She liked to go to the movies (it had to be interpreted for her), and other activities that you would not dream she would enjoy. Once my mother entered her in a chili judging contest. She was the perfect judge. She really enjoyed the experience. The most important thing to think about is what the person really likes to do, and then figure out how to make their disability not be an issue for them while they are enjoying their activity. The "Order of Expunction" was granted by the Court in August of 2009. Unfortunately, my attorney's paralegal did not ask for a copy of the Court Order and, therefore, I cannot get a copy anymore. The DWI is no longer in the records of my local county court (Bexar County) and I am in the process of getting an FBI background check on myself. HERE'S MY QUESTION: Can I file another Petition For Expunction on this same DWI, to ensure that it was done properly? My attorney's paralegal was supposed to include another dismissed case of mine--Criminal Mischief--in the original expunction motion, but did not do so in 2009. I just recently found this out (I will spare you the excuse that she gave me). Thus, I am now in the process of filing a petition to expunge the Criminal Mischief arrest, and I want to know if I can also include the DWI arrest with it--so I can have a copy of the Court Order for both cases? As you can imagine, I am now very concerned with the work that my lawyer and his paralegal did for me, which is why I want to add the DWI to the expunction order that I will be submitting soon. Why don't you have your fingerprints taken by the local police and then send them to the FBI for a background check. (Many jobs, etc., require this and the FBI does it all the time.) If there are no records of that DWI, then I believe that you are safe not worrying about it. (Moreover, if someone were to find that in the future, you could always tell them that the case dismissed and was expunged and that it was never supposed to show on your record. It is doubtful that it would affect you in that circumstance.)

As far as the original DWI, the civil court that handled the expunction should have the file with all of the records OR your lawyer picked up the file. If not, then you can pick up the file with proper identification if there was no destruction order in the final order. (At least that is the way they do it in Harris County - but there is a standing 1 year from final order destruction order.)

The court loses jurisdiction over the divorce 30 days after the judge signs the final decree of divorce. The husband cannot go back to court on this case. Even if he tries, the judge does not have any jurisdiction over the divorce any longer.

Additionally, in Texas, child support for children ends at the time the child turns 18 or graduates from high school. So expecting her to contribute to a grown child's college education might be nice but no court can order her to do so under Texas law.

He was married to wife #2 in Indiana (mothered 3 of his children) and filed for divorce 1989 (not 100% sure that was the year) then 'remarried' 2xs after. 10 months before his passing he moved out of the home that he & wife #4 shared. He had a will stating that all his assets were to go to his 5 children (he did not father any children with wife 3&4) but had wife #4 as benefactor on all of his accounts (retirement, life insurance etc..) Well wife #2 filed for a portion of his retirement benefits, turns out that she & father-in-law were never legally divorced. The railroad recognizes wife #2 as his legal spouse and has taken wife #4's name off of his benefits. I'm not 100% sure where a majority of his benefits are, but I do know his total assets amount to approx $3.5million. Before Father-in-law passed he stated that all of his money was in stocks & bonds- I do know that the railroad offered him a lot of stock as part of his retirement, is this counted as his retirement benefits from the railroad or would this be in an investor account? My main question is what options does wife #2 have in making sure that wife #4 does not get anything except the vehicles they shared (both names on title with survivorship listed) . However, the general rule is that he can sue you for the difference between the sales prices and what you had agreed to pay, if the actual sales price is less. Yes, she has an absolute right to a jury trial. The jury fee is $30, I think, and she has to pay that to get the jury trial. You will not have to pay the jury fee.

Frankly, a jury trial is her only way to get the conservatorship decision reversed. Unless you have some equally bad facts on your side of the balance sheet, I would expect the jury to do about the same thing the trial judge did.

In divorce cases, there is no "win/lose" in a legal sense, so you won't be able to recover any legal fees from her.

You can only have her wages garnished if you obtain a judgment against her. To do that, you would have to get the payments on the obligations caught up yourself and make demand that she pay you. If she doesn't, you would then have to take her back to court on what is called and Order to Show Cause where you would ask the court to hold her in contempt for her failure to maintain the payments and to ask that the court award you a judgment for the amounts you have paid. You would also have the right to request that she pay your attorney's fees in the event you have to take these steps. The attorney's fees award would be added to the judgment.

