What is the current MA law on hooka (smoking) lounge? Can I serve food and bevereges?



Answer

There is no law authorizing the creation of a Hooka Lounge. The only current use of marijuana is for medical purposes and as such it is not intended to be used in a smoking lounge.

The best you can do is open a bakery or restaurant next to one of 35 licensed retail outlets in the Commonwealth.

If you want to open a cigar club or a smoking club, you will need a special permit to obtain one and I sincerely doubt you can get one in Boston as someone tried years ago and could not get one. Moreover, the Club will not be open to the public at large but will need to have criteria for membership which would be included to the proposal to obtain permission for one. You would also have to seek exception under the state law regulating smoking in buildings.

In fact is becoming difficult to find an apartment or a condo that will permit smoking inside the units.
