My mother died intestate,there was no probate. I now find there is $8000 in a bank account about to go to the state. Can I, as her only living heir,get that money from the bank before it goes to the states "unclaimed funds"??

Contact an estate law attorney as soon as possible. It is not really my area but a decent estate attorney should be able to assist you.
