my homes was foreclosed in jan. 2010, it was included in my b.k. in nov. 2009, only 1000.00 was returned, so i'm out 750.00, from the deal, i feel the agent should have done her research prior to me having to put out all this money. is there a case here? p.s. she stated she learned something new.
Answer
Sorry, if anyone has a claim it is the agent against you for failing to disclose your bankruptcy and foreclosure and making them lose their commission. Your agent is not responsible for doing "her" research about YOUR credit problems. Your ability to qualify for a loan is your responsibility, not your real estate agent's.
Answer
I agree with Mr. McCormick. If she learned something new, it was not to deal with you.

There is a mediation next week and I am a beneficiary in a will. Do I need a lawyer to safeguard my assets ? The will is being fought between the family and my Boss' partner. I am not in anybody's side.
Answer
It is up to you whether you want to have representation at the mediation. Unfortunately, without knowing the details, I cannot tell you whether you have anything at risk by not having counsel with you.
Yes, it can be expensive to have an attorney attend with you. However, you must weigh your options of seeing how much you have to lose versus the costs associated with counsel reviewing your matter and/or attending.
Let me know if you would like to discuss the matter.
Sincerely,
Caleb

Hello I need advice on tenant landlord issue. I'm currently being evicted due to unpaid rent which was due July 10th. The month prior I overpaid by 100 dollars to go towards julys rent. On July 19th we were served by the real estate company and given 60 days. The home owner who is also a lawyer then started to send us various letters about suing for rent due, on August 12th a sheriffs officer served us a lock out notice which stated the date would be aug 20 6:00am. But a judge did not sign it a clerk did. Unfortunately I'm trying very hard to gather my things and comply with the requests but I'm scared I won't be out on time due to lack of finances. Is there anything I can do or say to possibly ask for an extra day or so
Answer
It might be too late now for this answer to do any good. California law permits an extension of time for good cause upon application to a court. The tenant, though, must post with the court the reasonable rental value for the additional time that the court grants before the eviction is stopped.

I was recently attacked by a neighbor's German Shephard, Chow mix while walking my black lab down the opposite side of the neighborhood street. The German Shephard mix that attacked us barreled through an invisible fence after getting shocked twice. The dog attack both myself and my dog, knocking us over and reinjuring my old back injury, causing extreme pain especially for my line of work for the federal government. I did file a police report and have all records pertaining to the incident. Two questions. First, do I have a strong personal injury case against this individual?, and second what would this process entail? Thank you for your potential submission.
Answer
I think you have a case. The strength of your case will depend on a number of factors. I am representing someone at this time where coverage for their injuries was denied by the dog owners insurance company because the dog was a pit bull/chow mix.
The process would require you to contact the homeowner and get the name of their insurance carrier or contact an attorney experienced in this area of law.

I moved into a house on July 27th, on July 28th one of the pipes under house broke. We have NO water, and been that way for over a week. Landlord now tells us it's gonna cost more to fix than they want to pay, so they want us to move out.
We signed a lease, from July 2012 to July 2013. Can they legally do that? They do not want to pay us any money except the first month rent that we paid.
The house is in Florida. I have 3 kids, and school starts in less than a week.
I need advice!!
Thanks in advance!!!
I paid the landlord $370 to move in, I had to get electric turned on at $490, and the propane cost $300. You people say the landlord is helping me??
He is only willing to give me $370 back, and nothing more. He says it is "my problem". The plumber said he could fix the issue for $3,700 and in two days. The landlord just doesn't want to pay to fix it...it's not the fact the house is inhabitable, it's the landlord choosing to make the house inhabitable.
Answer
Sue the landlord in small claims and tell him you intend to do so unless he refunds the your money. The electric can be transferred to your new residence so it is unlikely you will get that back.

