I recently submitted a deposit to be able to have choice on a dog from a breeder. When the first litter of dogs came out I chose a puppy that I wanted, but the breeder declined my selection and offered me another puppy. I refused and decided to wait until the second litter, and the same thing happened. Frustrated, I decided to go with another breeder and asked for my deposit back. The breeder then offered me the dog after I said that I was going elsewhere. When I responded and said that it was too late, the breeder rudely said that I would not be getting my deposit back. There was no signed contract prior saying that the deposit was non refundable. So, the question is can I get my deposit back for the dog that I never received?



Answer

Send a written notice to this recalcitrant breeder, demanding the

return of your deposit funds, and, if s/he refuses, consider filing a case

with the local small claims court(would be my advice).
