Question

My sons Dad was charged with a felony of felon in possession of a firearm. He passed lie detector test and the police found no physical evidence of a firearm or any gunshell casings. they arrested him almost 8 months ago, he has been incarcerated since 10-31-13, the last 3 public defenders he was given withdrew for personal reasons and there still has been no pre trial or trial date set on the courts calender. He wants to request a speedy trial but cant until he has an attorney that isnt withdrawing for one reason or another. Is there anything that he can do to get out of jail until the state can figure out what they are doing and get him a trial date? it seems that this is all unnecessary delays

Answer

When multiple public defenders withdraw for personal reasons, it is sometimes because the client is threatening them or otherwise not cooperating. Hire a private attorney for your son if you want this to stop and see the case tried. However, even private lawyers will need to withdraw when the client's behavior towards them creates a conflict of interest such as fear for their own safety.
