If the person has been declared incapacitated by a court then he most likely couldn't continue in the job. The shareholders elect the Board of Directors (with the incapacitated shareholder's guardian having the right to vote those shares), and the Board elects its Officers.

Your loan modification would presumably be a contract. Contracts can be enforced, even in Rhode Island. The bank knows this. If the bank has notified you that the payments are going back up to the original amount, two things are possible: (1) The bank is breaching its contract with you; or (2) you have done something, or have failed to do something, that amounts to a breach by you of the contract.
Which is it?
If #1, get a lawyer to go to court on your behalf to enforce the modification agreement.
If #2, be prepared to suffer the consequences.

The cop was wrong to say the kids can't be witnesses. They can and are all the time. There is a definitely a charge, such as aggravated assault with a deadly weapon. On April 29, 2012 the store I was managing received a shipment of floor freezers. Because the freezer hinges stuck out a little too far I was not able to take them inside the building without disassembling the lid from the freezer. As I was unscrewing the bolt that held the hinge in place, the hinge snapped up and got me in my face, breaking my eye socket and rupturing my sinuses. There was no warning on the freezer informing the custmer that the hinges were spring loaded. As a result, I had to have a surgery. The doctor that performed the surgery entered my nose with a balloon to push the bone back in place, dislodging a bone fragment and it ended up landing on my brain causing major headaches, and loss of movement in my legs as it caused my cyatica nerve to flare up. I had a surgery one week later to fix this as well. Are there any repercussions I can take? I am now receiving $11,000 bills for the surgery because workers compensation found in favor of the insurance carrier who disputed the charges from the original surgery. Any information would be helpful.

I don't really understand why you would like to put his name on your birth certificate but I can tell you there are going to be numerous reasons this will be difficult if not impossible. For example, the fact that your mother would swear to it really is not enough if there was anyone who opposed it. When unmarried people have a child, parentage must be established either through consent (voluntarily stating it in on the right form), by operation of law (in CA if you are named the father and do not contest it within 2 years of finding out you have been named), or after genetic testing (DNA). If the man your mother named is now deceased, he may have died without a will and his children would have inherited his estate. If you are now found to be a child because of the birth certificate, it could cause havoc in the probate court because you could claim a share of any inheritance. Pretty likely your new brothers & sisters would oppose you being named as another child if it could result in any of them giving up property or money. In short, having a birth certificate with his name on it would give you legal status that you previously didn't have. There are numerous situations where I could see there being motivation for an opposition to this change to your birth certificate. I don't mean to suggest anything offensive, but just because your mother tells you it was this person, how do you really know? She may not be certain but wanted to give you a name. She may know for sure but named someone else because she is embarrassed about the true identity. I'm not suggesting you assume your elderly mother is lying, just pointing out there are so many problems with trying to add a deceased person to a birth certificate.

1. I have an appendix which is about four or five pages long and which is comprised entirely of quoted material from factual sources. I quote no more than 300 words of original material from any one source, and draw altogether from a dozen sources. Collectively, the quotations work like a montage, creating a factual overview of historical events dealt with within the novel. My position is that this is fair use because a.) it is educational in nature, b.) the juxtaposition of quotations creates a new and meaningful overview, c.) the thing that is created has social value, d.) none of the quotes constitute the heart of the original work.
On the other hand, my novel is for profit -- so I am wondering, am I safe using these brief quotations, or should I get permission for the ones that are not in the public domain? (If there is a risk, how risky is it?)
2. If the above is okay, can I freely use quotations that draw on factual sources, or translations where the original is in the public domain, so long as I don't go over 300 words and so long as the words I use are not the heart of the work from which they are drawn?
3. In much the same vein, is it okay to quote a single line of poetry or a single line of song lyrics?

Fight the accusation. Paypal has internal dispute resolution but may not rule in your favor. If they believe the buyer, you may be stuck with their arbitration requirements. Look into their dispute resolution procedures first. If you're thinking of suing remember Paypal is really a "clearing house" and "middleman" and if the buyer is not in your jurisdiction you may have to sue in the buyer's jurisdiction and if Paypal terms and conditions obligate the parties to arbitration, your case could be deferred and you could be required to arbitrate long distance. Depending on how much is involved it may be worthwhile for you to take this one "on the chin", refund the purchase price and demand the product back, and attempt to resell it.

