I don't make the mortgage payment nor live there but, it's on my credit report. If I file Chapter 7 will my half " Ownership of home have to be sold off " ?

You are on the note so that is why it is on your credit. You own a portion of the property and you may not be able to file a chapter 7 as your portion will be treated as an asset. However, I don't know what else you own or how much equity is in the property. Even if you could not file a chapter 7, you could still file a chapter 13. In a chapter 13, you keep all your possessions but you pay back a portion of your debts.

I don't know your circumstances or the kinds of debt you have. What I suggest that you do is get a consult with a bankruptcy attorney and find out whether you can file a chapter 7 bankruptcy. If you cannot, then you have some options: (1) you can convey your 1/2 share of the property back to your dad and/or sister, but if you did this you would not be able to file a chapter 7 for 1 year at least from the date of the conveyance; or (2) depending on your debts and your ability to put money aside, debt resolution may be the way to go.

When I expressed to him my level of discomfort with his actions, his response was to make light of a very serious situation. His exact words were; "Sexual Harassment!" This was said by him without any concern of what could happen. I then told my supervisor, who mentioned to me that he did hear him say the "Sexual Harassment" comment. On Monday January 14th I called our corporate headquarters and spoke with an H.R. rep. I have not heard back from that person either. Is their a statue of limitations on this? From your post, this was a single incident by a fellow employee. Generally, that is not a strong basis for any reasonable legal action (EEOC or lawsuit). You can certainly see a lawyer to discuss all facts, and what happens if you initiate a complaint against your employer, but you may also want to continue to ask for a resolution by HR and just see if there is any other similar activity. It is possible it was addressed by management. The other person may have also realized it was out of line. Whether you are happy in the job may also be a consideration. Of course, if this type of thing happens again and management does nothing, it is a different issue.

I already have an attorney, and have demanded an accounting and will be petitioning the court for his removal and etc. But, I still have more questions. A Testamentary Trust is one created under the Will, not during the lifetime of someone. Its terms are usually outlined in the Will, so if you have a copy of the Will, the general terms are set forth in the document. The trust will not be funded until the estate is settled and all estate obligations (debts, expenses, etc.) are paid. The Executor first accounts for the estate and then indicates how and when the trusts will be funded. If there is litigation involving the activities of the Executor, this usually delays the funding of the trusts. In rare instances, the trusts can be funded, in part, before the estate is settled, and this usually requires Court approval. If the current Executor/Trustee is removed, his replacement will have the responsibility to see that all is done properly and in compliance with the Will and law.

I hope this isn't too late. I doubt that they are telling you what KIND of document to sign. That woudl be wrong. But they really just need (I believe) SOME kind of proof that your daughter actually lives there. They certainly do not have a right to dictate what kind of relationship you have or make you sign any particular kind of document. But if she does not have a normal lease, you need to come up with something that proves she actually lives there. I would suggest that you sign a lease with her even if it is only for $1 a month.

I am over 40 years old and recently went through an entire job application, hiring process for a sales related job with a large company (over 1 billion in annual profits - 10,000+ employees). I was asked numerous illegal interview/application questions - spouse details (job, earnings, parents names and contact info, spouses parents jobs and career info), family (child support payments, amounts, various debts (car payment, mortgage, rent)), dependents (number in household, number outside of household), marital status, participatory sports, religion (preferred religion) and age DOB and how old). Then I was sent a bland turn down email when clearly I was the best candidate. They would not respond when I tried to get an answer as to why - it was obvious it was due to one of the many illegal questions they asked. They clearly used illegal questions and discrimination here. The job has no age limiters or qualifications affecting it. Prior to this I received a similar rejection letter from a company that point blank told me I was too old at the beginning of the second interview and then proceeded to basically abuse me in the interview - very mean and hostile interrogation style (like what you would see in a police interrogation of a suspected murderer). This company is also large (10,000+ employees and over 1 billion in annual profits). Both were within the past 35 days. It is important to note that I went through many stages for these applications to include IQ tests, personality tests, background and credit checks and more. In each case I was fully qualified (college degree with high gpa in business) and successfully passed each and every stage until the end (also, in both cases I was told I beat all the other applicants in all the tests). I have full documentation and proof of everything that documents the illegal questions, how I passed each level of the application process and tests and more (all emails, applications, forms, etc.) Do you think I have a discrimination case for one or both cases? What should I do?

For the duration of our stay, the owner has neglected to fix a majority of repairs needed on the premises. Although she has a room in the townhouse, she is paying,maintaining a lease, and living at another location. She is trying to tell us that since she's the owner and pays 30% of the electric bill that this counts as living here. Upon move in, none of the common areas were cleaned or properly maintained. Any time she has fixed things, it's taken months and several complaints to get the task accomplished. For almost 4 months, our kitchen supplies sat on the floor in the living room because we were waiting for her to make some space for us. After waiting all this time, we decided to clean out some of the cabinets and put our stuff away since on average we only saw her there once a month. Some of her relatives came to visit recently and they just came and went as they pleased, touched and used our belongings, and even took some things which have yet to be returned. On March 28th she told us we could sign another lease, and now all of a sudden she's saying that she has family coming and that she is going to rent the property to them. We also put a bookcase, desk, and hung a few pictures in the downstairs area which she is claiming we are not allowed to do because we are leasing a room and not the entire establishment. However, no where on our lease does it state that we are explicitly renting just a room. It does state that we "shall make no alterations to the buildings or improvements on the Premises or construct any building or make any other improvements on the Premises without the prior consent of Landlord." I was under the impression that this meant structural/permanent changes and was not applicable to having a desk, bookcase, and some pictures in the living room. The only thing I think we are truly in violation of is having 2 bunnies instead of the one that is stated in our lease. However, the owner has been aware of this fact for about 8 months now and has not cared to mention it until recently. Since she has failed to maintain the property and has now stated that we can no longer live there despite previously telling us we could sign another lease, would we be in the wrong for vacating the property before our lease is up at the end of June? Thanks.

