I fell on a sidewalk in New York City and broke my foot. I fell after stepping into a "sidewalk pothole". Can I sue the city?

Question

I fell on a sidewalk in New York City and broke my foot. I fell after stepping into a "sidewalk pothole". Can I sue the city?

Answer

Suing the CONY would hinge on a few factors: did they have notice of the pothole (usually determined by a Big Apple map search) and when the accident happened. Please feel free to contact my office to further discuss this matter.

Answer

Your case might be against the property owner. Would need to see photos of the accident scene and discuss the details. VTY, ME Zuller

Answer

I am really sorry to hear about your accident. You may have a cause of action for a defective sidewalk against either a private property owner or the City of New York, depending on exactly where the accident occurred. A thorough inspection of the location is necessary. It is also important, though not absolutely necessary, that an accident report was filed (this can also be accomplished if EMS was called to the scene as they would document the date and location of the pickup). After liability is determined we would focus on the injuries you sustained and its impact on your customary and normal daily activities. There are some important steps that need to be taken in order to protect your rights. Please do not discuss your case with anyone before consulting an attorney. If the case is indeed going to be against the City you MUST file a Notice of Claim with the City within 90 days of the occurrence. I would be most interested in discussing your options with you and help you along the way with this process. Please give me a call (347) 702-4133 or email me at [email protected]/* */ for an absolutely FREE consultation.

Answer

The case is likely against the abutting property owner, which is an easier case than against the City. If you do need the City you need to serve a Notice of Claim within 90 days of the accident. Feel free to contact me.