I have a friend who purchased a car from a car dealer in the area. Apparently they could not afford the car and returned the car to the dealer so he said he would take the car off their hands and they purchased a less expensive car from them. From what I understand they were told the car was sold apparently for less than what was owed. Now they have gotten legal action against them from the credit union and the credit union had a sheriff serve them with papers saying they are going to take their belongings. My friend called the dealership and told them she was going to sue the dealership. The dealership told them what they did was perfectly legal and they cannot be held responsible for what the credit union does. Does my friend have a legal suit against the dealership. I have never heard of a car dealership doing this to a customer. My friend assumed since the dealership took the car back that it was repossed and it was a done deal especially after she bought a second car from the dealership.
Thanks for your assistance
Answer
I really cannot discuss your friend's legal issues with you ethically.
The rule is that when you buy a car, you buy a car. There is no cooling off period and no right to bring the car back.
While the dealer may have taken the car back, its a repossession - it was just voluntary. Your friend should have worked this all out beforehand.
I don't know what was said between your friend and the car dealer or when this took place so I don't know if friend has any cause of action. The only possible avenue might be (and I say might depending on the facts) a claim for unfair and deceptive trade practices. However, its very hard to prove and car dealers (almost) have a license to lie.
As between your firend and the credit union, she needs to find a way to pay the deficiency or resolve it in some other fashion. As between your friend and the car dealer, she can see a consumer protection lawyer and see if she has any kind of a case.
Why doesn't the car fan won't shut off until you pull the fuse?
If this is the fan that cools the engine it will run for a while after the car is switched off. If its the internal heater then I haven't a clue.

Background: Bank of America has begun foreclosure proceedings against me. They did not sent a Notice of Intent, which was my only defense in my answer. With my pro se answer I asked for Discovery, to which there was no response after the 35 days.
There is a status conference scheduled for 10 days from now. The Plaintiff's lawyer sent a "Stipulation of Dismissal Without Prejudice" And here is the exact wording:
"It is hereby stipulated and agreed by and between counsel for Plaintiff, Bank of America and the Defendant, (my name), that the above action (including all counterclaims) be dismissed without prejudice as to all Defendants"
I'm assuming that they plan to start over with the proper procedures, or they couldn't complete the discovery in time.
Should I sign this and send it back? The Plaintiffs lawyer did not send a signed copy to me.
The other option would be to file a motion to dismiss for failure to respond to discovery. Would this be a better option?
Also, if I did want to sign the Stipulation of dismissal, I would want add: "the parties to bear their respective costs, including any possible attorneys' fees or other expenses of this litigation."
Should I have the Plaintiff modify the SOD to my liking?
Answer
You'd better get a lawyer pronto. Your efforts to DIY are speeding you to a judgment in foreclosure and losing your home. You can claim as many failures by the bank to strictly follow procedural rules, but you can't sit on your hands.
If you think you're saving money by not using a lawyer, how much is the house worth to you? Is it worth less than the cost of a lawyer?

Our employee responsible for payroll failed to file or pay payroll withholding taxes for about 18 months (2009 and 2010). Our Board of Directors or our GM was ever advised of this issue. The IRS was sending her correspondence abut the issue yet she was not providing management any information. We (management) were finally apprised of the situation after this employee resigned. We as a company now have a tax liability and lien on our property because of her negligence. Do we have any alternative of taking her to court in some sort of civil suit?
Answer
Not really. The company will be responsible for the taxes regardless of her actions. The company can either pursue a claim against her (and maybe collect on a judgment depending on if she has any assets) or just focus on the tax problem.

I want to know what the rules are for New York -- my husband and i have been married for 28yr however we have been separated for 13yrs I live in Florida and he Lives in New york Will I be entitled to spousal support and or a portion of his pension?
Answer
Spousal support is doubtful - you've been apart for 13 years. Pension is possible...depending upon when the benefits were accrued and upon whether you are legally as opposed to merely physically separated.
Answer
Under New York law, you would be entitled to 50% of the portion of his retirement benefits that accrued during the marriage (which I assume is almost all of his pension based on the number of years you were married). This would include pension, 401-K accounts, and other retirement accounts.
It is unlikely that you would also be entitled to spousal support, but it may be possible under certain circumstances. What do seasons cause?
As the seasons change, they cause the weather to change also. For example, if the season is Winter then the weather will be colder because in Winter the Earth is facing further away from the Sun. But if it is Summer, then the weather will be warmer, because the Earth is closer to the Sun, making the atmosphere warmer.

