Well, i was off for three days i come to work and she walks in threw her purse and hit her pen twice in front of me loudly. So i thought something was wrong again. As i was walking by all i said was "whats wrong" she started yelling spit on me and was screaming at me very loud. She was using profanity and then she communicated threats of physical violence.As this was going on i was in shock another coworker was passing by and heard she had threatened physical violence to me. She said she was "going to hit me in the f..... face". I said "really your going to hit me in the face" she said yes. I told her i was going to report her right now. As i was walking away she said "watch your back" i said nothing. After all this i was told to stay home for 3 days then they called me in to terminate me. They did not give me a reason why i was being let go after 6 years without any problems ever. Then as i was walking out they gave me the other girls termination paper with all her information.

It's not a matter of his right. He has a duty and responsibility, legally, as executor, to make sure that expenses and taxes and costs are paid. After that is done, the court gives him permission to disburse the remainder. However, heirs can request the court to allow partial distribution, before all costs and taxes are paid, if sufficient funds are left with the executor to pay the estate obligations. Therefore, you need to inquire of the estate attorney as to whether there is a possibility of a partial preliminary distribution.

Not in Pennsylvania but they can execute on your bank accounts so if you have direct deposit you may want to stop it now. As far as Debt settlement companies a lot of my clients have complained about them and one client who was in my office yesterday was very upset that she was making payments upon credit card bills where collection was probably barred by the statute of limitations. There is an argument that such partial payment restarts the statute of limitations and some arbitration panels and/or judges may accept that argument. Do not ignore the lawsuits. At least file an answer or have an attorney file one for you.

Actually our property line ends at the end of the easement, so technically they are not going over our property just the easement, but the curbing that was on the edge of the easement where they cut space out to put their gate in has now eroded all of the asphalt in front of our gate and there has been no maintenance agreement or anything. It just doesn't seem like it's legal considering she could give herself an easement on her own property to her back house. Do we really have no legal standing to deny her access to the private road easement we have in our deed from when the property was originally subdivided?

As I told you when you first posted this question, unless the grant of easement was exclusive, the owner of the house in front of your property had every legal right to grant additional easements in the same location and you have no legal standing of any kind to object. What you do have a right to object to and demand correction or sue for is the damage to your curb and asphalt. The one other piece of silver lining to this is that all legal users of an easement must share in the cost of repairs and maintenance, but the owners of the property on which the easement exists have NO obligation for maintenance or repair, so whenever the driveway needs resurfacing or other repair, the owners of the new house will have to share that expense with you, whereas before it would have been 100% yours.

I agree. You don't have an exclusive right to use the easement. The property owner, not the easement owner, can decide who else may drive over the easement. However, all users of a shared easement must contribute to its maintenance in proportion to their useage. Further, if a particular maintenance issue is attributable to the fault of user X, then user X is liable for the full cost of that particular repair.

You have a right to change attorneys at any time. I am assuming that your current attorneys filed a lawsuit on your behalf already in this case, given the fact that three years have passed already. Assuming a lawsuit was filed, your new attorneys will need to arrange with your current attorneys to sign a Stipulation agreeing that your new attorneys can be substituted for your current attorneys, and the Court will have to sign an Order to that affect. Understand, that if you signed a Retainer Agreement with your current attorneys, probably on a contingency fee basis, that your changing attorneys, unless for cause, will result in your current attorneys being able to maintain a lien and assert a claim for attorney fees and costs from your eventual settlement or verdict. That is an issue to discuss with any new attorneys who you may retain in your case.

This "sounds" like you are not in a foreclosure but instead doing a short sale or deed in lieu arrangement where the lender is willing to waive deficiency if it does not have to foreclose. If so this is only one aspect of those kinds of arrangements. For example, in a short sale situation if there are unpaid property taxes that the lender will not pay, then you may have to deal with this situation directly with the buyer, because if unpaid taxes show up on the title commitment and the lender will not satisfy them for you, you may still wind up having to come to closing with cash to cover them if the contract does not protect you or the deal could still fall apart. So you are still best advised to have an attorney involved to help make sure that you are protected.

I recently hired an attorney and gave her a $3500 retainer for my 17 yr old son's infant's custody case. Within 6 weeks, the mother of the infant moved in with us and we asked the attorney to drop the case and refund that portion of the retainer which we didn't use (we never even went to court). According to her billing, she would owe us about $2000. After ignoring several phone calls, she now says the retainer is not refundable and her secratary said that she's in a ''bad'' mood and maybe she'll think about refunding some portion of the money in a couple of weeks. We have very limited contact with attorneys. Is this normal. Unfortunately, I cannot find the retainer letter we signed.

The PA Supreme Court Disciplinary Board enforces this requirement.
In addition attorneys are required to maintain an escrow account for moneies received and not yet earned.

