Question

A co-worker was found (at interview 6 years ago) to be in a sham marriage. They denied his application but he has been living here everything since, AND working, with a social security number. He only first came here on a visitor visa so how does he get a ssn and why wasn't he deported after being caught perpetrating marriage fraud?



Answer

Not sure what your concern is regarding this co-worker, however, if his case was denied, it should have been transferred to the Trial Attorney's office for Removal. I cannot tell you why he was not sent to Immigration Court, other than his case may not be a priority with the new, more lenient Removal procedures.