Okay I have a friend who has been convicted of a crime in the Ventura County Courthouse. His name is Vizcardo, Jonathan Reagan DOB is 6/22/1990 his violation date is 2001. The case number is 2011014241. He was convicted with unlawful sex with a minor. If the violation date is in 2001 and he was born in 1990 he would have been 11 at the time of the violation. I am kind of confused as to what is going on here. Is there anyone who can help me to understand this situation?

I've been living in a house for twenty years that was promised to me by a family member, but now face eviction or sale, what recourse do I have financially or tenant wise?
Answer
There is a landmark California Supreme Court case in which the Court held that a long-time occupant who has been promised the property (even via an oral promise, not in writing) and who has worked to maintain and improve the propoerty over the years can enforce the promise even though it is not in writing and perhaps lacks other legal requirements of a contract of sale or a deed, That case was decided back in 1950. It is Monarco v. LoGreco, reported at 35 Cal.2nd 621. You should look up the case on line. In the intervening 62 years since Monarco was decided, other more recent decisions have further sharpened the principles, sometimes broadening the rules, but here and there tightening the requirements for "promissory estoppel" to trump the statute of frauds, which requires real estate deals to be in writing (sometimes).
Of course, to the extent the owner has put anything in writing, your case would be strengthened.
If it is a lender that is forcing the unfavorable-to-you eviction and sale, the Monarco rule probably isn't helpful, but you could probably work out a deal - and get it in writing - with the owner, whereby you get ownership in exchange for refinancing the loan in your name.
Answer
I should add that if you go on line you'll get plenty of hits for the search terms "Monarco LoGreco" but the most useful will be to read the entire case and then try to find several more recent cases that cite Monarco.

Answer
This is not a civil rights issue. This is an issue of theft although it seems that DMV is treating this as a matter of conversion. I recommend that you consult with a civil attorney about this matter. You may want to consider filing criminal charges against your daughter. Her misconduct includes theft by conversion as well as perjury and fraud. You need to take steps to have the car put back in your name as soon as possible and to get your daughter to address her responsibilities in this matter.

I went to use the rest room in Walmart and I slipped on a toilet paper cover, and they said its not there fault my knee and leg are bruised up from the fall. Is this true it's not their fault?
Answer
Finding fault and find if damages are warranted is what judges and juries do. Their liability can depend on many factors. How long had it been since they cleaned the bathroom? How long had the toilet paper cover been there? How did it get there? You have to prove that their negligence caused your accident.
And from a practical standpoint, how much is the case really worth? Bruises really aren't worth a lot of money in terms of pain and suffering. You might have some small medical bills and a day off from work, but I don't see how that case could be worth much.

I'm in Virginia on business and just received word today that my ex was awarded full custody of my kids and my having no visitation rights; however, I was never served or notified of a hearing, etc nor was I informed by my ex of such case pending or taking place. I have been in constant contact with my ex-wife, kids and have purchased clothes and sent money while away on business. I have been gone for six weeks but the court is treating this like an abandonment issue. Apparently the court attempted serving me at an address I haven't lived at for 2-years.
The case was last Wednesday where she informed the court that she had no knowledge of my where-abouts, which is completely false. Because I have been out of town I wouldn't have knowledge of a pending court case or been able to be served.

MY father died with multiple debts. This includes back taxes. He also never paid alimony to my mother. He has about 25k in the bank but owes much more than that. My brother has power of attorney. Is it possible to pay my mom alimony with the money my dad has left in the bank? It seems fair that my mom should get paid her alimony (being his ex wife) before his other creditors. Is there a way for my brother to pay her legally before the other creditors? We live in California. Thanks
Answer
Technically a power of attorney is not valid after the death of the person giving the power of attorney. There is a summary probate procedure (that is very simple) that the heirs have to follow to get the money in the account and then give it to your mother. You need to see a probate lawyer.