Non-refundable retainers are not uncommon and most of the time that an attorney expends upon a case is right at the beginning. That reflects what her billing shows of the $1,500.00 expended within six weeks. It may be that the retainer agreement provides for a non-refundable retainer but that she is considering refunding a portion of it anyway. If it was a non-refundable retainer the question would be whether or not the retainer was clearly excessive. I don't handle custody cases and I'm not sure whether or not that type of retainer in a custody dispute would be considered "clearly excessive." But you should also know that since the case appears to have been filed, the attorney cannot just "drop" the case and that she will have to expend some further time to stop the court machinery that she set in motion by filing the case. It could be that she is just holding the balance to compensate her for her time while she does this but there is no requirement that a non-refundable retainer has to be deposited in the attorney's escrow account. But attorneys do tend to err on the side of caution and frequently place such retainers in their IOLTA or trust accounts.
In any dispute with a professional over fees, it is always best to submit the question to arbitration. If the attorney and you cannot agree on the amount that you feel should be refunded, it is best to resolve it with the Fee Dispute Committee of your County Bar Association.

In the meantime you can stay in the house and not pay mortgage, taxes etc
After you are served with foreclosure papers, you should contact a lawyer immediately. He can either stop the foreclosure action, delay it, or reach a settlement with the mortgage company.
Another option would be to file a chapter 13 bankruptcy which would allow you 60 months to get caught up, if y ou qualify. This also delays the foreclosure.

The starter in your vehicle works at a very low speed. It is only used to crank the engine enough to help it run from a standstill. The car's normal idle speed is +/- 700 - 800rpm. Even at this low speed it would be too fast for the starter to handle. Furthermore, keeping the starter engaged would cause unnecessary wear on the starter parts, as well as the flywheel gear (ringgear). It would also be another mechanical device the engine has to turn, thus decreasing the efficiency.

Since the woman is in florida It would make sense to file an action there. I would file in the county where she resides. Perhaps they have a small claims court in that case i would file in the one with jurisdiction where she resides. I trust you have the paperwork to establish you lent her the money.

You do not "contact" the county in Florida. You will probably need a lawyer unless the forms are online to file a small claims complaint. You file in Florida in the county where the woman resides. After she is served, unless a default judgment is entered because she either admits or claim or fails to answer, you will have to travel to Florida and attend the hearing. Another benefit of filing in Florida is: (a) if she has assets, that is where they are located; and (b) Florida allows wage garnishment if you get a judgment and she works. There is no wage garnishment in PA for a debt of this type. Also, if she has no contacts with Pennsylvania, Pennsylvania might not have jurisdiction over her if you tried to sue her there. However, even if suit could be brought in PA, you would not be able to sue in small claims. Further, if you sued and recovered a judgment, it would not be enforceable in PA if she had no assets there and you would have to transfer it to Florida or any other state where she had assets. All of this dictates to you suing where she lives.
I suggest that you try re-posting your question and directing it to Florida collection attorneys as they may be able to give you more specific advice geared to Florida law.

I am not sure I understand your situation very well. There are only temporary orders in place, yet your kids are grown, with kids of their own? Did the case never progress to a final order? Is the AG involved? You might be able to negotiate your way out of some of this, but the interest, if computed correctly, is legal. My mother was repeated transferred between their general ward and ICU for suctions of secretions and intubations due to their malpractice and neglects which resulted in my mother's long stay in the ICU for more than two months.

You will have to try and subpoena the records, but the conservator holds the legal authority to object to the subpoena since your mother is still living. If the bills have been paid, then they could not be the cause of your ex-husband's bad credit.
The real issue is what do you want to do about it? Who is "everyone" that he is telling? Have you suffered damages (damage to your business relationship or reputation in the community) because of this? He has obviously gone downhill since the divorce. He can say what he wants. If people really know you they will know that you are not the kind of person and will see that your ex-husband is just a bitter vindictive man. I think I would let this die and not make a fuss.
I suppose that if you want to try and put some fear into him, you could pay a local attorney to send him a nasty letter advising that the statements regarding you ruining his credit are untrue and demand that he either provide you with evidence or retract the false statements. The problem is he might become really unhinged mentally that he could do real harm. You do not want to make a bad situation worse.
This is just my personal opinion - you are welcome to seek out another. You know best what you are dealing with and if you know a lawyer who will send this letter then go ahead. I just don't think I would make an actual court case over it.

You did not say how long ago this happened, but hopefully, it was fairly recently. The more recent, the better. What you need to do is start looking for a personal injury attorney who is local to your area. Usually, they will at least give you a free consultation to get the basic facts of your case and then tell you what they think they can do.
It is important to start right away so that they can move quickly to talk to witnesses, and file a claim with the store or at least write them a demand letter in regard to your needs. From there, it is possible a suit will be filed to keep things moving, or the store will quickly come to a negotiated settlement with you. First off, do not form single member llc, worthless in protecting anything. A trust on its own or as the other member of the llc may be the way to go, but you may have issues, as you have 2 judgments and any transfers could be seen as fraudulent in light of the existing judgments. You may want to negotiate settlements with two credit card judgment holders before forming the business. I would recommend contacting an asset protection attorney and a debt defense attorney to discuss your options in greater detail. Remember, just because they have not tried to seize your truck or boat now does not mean once the last payment is made they won't attempt it.

