Question

i am a non custodial parent (dad) of a 13 year old daughter. currently abide by the texas standard possession order for texas and live under 100 miles away. the order also does state the visitation for parents who live over 100 miles away as well. I am wanting to move from houston to san antonio just under 300 miles away. Do i have to tell the court or get a modification to the order even though it states the visitaition of over 100 miles away. will I be in contempt of court if i move without permission from the court? everything seems to be covered in the standard visition order.

Answer

You will have to read your divorce decree carefully (or have an attorney review it) to see what, if any, geographical restrictions were included in your decree. The standard possession order language is typically "cut-and-pasted" in most divorce decrees, but another paragraph may contain a geographic restriction - a typical one that is often seen is a restriction to the same county or surrounding, contiguous counties.
