You might be able to get the other party to a lower settlement amount. However, I must say that the fact she has paid consistently for 17 years is a pretty amazing thing, because I imagine about 95% of people would not be able to do that without violating their probation. Other than a a settlement since the judge ordered that specific amount, there's little you can do now.

It has been my experince that person in your position get better deal or are better able to defend themself when they have legal counsel. If you can prove that you had insurance, then the prosecutor may be willing to dismiss that charge. But, if they want to pursue the speeding in a school zone, you could face a significant hit on your license and yoru insurance premiums coudl go way up.

You will need to read your agreement. The provisions contained in it will control. You can certainly switch agents but will have to do so according to the agreement.

There is no such thing as equal trustees in an estate. you might be an equal beneficiary under a will, or there is a trust that designates trustees...Not enough infirmation here for clarity.

Based on California law you can file a petition. The court first would try and use your mother's wishes on who should be a conservator, if not the court has an order of preference but it is always in the best interest of your mother.

There are alternatives to conservatorship. Conservatorship is when the individual is incomptent to take care of themselves. Representative payee status at Social Security and medical power of attorneys are appropriatevif the only income is Social Security.

Remember all of her money still belongs to her to be used for her care.

Anyone with a potential interest in the assets of the estate can file for probate at any time. Your mother might get chided by the court for not having done so, but the title to the property can not change without a probate occurring. The probate is filed where your grandmother lived. You should read some of the Nolo Press books on probate, estates, etc. as they are in understandable language.

unfortunately the creditor can legally come after you alone, or both you and the principal borrower (your friend), as you both are jointly and severally liable. Your best option here is to either pay the entire amount back in full and then pursue your friend for reimbursement, or see if you can negotiate settlement terms with the creditor to reduce your liability, etc....you may want to retain legal counsel to immediately help you with this unfortunate situation.

I would need a lot of details. Normally, when the first forecloses, the second becomes a "frozen" or "sold out" junior lienholder. The second may then sue the borrower directly on the promissory note, for the full balance of the unpaid debt. The second cannot sue if it was also the holder of the first deed of trust (which you are referring to as a mortgage) or if the second would come within the ambit of the purchase money mortgage protection.

There is also a statute of limitations on an action on the promissory note. To me, their offer seems a bit low, and makes me think they feel they cannot win a lawsuit for the debt. I suggest having a competent real estate attorney familiar with anti-deficiency law review the matter before making the decision to accept their offer.

In the circumstances, it is probably a good idea to have a discussion with a lawyer before rejecting the offer, assuming you are in any position to pay the 10%. Even if you have already decided to pay the 10%, I'd recommend having a lawyer verify that this is in full settlement of the indebtedness.

In Ohio, what the IRS considers "income" and what a local judge considers income are two different things. For instance, a retired billionaire may have made no money in the past three years because he quit his job. But that does not mean that he is indigent to the point that a judge would allow an attorney to be appointed by the court free of charge to represent him.

While I would not compare your brother to a retired billionaire, the point is the same, "Indigent" is something different than someone who does not have a taxable income.

Up to you to tell them to add your wife to title and loan and put through the disability payment as added income; while they technically don't have to do this I don't think they'll want to give up a sale. But if you don't I'll bet the paperwork says they can recall the deal if you're unable to restructure it. AND they may be able to charge you for the reasonable use of the vehicle since you drove it off the lot. Almost none of us really reads through the paperwork they throw at us at a car purchase, but it's time to do so if you're concerned about having to put up more cash into the deal - maybe there is something that requires them to add her/her $...or gives you the option to do so.

The court administrator's office usually gets around to deeming these misdemeanors within about six months. You can call the court administrator's office and nicely ask if they can do yours sooner. Regarding removing it from your record all together, you should consult with a lawyer about a possible expungement. Since it is now 3 years later it would be difficult to sue the listing realtor unless you can prove that she purposely made that error. Even then you might be dealing with a statute of limitations.

Apparently, at the time, you did consider it a 3rd bedroom, although it lacked a closet. Im considering the Navy in which she would become primary parent to the children. My base pay would only be 1467.60 per month. If you want to open a shop, you can check local ordinances, but that will depend on EXACTLY what you're doing (assembly, retail, or ??). In a divorce proceedings and, in particular, the equitable distribution of the property aspect, will this loan be subtracted from the common property value before the division is set forth or taken out of my share after the property distribution is made? Could this act be rendered as encumbering a common property and, if yes, are there any regulations pertaining to such matters? Would I be required to present the court with the loan's allocation or a detailed schedule of the sums spent or would the entire amount be subtracted off the home's sale price? Thank you.