Hi. My parents are getting divorced, and I'm sure that they're getting joint custody over me. Now, one area I'm concerned about is my last name. It currently is my father's last name. Now, if my main "home" is identified with my mother, does that mean my last name will become her maiden name? And if so, can I change it back to my father's last name again?
Answer
If your name was changed it would have to be a part of the divorce decree. However, that is quite unusual and unlikely to happen.
Answer
Your name will not change and will not be effected by custody. Your name cannot be change in a divorce case.

My ex fiance sent me a facebook message (we aren't friends on facebook) saying I owe her money for some bills and wedding deposits she paid. We haven't spoken since 03/2009 when I signed the house deed over to her. Now out of the blue she is threatening to take me to small claims court. Isn't there a statute of limitations to file a claim in small claims.
Answer
Generally 4 years in Pennsylvania since the last payment or promise. Good luck.
Answer
Depending on her theory of why you owe her the money she has either 2 or 4 years to file a lawsuit. 2 if she claims you committed a tort 4 years if it was a breach of contract. These limits apply in either the district justice or in Common Pleas.
It's been over 5 years so ignore her.

I had an unemployment insurance policy on a loan from citifinancial and it paid about 650 dollars in claims. We recently refinanced this loan after one year and one month of paying on it . The policy was for the duration of the previous loan and cost over 1400 dollars. It was payed off in the balance. We were told by citifinancial that under nc statutes we are not intitled to any refund since a claim was filed on this insurance . Is that true?
Answer
This is not really a credit, debt or collection issues. Its an insurance question and I don't handle these types of questions.
My take on this is that if you buy insurance of any kind and don't have a claim, the insurance doesn't refund your premium. You pay for the peace of mind knowing that you are protected in case something did happen and you would need the insurance.
Why would you expect some kind of refund here? Insurance is governed by what the policy says. Start with reading your policy to see what it says about refunds.
I would also see if you can ask an Employment lawyer or the Employment Security Commission of NC.
Here is a link to the employment statutes and I don't see anything in there, but check for yourself.

I recently received notice to appear for a pretrial conference for a credit card bill I couldn't pay, what should I expect.
Answer
First you need to take a close look at the notice you received and determine who is suing you, is it the original creditor, i.e. Chase or Bank of America for example; or is it a debt buyer such as Pride Acquisitions, Asset Acceptance, Portfolio Recover, etc.
If it is a debt buyer you may have defenses to the lawsuit against you. You need to carefully look at what the complaint against you alleges. Are they seeking damages under a breach of contract theory? Are they seeking damages under an Account Stated theory? Are they seeking damages under an Account Open theory? Are they seeking damages under an Unjust Enrichment Theory? What is attached to the complaint that was served on you? Did they attach more than one account statement? Did they attach a credit card agreement? Did they attach a Bill of Sale or other documentation indicating the debt was sold or assigned to them? Once you know these issues more clearly you can prepare for the pre-trial conference.
At the pre-trial conference, at least in Miami-Dade County, typically there will be a whole bunch of other defendants being sued by the same company or similar companies for debts. You will probably sit and wait for a while to have your case called. During that time you will be approached by the attorney for the party suing you and most likely offered a "deal."
The deal is typically a monthly payment plan on the full amount owed plus attorney's fees, court costs, etc. They usually are payments from $50 to $75, depending upon the amount being claimed it could be even higher. It will sound like a good deal because you want to get out of that court room as fast as possible. The good deal is not as good as it appears because you will be entering into a consent judgment whereby you admit that the Plaintiff had the right to sue you, you owed the debt and if you don't make your monthly payments they can immediately seek collection of the full amount owed without necessity of further hearing. Simply, if you fail to make a payment they will seek to garnish wages, bank accounts or seize whatever they can to collect on a debt that you stipulated that you owe!
If you don't take them up on the "deal" you will either be sent to mediation or set for trial or the judge will try to resolve the matter by talking to both sides to come to an arrangement. Again, the above scenarios usually not ending in your best interests. I would recommend that you contact a Debt Defense Attorney in your area and have them look at the case against you to see if you have any defenses and help you determine your best option.
Answer
I agree with the above. I strongly suggest you see a consumer lawyer who handles debt collection defense. Msay times they will handle these matters, as I do, for very little money and many times they can collect attorney fees from the debt collector. So me & 3 of my friends we're walking & stopped by the police. They searched us & found 17 nickel bags of weed. Here's the thing it was in a bookbag on someone who's on parole. I told the cop the bag belong to me but they said it still doesn't matter. So now they want me to write a statement & tell its my weed. That's fine & all but when I write the statement, what can happen to me? Do I need a lawyer?? Please someone answering me.
Answer
You definitely should have an experienced criminal defense lawyer. Don't write anything for the cop.

