Answer

It's not more than a couple days. If terminate, most employers provide all earned but unpaid wages at the time of termination just to be safe.

Answer

If you are an employee then you have a claim for wage penalties.

Answer

The time has long passed. Go file a claim with the local Labor Commissioner.

Answer

Labor Code section 201 covers this. It says "If an employer discharges an employee, the wages earned and unpaid at the time of discharge are due and payable immediately." The law goes on to make an exception giving employers in seasonal agricultural-processing and fish processing industries a few days to make calculations when an entire group of employees is let go for the season; also, extra time is allowed for calculating certain fringe benefit amounts that may be due. Nevertheless, the basic law is that the employer hands you your final paycheck when you walk out the door for the last time after getting the pink slip.