First of all, I question the wisdom of borrowing money to attempt to resolve dire financial circumstances. In general, it doesn't work. That being said, if you are borrowing money with the thought that you will be able to put a lien on jointly owned property, the lender will be asking your spouse to join in that loan to properly secure the loan. If it is not a lien on joint property, then the debt will be unsecured unless attached to property that you own alone. And in any divorce proceeding, your spouse's lawyer will absolutely attempt to attach the loan to you alone and make it your sole obligation. You will be seriously complicating your divorce proceedings.

Keep in mind that this answer is given based on the scanty information you have provided. My answer may change based on other information. The legal issue is whether the payoff of some of your bills by your former fiance was a gift to you or a loan.

If the former, then there's no need to pay him back; if the latter then yes, you would need to pay him back as you would with any other loan.

However, the return of your diamonds is really a separate issue. If they're yours, then he should return them immediately to you and not attempt to "hold them hostage", so to speak, until you can repay him for bills which he supposedly paid in your behalf and for which you may not even be legally responsible(if these payoffs were in fact intended as gifts).

In order to expedite the return of your diamonds, you could file what's called a warrant in detinue in the local general district court for the

return of your property. (I suspect that by the time he's served with papers by the local sheriff's deputy, you'll have your diamonds back.)

If the judge ordered a child custody evaluation - you should concentrate you efforts on the evaluator. Criminal records, letters from people who know her drug habit, school teachers, school records etc presented to the evaluator in a timely fashion are important. You should also be prepared to discuss the situation that led to the judge giving the mother sole legal custody - and what has changed with you since then, that make the order inappropriate now. Declarations on your behalf stating how the situation has changed since the judge granted her sole custody could help a lot. The evaluator then could ask if she were willing to take a drug test; a negative response from her could lead to an evaluator's recommendation for a switch in custody.

Drug testing results are usually available much faster than the time it typically takes to complete a full custody evaluation. The financial advisor dealing with the account told me that part of the money was in an annuity and the other part had been distributed, taxes had been paid on it, and it was placed in a separate account. Following that information, I paid taxes on the portion that was left in the annuity under the impression that the rest of the money was fine and didn't need to be included on the tax return considering that it wasn't (supposedly) invested and I wasn't receiving it as a payment for services rendered. The parent signing up the child for the classes or the sport appears on the outside to be the good parent and only caring for the child's wants and extra activities. However, they are really manipulating the situation and I personally feel the court needs to be made aware of it. However, it is unlikely you will get anywhere without an attorney.

You need to go back in to court with a motion to compel. The other thing is you need to stop letting your ex control the situation.

You are just documenting the prior transaction by signing the affidavit and getting a new title for the vehicle. That would not make you liable for his debts assuming that you can demonstrate that you paid for the vehicle prior to his death. On the other hand if the vehicle was part of his estate, it would be subject to being sold and the money used to paid estate expenses. Children in Colorado are not personally liable for the expenses of their parents. You should not promise to pay any of his debts without legal advice. You should not use his assets to pay his debts without legal advice because there is a strict priority of expenses and debts that must be paid with estate assets.

My understanding is even if the recipient of the ideas (contest runner) wishes to claim that the surrender of ownership was one of the terms for entering the competition, that this is not enough to loose your rights as a creator without the company following through with some form of compensation being given in exchange for that specific creation. "Ideas" are not, in and of themselves, protectable by copyright. This bring said, so long as you submitted something tangible, you own the copyright in that tangible thing unless you agreed to lose or license any of your exclusive rights associated with the copyright.

It is important to read the fine print with these things, but I would say that most likely, if the contest runners took your writing/drawing and used it without your permission, you would very likely have a claim.

Your understanding is not correct. If the terms addressed the issue and by virtue of your submission the contest org assumed rights in your creative work, then the consideration for this transaction was your opportunity to participate.

This is commonplace in a great many circumstances, such as writing competitions, etc. This may not mean that you have forfeited all your rights here, only that you granted the contest org a license to exploit that work.

I suggest that if you are taking this very seriously, you have an IP lawyer review the terms and offer a proper analysis so you are clear on your rights. There may certainly be more to consider than what was disclosed here.

Yes of course the State can legally file charges at a later time. It is entirely possible that the State did not have pending charges at the time the question was asked. If the additional charges were not filed upon as part of a plea bargain, or were perhaps part of the original case but simply never filed upon, then they should not be filed and can likely be dismissed.

Less than four witnesses should be fine. In fact, Alaska statutes make no mention of a child care power of attorney. It seems to be just something lawyers have come up with to address the situation. So fewer witnesses, or actually no witnesses would be just as "legal" as the form you found.