California has a minimum fee schedule for legal fees depending of the asset value of a probate estate. Living Trusts cause assets to pass outside of probate. In Texas, probate is no big deal and not terribly expensive as it is in California. However, Texas has some laws regarding homestead real estate that might make it advantageous to amend a California Living Trust into a Texas Living Trust to incorporate those homestead provisions.

A year later the same surgeon fixed a hernia (which was caused by the bypass) another 4 month recovery only a few months later I need to get my skin removed from my stomach and I go see a plastic surgeon and he tells it seems like I have a hernia to him Ugh!!! When he opens me up he discovers that the hernia was not repaired all the way and there is string just laying there and my guts ect are exposed (which could of led to all sorts of problems ) I know have to have another hernia operation (again more down time and distress, depression ect). My husband went ahead and paid for tummy tuck because doctor didn't think I should keep getting cut open. So this is second surgery he has screwed up causing me down time, stress, and not able to look for a job. What options do I have. My PS took pictures of the screwed up hernia operation. I doubt that your employer can be held liable based on the given facts. Your potential recourse is (a) to your own insurance company, or (b) your co-worker's insurance, perhaps via a small-claims court suit to establish liability. The problem with using a "work-related event" theory to recover from the employer is that the employer's role in causing the damage to your car is quite remote, in my opinion.

First, check your divorce paperwork to see what it provides. If there are no special provisions, the applicable Kansas law from KSA 60-1610 is as set forth below. Normally, child support will continue until June 30 of the child's senior year in high school.

It's a six-year statute of limitations. Don't trouble yourself about the hearsay issue, since there are exceptions. It is unfair, especially since you had an earlier agreement that you could keep the money. If they send it to collections, there are some very definite steps to take. You are not required to leave anyting to yrou adult children. if you fail to provide for minor children the bequests of your will may be altered by the probate court. If you are silent about aspecific child, they may be able to convince the court that you simply forgot, and get the will amended to conclude them. The attorney that is drafting your will should be able to explain this all to you. If you are going without a live attorney, (such as with a form form abook or th einternet) then any child left out will likely be able to have the will nullified or altered to make them an equal beniciary.

One of the three tardies counted against me was during training and a result of a mistake on the schedule given to me at orientation. About half of the class was late because of the mistake and we were all counted late. I talked to other trainees (caucasian) that were late because of the typo on the schedule and some of them said their respective managers had torn up their write ups. Mine however was counted against me and eventually contributed to my being suspended pending termination. Is there a possible case for wrongful termination or discrimination?

To file a lawsuit for wrongful termination or discrimination, you need to suffer an adverse employment action. Mere suspension is probably not enough.
Additionally, it sounds like you have other reasons to be terminated, like the other two tardies. So even if you do file suit, they could argue that you were terminated for performance reasons.
If you feel strongly that discrimination based on race occurred here, speak to a lawyer about filing a charge with the EEOC or IDHR today. There are strict time limits to do so.

It isn't necessarily grounds for a mistrial. A mistrial is when the trial has actually commenced and an error has occurred. In such an event, the case wouldn't go away, rather there would simply be a new trial. From your question, it sounds like there isn't an actual trial that has commenced.
If anything, it could be grounds to have the prosecutor recused from the case and assigned to a new prosecutor. The problem you have is that this prosecutor has now been assigned to your case for 8 months now and you haven't raised it as an issue before.

The judge will give you additional time, if you ask for it, to find another attorney and get your paperwork filed properly. Make sure you have all of the fees you need, etc so that the process can be started immediately. Also you should know that USCIS will send you receipt notices when things are filed on your behalf so if you aren't getting them you know that something is wrong. Best of luck.

