A will was established for and by my parents in Florida, they now reside in Illinois.
We the sibilings of the parents are wondering if the will is still active in Illinois where they
reside or is it null and void?
Answer
A will prepared in another state is valid. It would be filed in Illinois and probate would proceed in Illinois, if necessary, but any interpretation questions would be resolved applying Florida law. The scope of this space does not afford an opportunity to adequately advise you. The response provided is intended to be informative, but not final. You are advised to arrange a consultation at which all facts and documents can be explored and terms for representation agreed. An attorney-client relationship must be formally established.