Yes, and you also needed one before you opened your mouth. You've already dug quite a hole for yourself, and you seem eager to keep digging. Get a lawyer right away and don't say another word to the police (or anyone else) about what happened until you do.

Agreed. Say nothing and hire your own attorney. That's felony level here in Michigan.

I have two children. The father and i split up and we had legal cutody papers in place. In september he attacked me and i had to have him arrested. I then got a protection order covering my children and i. and he is not aloud to talk with the kids or see them. The criminal case will be settled in August and he will be going to Prison. my Job is wanting me to move from kansas to oklahoma. in our custody agreement i am required to give a written 30 day notice if i am moving. For obvious reasons i DO NOT want to inform him of our move nor my address or any information period because he is a danger to us. My question is does my protection order override the custody order. and can i go ahead and move and not worry about it.
Answer
In most cases, a Temporary Restraining Order does not ovverride a duty to inform. You probably still have to give Notice of your proposed move. If you are fearful for your safety, you can file a Motion with the Court to waive your duty to give him an exact Oklahoma address. You might opt to move, without informing or getting a waiver, and take the risk, But, it could backfire on you. You couid be required to pay the full cost of the children traveling every month/week to see their father in prison, and you could lose custody. Perhaps you should consult with the attorney that represented you in the custody and/or Restraining Order actions.

I sold a car to someone for $1400. I didn't have the title yet so they told me they would give me $1000 and then pay the rest once I gave them the title. I've had the title for almost five months and have tried to contact them multiple times. They have my car and will not pay me for it. I have no way of finding them. What can I do?
Answer
You ma have a few options. Hold onto the title until you get full payment. Contact the Department of Revenue, to make sure that no one has tried to retitle the vehicle. (if your address changed since you last titled or licensed the vehicle, there may have been a notice sent, that you did not get.) You might also pay someone to try to find the buyer for you.

The car that i was driving in was hit head on by a drunk driver driving the wrong way on the interstate. One was killed, one seriously injured, one disabled for life. several 911 call were made to different LE agencies at least 10-15 minutes before accident. LE agencies failed to broadcast out information to police units to attempt to locate or intercept drunk driver. Are LE agencies responsible for not acting on credible information?
Answer
It is difficult to recover against law enforcement under this scenario through the Texas Tort Claims Act. However, you should be able to recover damages from the at-fault driver's insurance company as well as any underinsured motorist coverage that you have for past and future medical bills, lost wages, pain and suffering, mental anguish, and disfigurement.

Need some legal advice regarding my rights as a wife living in a rental house with husband. Have been married for 10 months. I have a house of my own, but last summer my husband was removing a tree and tore down my electric pole. Finally after staying on him he set another pole and half way installed the electrical to it. Then when I asked him to pay the electric bill, he told them to apply my deposit to the bill and shut off service. This is my residence that I have had for 12 years now. Things are not what they should be in the marriage, so a divorce is the only option. He wants me out of this house we both live in, and last night he left. First can I make him financially responsible to get electric back to my house since he is the one who did the damage? Second, since he left, can I stay here in the rental house till the repairs are made and I can go home? And since he left, can I make him stay gone till I am in my house? I am unemployed and have no money for these repairs
Answer
All of those are possibilities, but not without the assistance of an attorney. Hire a lawyer in your community who can more specifically answer your questions and help you achieve a fair outcome.