Parents are always free to make modifications or agreements. Child support deviations must be reasonable but are most often agreed to by the court. Make sure you have a court order (signed by the judge) for the new amount or you will be in contempt. I have seen these informal agreements end up with a person in jail when one side denies the agreement.

A discharged bankruptcy is not ever a barrier to purchasing a house, per se. It is, generally, a barrier to getting a loan. There is no fixed number of months or years. Your ability to buy a house, using a loan, will depend upon many things, including your current income, the size of down-payment you can make, your other debts, your job stability, the reasons for the BK7, perhaps on whether you can get a co-signer or guarantor, whether you insist on the lowest possible interest rate or are willing and able to pay a risk premium, and on and on. Generally speaking, it'll still be pretty tough to get a loan after 20 months; 72 would be easier, but there are so many factors involved I would never say categorically that you have to wait until the 7 drops off your credit report. Maybe seller financing would work. Talk to a few loan brokers and see what they think.

After the 3 day notice and you do not vacate they then have to proceed with an eviction. When you receive the eviction papers there is a time period to answer it and to pay your rent into the registry of the court house. I suggest you do so and stay put. The court will give you a hearing date and at that time tell the judge of the agreement. the judge will probably sanction them and allow you to stay until the accepted period stated in the notice.

The buyer defaulted on the mortgage and the trust took back the property. There are 3 trustees, all daughters. One of the trustees has done many illegal things (ie insisting on renting the property instead of reselling, tying the tenant into a three year lease for $1200, commingling trust money with her own money and the list goes on. Now this trustee has manipulated our 85 yr old mother into believing only what she is telling her and has convinced mon into contesting the trust and saying she wants her property back. She will then give it only to that daughter and that trustees son and excluding her other two daughters and other two grandchildren. What are her chances after 9 years to get her property back? The trust states that 2 trustees are needed to bind the trust and we have already resold the property to the tenant that had the 3 year lease.

First, I would have to see the Trust to comment on it, but if it is in an irrevocable trust at this stage due to your father's death, then it cannot be dissolved unless there is a provision that allows your mother to do that.

Second, The three trustees should demand an accounting and require all payments be made to the Trust bank accounts and that the trust bank accounts should require two signatures on all checks.

Third, I would take a copy of the Trust and all your information to an attorney as soon as possible so your third sister can be stopped from trying to break the Trust as soon as possible.

I would strongly suggest you get ahead of this, assuming that there are real assets in this trust.

Our insurance company paid for the repairs of both cars. Now the other party has sued us for over $1M. Our car insurance limit is $100K. You had better worry about it. Contact an attorney in your area, or ask your insurance company to refer you to an attorney at their expense.

Don't get freaked out by Mr. Marman. It seems to me his answer is always either "hire a lawyer," or "hire me." First off, your insurance company is required to hire you an attorney. Many larger insurance companies actually have staff attorneys who do nothing but represent insureds. They should have already provided you an attorney since you say they are handling the case.

If you have not been contacted by an attorney to represent you within a week to ten days of submitting the lawsuit to the insurance company, OR at least a week before the answer is due, call me or another attorney immediately so we can help you demand immediate representation from the insurance company.

Second, a $1M case filed two years after the fact is highly suspect and pretty unlikely to have much merit, at least at that value.

Third, your insurance company is obligated to settle the case for policy limits or less if at all possible. If, at any time, they come to believe the facts and law are likely to support a judgment outside of policy limits, they are obligated to notify you and then pay the policy limits. You would then be on your own, but unless and until that happens, there is no reason to hit the panic button. You should, however, keep on the attorney they hire for you to make sure he or she is doing a running analysis of the case value so you don't get surprised by them suddenly paying policy limits and telling you you need to find your own attorney.

Lastly, even if you were not insured at all, there is no reason to go liquidating assets and certainly do NOT transfer assets to kids or relatives. Liquidating assets will just make them more easily accessable in case a judgment is entered against you, and will lose you many exemptions from judgment collections, most notably the automatic homestead exemption on your personal residence. And don't get suckered by anyone who tells you you must record a homestead declaration, the homestead exemption is automatic. The declaration only designates which property you consider your homestead. Unless there's some doubt as to which is your home, between the rental and your house, it is a pointless exercis).