If your wife thinks your mother is unable to manage her affairs, she has to file a petition for guardianship and attack the validity of the power of attorney on the basis that Mom was not competent when she signed it. You will need to find a physician who is willing to examine Mom and will sign the required form for the court.

Depending on several factors and the way it is presented to the court, you could try to get the restitution order modified to "restitution per civil judgement.". But if you attempt this on your own and you are not successful, you probably can't attempt it again for at least another year or more. However, they sued me and served me the paperwork about two months ago but on the lawsuit, they had a different online review that I did not write. I asked my attorney, "Well, can't we just stall until the statue of limitations runs out on the post they have proof (they have my IP) of that I posted?" She said that would not matter because all they would have to do is amend or revise the current lawsuit to add that information to it. I say BS. Is she right?
Reason why another negative review is on the lawsuit. They originally filed the lawsuit many months ago listing 'John Does' as the defendants, they did this while they gathered the IP's of who posted the negative reviews. None of which were me and they are unable find them, the person used a proxy to hide their IP or something. I came along a few weeks later and found the negative review and copied and pasted it to ripoff report but didn't hide my IP. So once they found my IP, they named me in the lawsuit they had already filed which does not list the actual post that I posted.
Technically, the post I made is not on their lawsuit and the statue of limitations is running out on them in two weeks but my attorney says that it doesn't matter.

Your attorney is right and you are wrong. The statute of limitations has to do with filing a complaint against the defendant, not on a particular post. The complaint can always be amended and can be amended to conform to proof at trial. If you keep up with your strategy, you will go a long way to proving your opponent's case against you.

I really hate to be the bearer of bad news, but this may not be over. You will not be able to change your girls' last names that easily. My experience has been that even in situations such as you describe, the Courts are reluctant to terminate a parent's right without allowing him to seek counseling and "rehabilitate" himself. They may even point out that he didn't molest his own daughters, although to me anyone who is willing to cross the line and touch a child would likely not be concerned about being related to the victim. Be prepared. Hopefully he will just drop off the face of the earth, but I don't want you to be blindsided.

If you were already in the process of evicting your tenant and they left before you could do so, I would continue on with the eviction process. I'm not sure why you were trying to evict in the first place (likely not paying rent), but you can also tell the judge that your tenant has now "abandoned" the rental as well. If you don't continue on with the eviction process, your rommate could come back at a later time and say you stole/sold her items, that you are blocking her from her rightful possessory interest in the property, etc. No reason to take that chance. Make it all nice and official, so if your tenant comes back and tries to make a stink about not being let in, you can call the police and show them the eviction notice. No problems.

Not without a lot of potential consequences. The bank could foreclose. They may (but are not obligated to) accept a deed in lieu of foreclosure. They may be able to force you into bankruptcy if it helps them. Your credit rating will be trashed. If they foreclose they may be able to get a "deficiency" judgment which is the amount you owe (which could include costs of restoration if you abandon and the place falls into disrepair, plus taxes, insurance, interest, attorney fees, court costs.....) less whatever the net proceeds may be that they get on a foreclosure sale, and while there are some tax benefits for you at least this year, if could become phantom income if the foreclosure is in a future tax year and then there could be IRS issues. You may be able to work out a "short sale" of the property. You may be entitled to a loan modiciation...... LOTS of open issues here. Time to sit with an attorney, review your particulars, identify options, and act on them.

You would also have to seek exception under the state law regulating smoking in buildings.

There is no direct answer to your question. If you are a normal every day get up and go to work kind of guy the answer is probably yes. But, if your wife is cheating on you because you do mean and evil things to her on a constant basis then the answer might be something different. The best bet for you is to go and sit down and talk with a lawyer there in your town. I know the fella that runs the Legal Aid office and he may be one of the first people to see about your situation if you don't already have a lawyer or know a lawyer. If you do not qualify for legal aid then he can also give you several names of lawyers in your town to go and talk with about getting a divorce and custody of your son. I would suggest you do this quickly while she is out of town. You will still have to serve her but since it appears she has abandoned the family home and the children you can suggest to her that she go & find somewhere else to live since she is now taking up with another man.

The family member who is prepared to buy the property the day of or prior to the day that the bank has demanded payment from me-April 4th. This family member has also asked me when he does make the purchase, if she has not yet vacated the premises will he have the right to pursue her eviction from the property. I have looked at several of the sample 7 day notice to quit forms and more refer to non payment of rent-which is not the case, she is just interfering with my selling the home and preventing the family member who is purchasing it from moving in.