I live on a parcel that has two units on it. The front house is a two bedroom with gas wall heaters and gas water heater and stove. And the rest of the house ( lights, alarm, dryer, dishwasher, and ac etc) is electric.
The unit I live in is actually a two room office space that he has rented to use as a residence. It has a kitchen, bathroom and waterheater, and ac. It is completely run electrically.
Both units are run off of one set of meters.
When we moved in friends of ours lived in the front house. They had a discounted electrical and gas rates based on economic qualifiers ( a low income discount, afforded to those that qualify).
During the year that we have lived here we have paid $ 60-120 per month for electric. In the summer due to lack of insulation (windows are not operational, doors don't seal, etc) we use the ac just about all the time. Our only source of heat is in the front room and is provided by a wood stove. It takes some of the sting of cold - it's regularly 50 degrees and with the stove brings it to 60. Despite this we stay because during this year my husband suffered a near heart attack and put him in the hospital for four days. We have a 16 year old dog and ultimately when we moved in it was because we couldn't find any other place that would take us ( we had lived with with relatives - so we didn't have real rental history and having a dog that weighs over 55 lbs, and my husband smokes). So we have dealt with these things because after 613 days at an extended stay we were over joyed to have our own place and a free standing unit at that.
So here is our problem. When one of our friends in the front house passed away, and his girlfriend moved out, leaving considerable utilities unpaid . Two to three months worth, we had paid her our share. The electric bill was in ( our dead friends name) and the water bill in the landlords name. I should mention that he receives all his mail here and it was the habit that when the water bill would come he after receiving his mail from our friends - he would then hand back the water bill to her. He still portrays to the world ( banks, businesses, etc that he lives here. ). He used to live here and ran his business from where we reside.
So when our friend died and we where left with unpaid utilities and started receiving disconnect notices - I gave him the notice for them and he said he would take care of it. I told him at that time that i had looked into the electric bill and i told him that if possible please leave it as is - because when our friend moved in she would put electric and gas in her name as she qualified for the same discount and the date that they were saying would be discounted was the day she would move in. So all he had to worry about was the water. Well he forgot supposedly and we were turned off , we informed hi he apologized and said he would remedy it. Well he didn't and they turned us off and locked the meter. So I blew my lid - he apologized and nothing more was said. The day before the new tennant was to move in our old friend who had moved ( who had been the one performing magical math and then billing us for our electrical consumption and who had taken our money and not applied it to utilities or answered our calls to untangled this mess) suddenly decided to call the electrical company and turned service off. She then informed the landlord of her actions, he without speaking with us or the new tennant and being fully aware that when he did that our rates would sky rocket . When I became aware of what our former friend did I inquired and he said he put it in his name and that the new tenant could switch it if she wanted later. Then when the new tennant moved in they signed a lease and he took it to copy and said nothing further about his process for charging us in the back for our usage or to her and the fact that she was responsible for utilities and should put in her name to recapture discount. He is impossible to get to respond in a timely matter to anything - so eventually as time worn on we all became concerned and as I became aware that there was a electric bill in the pile of mail that collects in one of his cars that he keeps here. Again all in his name - so the new tennant at this time questioned if she was responsible as he never said anything. He also at this point was over 30 days into her tenancy and still she had no copy of her lease to verify who was to pay what. Finally when the first came around she held her check until she got her lease. So he returns the next day and sites "he lost the lease they had signed"
And they drew up another one, at this time I was present and offered to make the copy for them. I did that and it was then he handed her a electric bill that was already past due and was only for nine days due to him changing into his name in the middle of billing cycle. He also said that he would be putting in a separate meters in soon - we were thrilled. although he has said this before several times thur out our time here.
He left and we examed the bill and it was $ 160 , we were shocked and worried so using the Internet and the account number that we now had I looked at what was currently showing and it showed $800 bill. We went to electric company and they took our payment of 160 and allowed us to switch into her name but that we would be liable for the $800 and for at least 2 months of billing at the higher rate as it takes that long for the discount application to kick in. The actual usage is not excessive but without the discount we can expect that the next two months will be billed at about the same amount. So although we can get a payment plan for the first 800 the following two months will be due as normal. So with no date for when he will put in the meters and two months of outrageous pricing what recourse do we have. I believe that due to his neglect to clarify these matters with all concerned parties he should be liable for the difference in what it would be with the discount and what we are billed with currently. If he ha spoken with us as it was known to him that we needed this discount and that the new tenant could have switched it the day she moved in and this would not have become as huge a problem. HELP, I know this is a long question but I tried to give you all the back round. We pay $1000 in rent and out rental agreement says only that we are responsible for any usage above normal usage of the front house. And on the lease that we suspect he redrafted for her it only states that landlord pays nothing. When we signed our agreement we did not realize what a pain in the ass this would become. And since our friends were doing the magical math as I said we never paid more then 120 in the summer and 60 - 75 in the winter. What do we do? We have always paid rent on time and cAnnot afford anywhere also still. Help!!
Answer
You may need to take your lease to an attorney for review. If you are not responsible for anything more than the overage, then it is the landlord's responsibility. You should send him written demand via certified mail that he cover the extra utility costs. He is probably not required to make sure you get the reduced rate.
If your landlord won't pay, you may end up having to pay or risk losing electric service, then sue him for that amount. It sounds to me like your unit might not be legal. If so, you could also claim a refund of some or all of your rent. That is why you need to consult with a local landlord tenant attorney.

