At what age do kids get to make a choice as to where they want to live?

Question

At what age do kids get to make a choice as to where they want to live?

Answer

Kids never really have the right to make a choice as to where they want to live. Either party may make a Motion to have the minor child testify. The court decides whether to do this on a case-by-case basis, and will most likely want to meet with the child to determine whether or not to allow the child to testify as to a preference of which parent to live with.

Even if the child is allowed to state a preference, that is only one of many factors that the court will consider in making a determination of where a child should live the majority of the time.