One of my CPAs told me years ago that they will come after me for 20 years or something like that. But from what I'm reading, that's not true. After the Bush changes to student loans, they can not be discharged in Bankruptcy or virtually anything else. However, President Obama introduced some serious reforms that might help you. Also, he got rid of Sallie Mae and brought them all under the Federal government. I myself found thousands and thousands (over ten thousand) in fake/false charges added in that it took years to deal with. There are some discharge waivers for when the school closed down, especially if the school was just fraudulent. There are discharges if you still owe after 20 years and can't pay. You really need to contact the Department of Education OMBUDSMAN office in Washington and talk to them. You have virtually NO legal remedies, unless you find fraud and have the evidence/time to try to straighten it out. You are better off talking to the DOE. Best of Luck!

The rules can be a bit dicey with private schools with a church affiliation. I supposed that your school is incorporated in California as a non-profit and the PTO is simply ancillary to the school. If so, then the church/school will be accountable for the proper use of money that is raised by the PTO. Uses outside the scope of articles of incorporation and the legal limitations on the use of funds imposed by both the federal and state government on nonprofits are prohibited. (If the PTO is a separate non-profit entity, then the church cannot use these funds without PTO approval. I mention this because I have administered nonprofits with separate fund raising entities.) It sound to me as if you have a difference of opinion about how these funds are being used. You will need to address this internally within your church, unless there are violations of law. In that case, you may have a duty to raise this with the IRS and state government.

You have a fairly simple situation that is made very complex by the intersection of estate, capital gains, and property tax laws. If you do not anticipate being able to take over the mortgage before your inlaws die, most likely the best course of action is to put the property into an intervivos trust, and have the trust rent it to you for the cost of the principal, interest, taxes and insurance. I would then pass to your husband automatically once his parents pass away, and you would save possibly hundreds of thousands of dollars in capital gains tax, while bypassing probate. If you think it can be paid off before they would be expected to pass away, then it gets more complicated, but just transferring it to your husband at any time during their lives is likely to be a real tax mistake any way you look at it, unless you buy it from them for full market value. Your inlaws really need to spend a little time and money with an estate planning attorney to sort through the best course of action to accomplish the results they and your husband are reaching for.

An inter vivos trust (living trust) is a very good choice for passing appreciated real property from one generation of a family to the next. The capital-gains tax avoided almost always greatly exceeds the cost to set up the trust, and unlike a will, does not require a probate proceeding.

In this line of business employees don't clock in and out. Judge did not take all evidence into account once the defendant started crying. She was awarded $400 no penalty. Can she now sue in civil limited where judge may look at case more in detail? In my opinion, her option would be to appeal the small claims action, which is heard before a limited court judge. She needs to file an appeal from the judgment. Then there will be a trial de novo which basically means the court will hear all the evidence again. It's just like a trial. Note, though, that the court, on appeal, can do whatever it wants including finding in favor of the other side. New arguments and new evidence can be heard. Also note that you have a limited amount of time to file the appeal. Your county should have a small claims adviser who you can reach over the phone and speak to about the process. You may also use an attorney at the small claims appeal. In fact, it's probably advisable. Best of luck to you!

First, unless you were convicted of a felony, you never lost your civil rights. As far as the pardon process, you don't need an attorney for that, you just apply. I know little about pardons (because clients rarely hire attorneys for this), but I can tell you the process takes several years to complete.

Its really hard to understand your question but I will try to provide an answer.
You made a terrible terrible mistake in giving someone whom you don't know your bank card information. You also made a terrible mistake in paying on an account to which you may not owe anything. Chase doesnt file lawsuits in Pennsylvania at this time, so that means that your debt was sold to a debt buyer. Those are easily beaten by a consumer attorney.
Consult with a consumer attorney before you make payment to a debt collector.

