What kind of damage can be done to a mistress being sued by the wife for alienation of affection? Can the mistress family be made to testify?

Question

What kind of damage can be done to a mistress being sued by the wife for alienation of affection? Can the mistress family be made to testify?

Answer

If the wife has sued the other woman, the other woman needs a lawyer NOW. Of course the other woman can be made to testify. She is the party being sued. If she does nothing, a money judgment will be entered against her. Whether she can pay it or not is a separate question. While there is no wage garnishment, the wronged wife can try and levy on the mistress' bank account, get a lien on any real property that the mistress owns or try and have the sheriff seize and sell any non-exempt property.