As for transferring assets away, that is simply illegal when it is for the purpose of trying to put them out of reach of a judgment or other creditor. If you file for bankruptcy, the bankruptcy trustee will go seize those assets and bring them back into your bankruptcy estate as voidable preferences. And if you don't file for bankruptcy, they will be illegal under state fraudulent conveyance laws, subjecting you and the recipients to attorneys fees on top of having to undo the transfers.

So the thing to do is sit tight, work with your insurance company and the lawyer they give you. Keep on them to actively defend your case. Then if, and only if, it looks like the plaintiff really could recover more than the policy limits if the case goes to trial, and they refuse to settle for policy limits, you should talk to a bankruptcy attorney.

I have dealt with these issues before. Even though you and the insurance company is supposed to have the same interest, defeating the lawsuit paying as little as possible, that is not always the case. This is because, if the insurance company offers to settle for $90,000, and the plaintiff says "no", the insurance company has only $10,000 to lose by going to trial if $100k is their maximum payout even if Plaintiff wins a million dollar judgement. If that would happen, the insurance company may be on the hook for 100k, and you may be on the hook for the rest. "Cumis counsel" is an attorney hired by the insurance company to protect your interests in the case of such a conflict of interest. Who determined it to be your wife's fault? Not a court? Sounds like it may have been a police officer who may not have known all the facts, or an insurance company, many of which do not bother to investigate properly. When the insurance company paid for the car repairs, they should have obtained a release from the other party in exchange for the payment, like a settlement. This should be binding on the other party, but I would need to look at it. I would also like to know the facts to make sure you are being properly represented. The other issues we can discuss. I suspect there may be other weaknesses to their case, as well.

You should definitely reassess child support. Judges have broad discretion for child support for children 18 plus. And the new Child Support Calculation implemented in 8/03 generally lowered child support payments. You'll have to see what a current calculation would recommend and compare to what you're paying now and factor in the college expenses - and your current financial circumstances. Probably a good investment to at least ask an attorney to run the numbers for you and give you an opinion.

All inspections and negotiation was done and we were just waiting on the back to order an appraisal. Our realtor assured us that it was a done deal so we found a house to rent in a nearby town. After spending a couple thousand dollars on the repair, first months rent, moving expens es, etc. we were told a week before closing that the bank lender was fired and their loan might not go through now. Here we are stick in a one year lease, out a lot of money, and now we might have to pay rent and a mortgage which will be impossible. What are our rights here and do we have any options? You need to have your attorney review your contract. Generally, the terms governing short sale will allow you to back out after a set period and receive a refund of your earnest money if the short sale approval does not come through. There should also be a provision in the contract governing the condition of the property. Speak with your closing attorney rather than posting here. I imagine you will conclude it is time to move on to a new transaction.

He has been making payments and keeping up the bills on the house. Here is his question: If the house doesn't not sell, he would like to buy out his sister (minus any debts owned and money he has spent) and keep the house.

If that happens, how does the debts filed get taken care of? Who is then responsible for it?

He can't keep the assets and not pay the bills. He either needs to sell the house or find a way to put enough money in the estate to cover the bills.

What you are asking involves major litigation. First you have to open a probate estate for the purpose of collecting assets (insurance proceeds). Then you would file a Citation to collect the proceeds from your sister and probably have to prove that she used undue influence to persuade her mother to appoint her as the beneficiary of all three policies. It is up to you to decide if this is practical considering the burden of the cost of litigation over the benefit of recovering expenses incurred by your mother's care.

If your son is mentally disabled he is not competent to sign a power of attorney. You would need to apply for a conservatorship over him.

Technically an incompetent person cannot sign a power of attorney. However, if he understands that he is giving you permission to obtain confidential information from the bank then an authorization from him to do that is all you need. Otherwise, if he does not understand what he is signing or if he understands but will not sign it then there is nothing you can do except start an expensive court case to have you appointed as his conservator. If he has no money or property that can be taken from the creditors then it might not make any difference whether or not he pays the bills.

I've decided to go pro se due to the fact that my public pretender could care less about my well being, and due to my countys political corruption the judge, public defenders and prosecuters, are all "in bed together", the only thing they care about is their 99.9% conviction rate and couldn't care less about right and wrong.