I agree with Attorney Artim. NEVER NEVER give out banking information over the phone to anybody. And never make a payment plan with a debt collector. Assuming that you owe the debt, then you save up to resolve the debt at some point after discussion of your circumstances with a lawyer. But no payment plans with debt collectors - too much can go wrong.
You got a call from a debt collector. Chase has not been filing lawsuits because it got into hot water with the FTC for falsifying court affidavits to complaints. Lately though it is not suing because Bank of America and Chase and other lenders are gearing up for a big audit by the Consumer Finance Protection Bureau. Right now, Chase is not selling accounts to junk debt buyers but they did this in the past. My guess is that you have an older account (which may even be barred by the statute of limitations) that Chase sold to Midland, Palisades or another junk debt buyer who has sent the debt for collection. You were called by the debt collector.
Tomorrow, first thing, you close your bank account and ATM card and get a new one. Second, my rule is that if debt collectors send you nothing in writing, you do not pay them a penny. The debt collector is required by federal law (FDCPA) as well as PA law (the fair credit extension uniformity act) to provide you with written information about the debt. They are supposed to send a letter within 5 business days after they make phone contact with you. You need to dispute the debt and get specifics. If they keep calling then you need to talk with a consumer lawyer like Attorney Artim about sending a nasty letter to the debt collector.
Thirdly, law suits are not commenced by phone call. Debt collectors lie. Frequently. If you were sued you would know about it because letters from bankruptcy attorneys and debt settlement companies would start appearing in your mailbox before you were even served. And you have to be served with the complaint, most often via the sheriff or by certified mail.
Get your bank account cancelled and then wait for that letter. If the debt buyer calls back, follow this script: (1) ask if the call is recorded; get the time/date of the call, the person's name and find out which debt collector is calling. (2) ask them if they sent you a letter about the debt as required by the FDCPA and PA FCEUA? If not, ask them to send to your home address and provide it. Then hang up. If they claim to have sent it, ask them to re-send because you never received. If they refuse, hang up. If they try to get payment information out of you, tell them that you have spoken to an attorney and that you were advised of your rights under the FDCPA and FCEUA and that any discussion of payment is premature until you have received written notice about the debt. Hang up.
I doubt you will make it very far in the conversation before they hang up on you. However, I would then get up with Attorney Artim or me or another FDCPA attorney and discuss this.

There are a number of factual quesstions. First, was it an agreement in writing? Is there an interest rate stated? How much was the debt and what was it for. You can sue in small claims court for up to $10,000.

You are in a particularly poor position. You need an attorney fast. Here is why: If you shut off the utilities not only might you be arrested, you will face criminal charges, PLUS the tenant will automatically get 3 months rent plus attorney's fees as an award for your misconduct (called self-help). I have dealt with many landlords who would rather roll the dice without having a clue what the law is because they think the court will side with them because the tenant was morally wrong, that is just flat out wrong! Also, a landlord's ability to pay is irrelevant when it comes to providing utilities. The law says, if you CHOSE to lease an apartment to someone, you guarantee that tenant that it is a habitable apartment and fully complies with the state sanitary code.
Most attorneys charge an hourly fee for landlords with a retainer upfront and can walk you through the process with an overall cost of somewhere between 1500 and 5000 depending on how complex the eviction process with your facts are. Now, let's assume the rent is 1,000 a month and you make one mistake by say, turning off the gas/electric; you go to court, the tenant gets 3,000 plus the hourly rate of their attorney (generally anywhere from 200-450 per hour) and the attorney's fees often dwarf the judgment so conservatively figure on 3000.00 plus another 8000.00 for attorney's fees.

You can address this question as part of your divorce process. Clearly, the relationship of someone like him with your children is a factor that can be addressed by the court as part of the parenting plan. Beyond that, your options are limited.

You can file for divorce, ask for temporary orders to stop his spending and then get 50% of his 401k that was accrued during your marriage.

I had water flowing from 1side of my home so I called a plumber to come out and check for a leak he said. he found a leak in the pipe that runs from the street to the house. they did the check while I was at work and they replaced the pipe while I was at work also. They never showed me the pipe they removed. and there was still water flow for days after they finished . They said that was normal. I should add that we were having a lot of rain fall last year prior to them coming out and I made them aware of this and that I just wanted to make sure it wasn't a leak.. This time we had a heavy storm a day before so I believe once I call them to come check for a leak they are going to say it's from the rain which I now believe was the case all along. So what should be my coarse of action.

The brake light switch is mounted in a brake line junction where a main line from the master cylinder connects to a fitting that branches out to the left and right front brakes. This is located just behind the radiator below the battery. It is not a mechanical switch like you would find under the dash on a more modern car, but it is triggered by pressure from the hydraulic brake lines. If you have a leak, air in the lines, or worn brake shoes you might have difficulty with the switch lighting the brake light.
