Question

I hired a lawyer to represent me in a divorce case. My husband was served but we ended up reconciling therefore, we never went to court. I paid my attorney $2,500 up front. Am I entitled to a refund being that I dropped the case?

Answer

It depends. If you paid a retainer deposit, the attorney is entitled to be paid for the work done. If there is money left over after paying the attorney, then you are entitled to what is left over.

If you paid the attorney a flat fee, you are not entitled to a refund. The attorney is not responsible for the reconciliation.

Check your agreement with the attorney.
