I got into a car accident last month. I caused the accident, but it happened while I didn't have my driver's license on my person. This is my first offense ever in my life. I was cited with failure to control my car and 435.01(a) License required to operate. How serious is this? May I going to jail or will I be able to merely pay court costs and fines?
Answer
You are charged with misdemeanors, so you'll likely have to pay a fine and court costs, which usually amount to several hundred dollars. Your insurance will go up due to being at fault in the collision. Your insurance rates will be elevated for several years - most likely at least three. Depending on the severity of the collision, you may be sued by the other driver(s) involved, should they not be able to reach an out of court settlement with your insurance company. If you are sued, most insurance policies provide that your insurance company will provide you with an attorney who will represent you (usually with little to any involvement on your part). Best of luck in the future.