We bought a home in 2009 - got a quit claim on. We had a hand written agreement between the 3 of us and We have been making the payments on it - long story short - my husband got hurt and we got behind on the payments, which was no problem till recently when my husband and the person we bought the property from got into a huge fight, and they are now saying they want everything brought up to date in 30 days or we have to be out. Since we have the deed in our name, do they have any ground to actually make us leave in 30 days? There is also a claim that htey have someone who is interested in taking over the note for the house - if this is true, does the contract we wrote with the original person still hold up? or would it be null since it was a new person carrying it?

i have a question about unfair sentencing. i know 2 people that are charged with the same charge. one of them had several charges and had the charge they had in common dismissed in a plea agreement. the other one is looking at 10 years.isnt that unfair?
Answer
Sentencing is very unique to the person. It takes into account the individual's prior criminal record, employment, treatment (sub abuse or mental health), age, participation or role in the offense (what did each do in commission of the crime). Sentencing also takes into account protection of society and rehabilitation of the defendant. If the matter is a felony the Dept of Corrections will prepare a report called a presentence investigation that provides information about the defendant to the court and makes a recommendation for sentencing.

I was injured and won my first qme, my employers insurance company has 2nd qme scheduled. Is his findings binding? Workmanship comp dr has a 25 0/0. Permanent injury and I received offer for that. Can it change with the 2nd qme findings?

Why changing QME that found in your favor? A second bite to this may be completely a different opinion and be shocking to you. So you should question adjuster as to why or retain an attorney to help you. Feel free to call me at 213-388-7070 for a free consultation.
Answer
There should just be the one QME. You can get a second QME in a different specialty, but you should not have competing QME opinions.
There should be one Treating Physician's Maximum Medical Improvement opinion, then just one QME Opinion.
WHY don't you have a Treating MPN Physician's report showing Maximum Medical Improvement with your highest Permanent Disability finding? Maybe you can still get to an MPN Treating Physician that would write about Whole Person Impairment (WPI) beyond that found by any QME.
The opinions of a QME are never 'binding' until a Workers Compensation Judge makes a ruling after a full trial that a particular QME is the Best Evidence of your actual disability.
Until there is a Findings & Award by a WCAB Judge, nothing is binding.
You can request any sum you want to request for a settlement. If request a sum way beyond that which a judge would award, it will not be considered.

