You may have a cause of action for a defective sidewalk against either a private property owner or the City of New York, depending on exactly where the accident occurred. A thorough inspection of the location is necessary. It is also important, though not absolutely necessary, that an accident report was filed (this can also be accomplished if EMS was called to the scene as they would document the date and location of the pickup).
