Question

I have a two month son. His father and I have recently broken up. We were never married, but we lived together. I would like to leave the state, but he and his parents won't allow it. I'm afraid he'll get custody of our son, whom he doesn't even take care of. What are my options?

Answer

You can leave anytime with your son irrespective of what the alleged

father and his parents may want. That's right, I said alleged (assuming that

not even paternity has been legally established) and that until that

happens, this putative father would not even have legal standing to petition

for custody of your son (or anything else for that matter relating to your son).