nevada unclaimed property related
can I claim something as abandoned if a person left personal property in a restaurant or club and has not made an intent to claim in over a year?
Answer
There are several details you neglect to mention here.
First, do you know the legal owner of the property? If you do, you cannot simply claim ownership because it has not been claimed by the person who has legal rights to the property. You might be able to if you make a good faith (genuine) effort to locate and notify the rightful owner where the property is. Lost property may not simply be deemed abandoned if the true owner is known to the holder.
Are you the owner of the establishment? That is who must make any claim for such property. The circumstances of the "abandonment" come into play here, as well.
If an effort is made to find the owner and let him/her know his/her property has been found, but there still is no move by such owner to claim it, then it may be treated as unclaimed property. There is an entire chapter of statutes in our state relating to such property: http://www.leg.state.nv.us/NRS/NRS-120A.html

I was in an auto accident on 08/27 in Houston TX. I was the fourth car in a left turn lane with a green left turn arrow. The oncoming traffic (5 lanes) had a red light. Another driver ran the red light and hit me. There were no injuries but I had $1100 damage to my vehicle. She swears her light was green even though there was traffic in all of the other four lanes around her. There was no police report. Her insurance company has denied my claim stating it was a she said, she said. Can I and should I sue her in small claims court?
Answer
Unless you've got witnesses to back up your version of the events, you will have a difficult time, as the other driver's insurance company will hire a lawyer for her and you will be representing yourself. This is especially true since you were turning left in front of the oncoming lanes. It's the old "he said/she said" problem. What does your insurance company say? If you had comprehensive and collision coverage, the easiest thing might be to turn it over to your insurance company.

is it possible for a case to be reopened after being closed for (no information)? the charges were child abuse and drug possession. no one can explain to me what happened. i was there when the arrest occured and witnessed everything. what is the law around evidence suppression? how can i get it reopened to protect the victim who is my 2yr old son?
Answer
Yes. Cases that have been "No Infoed" can be reopened for up to the time the statute of limitations occurs. A child abuse case depending on the facts of the case has a certain period of time within which the case can be brought. Up until that time the case can be reopened.
The fact that it was no infoed indicates to me that although there was probable cause to arrest, there was not evidence beyond a reasonable doubt for the prosecutor to convict and thus he did not formally charge the perpetrator.
Bring the prosecutor evidence. With a two year old you will need an eyewitness or medical evidence that will prove the charge. The eye witness should be credible and without an agenda. Ask for a meeting with the prosecutor, as the victim's parent you have a right to an explanation.

I have two children that visit their father 25% of the time. My oldest son will be 14 in October and is wanting to stop visitation. He told his father he wants to take a break but his father said, that is not possible and the courts won't listen to a child. I don't think we could get a hearing anytime soon to address this issue. My son is refusing to go for his next visitation time which includes vacation days totaling 10 days. I'm not sure how to handle the situation. My ex-husband is quick to call the police and I'm sure that will happen if my child refuses to go for the extended time. Do I leave him at home with a sitter so as not to expose him to police action or do I bring him and force him to go? Does he have a chance of being heard and not be forced to go? Do situations like these always go before the courts for decision or is it possible to release him from visitation without court intervention?
Thank you.
Answer
Your best remedy in light of the circumstances would be to file a request for order with the court with a emergency declaration asking to have this matter set as soon as possible. Please meet with an experienced family law attorney to explore your legal options.

Who is at fault is a moving vehicle hits a non moving vehicle that is legally parked on the street?
Of course it seems like the moving vehicle is. They should have left a note if they were an individual with morals and who would'nt like that to be done to them.
ADDITIONAL INFO: Though each accident is handled on a case by case basis, generally the operator of the moving vehicle would be at fault, however instances where a vehicle is illegally parked or grossly impeding traffic may warrant further investigation. In such cases it would be possible to make a case for the illegally parked vehicle be at fault. In such a case of an illegally parked vehicle the owner of the vehicle, even if not deemed at fault, would more than likely at least receive a citation.
If such action occurred, then it would be easier for the operator of the moving vehicle, even though they were determined to be at fault, to make a case that if the illegally parked vehicle were not illegally parked in the first place then the accident would have never happened.
