and stipulated judgment stated as "40months from the date of execution of the herein

stipulated judgment" is that 40months from the date when both of us signed? or is it

the date when it was finalized and recorded by the court?

As I told you before, it is not by date. The court will invariably interpret this to mean 40 monthly payments. When you have paid 40 monthly payments you are done, and not before.