What does your lease state about vacating the property. Send her a 30 day notice that you plan to terminate your lease at the appointed time. Also state in your letter that no where in your lease is that a paragraph about other people coming and going in the unit and that if she intends to allow another tenant then she will need to void the current lease, give you back your deposit and give you reasonable notice.

However, the doctor had a duty to advise you about the costs. A $1200 test is pretty expensive and you had a right to know. You can file an objection with the doctor and see what they are willing to do. If you are not satisfied you can take the matter to arbitration if you agreed to arbitration or to small claims court.

Unless your mother signed personally for the cards or used the cards, she should not generally be liable for your father's credit card debts. However, it depends on the assets in the estate and where your father lived at the time of his death. I recommend that your mother take your father's will, if any, to a probate lawyer who can then review what assets are in the estate and make sure that your mother gets her spousal allowance (called different things in different states) which is free of creditors' claims. If there are no assets in the probate estate or if the probate estate is exhausted by the spousal claim, then there may be no need to probate an estate. In which case, I would tell the creditors that your father is deceased, that there are no assets and an estate will not be opened.

If there are assets which would pass through probate, then your mother may have to pay the bills, but out of estate assets, not her personal assets. Basically, heirs cannot keep the assets and not pay valid debts.

If the judgment is just against the corporation and not against you then you are ok in terms of being directly liable. The problem is that when you go to dissolve the corporation, if there is a judgment against the corporation, then any assets of the corporation would be sold and use to pay the debts. So the proceeds of any assets go to the judgment creditors and not you. Once they are paid then any excess would go to you. If you were sued along with the corporation then then the creditor can try to enforce the judgment against you personally, but unlike your corporation, you would have the benefit of the personal exemptions.

If there is no equity in the company, you could do a few things:

(1) if the company has no plans to remain in business and if it has a lot of debts, maybe it should file a chapter 7 liquidation bankruptcy.

(2) if the company does not have enough debt to justify bankruptcy, you could just simply let the secretary of state administratively dissolve the company. This would work if there are no assets in the company - no vehicles, land, bank accounts etc. The judgment would still be there but if the corporation goes out of business, is dissolved and has no assets then I don't see what a creditor could do.

I am not a business lawyer - I handle consumer debts. Perhaps a business collections lawyer may be able to offer further insights as to what a judgment creditor could do.

Credit card debt is dischargeable in bankruptcy regardless of when you last made a payment. As for recent purchases, it depends on what was purchased. If the items were for "necessities of life", they are dischargeable. If the purchases were for luxury items, those charges are likely no dischargeable.

The answer to your question about softener can be a bit tricky and depends on 2 big factors: (1) did you sign any documents giving the lender a valid security interest in the water softener; and (2) whether the water softener is attached in a way that it would be considered a "fixture" under California law.

It something becomes "permanently" attached to the house, it is considered a fixture and thus would require a deed of trust against your home to have a valid lien. A water heater or a central HVAC would be considered a fixture and they probably could not repossess it. A contractor who didn't get paid for a roof repair couldn't legally come to your house and repossess the work.

On the other hand, some things aren't attached to the house. A washing machine is typically connected to the house by water hoses and a drain hose, so it would not be a fixture and could be repossessed if the lender had a valid security interest.

Now does the lender have a valid security interest? Well, that would be hard to say without having an attorney review the contact AND the method in installation for the water softener. I've had clients filed bankruptcy and tell the company that they consented to repossession of the water softener. The reality is that they probably won't pick it up.

As for the credit card purchase, the are dischargeable unless the creditor files a lawsuit in bankruptcy court called an adversary proceeding. Certain luxury purchase or chase advances made within 90 days might be considered fraudulent and nondischargeable, but the lender does have to file the lawsuit and prove its case.

I communicated with my landlord, found out they sent the check late (at 8/18/2013), and to the wrong address, twice maybe. I don't want to wait any longer for them to return my deposit. Recently, I required a Mediation through my County Municipal Court Clerk Web Site, the time was set to meet at 12/05 /2013. The problem is, after couple days of my request for Mediation, my landlord shipped my security deposit check to me at 11/18/2013 using FedEx overnight, but amount was reduced from $150 to $90, and there is not info inside the envelope that says why the deposit being deducted.

Okay, I know The Ohio law requires landlord to return their tenant security deposit within 30 days after moved out, and the tenant has the right to claim double deposit through small claim court if the landlord wrongfully hold the deposit.

Here is my question, I received the check, but I do NOT want to accept it, since it has been almost 5 months after I moved out. Through the email my landlord sent me, I know they sent my check on 8/18/2013, and that is already after 30 days after I moved out. So can I reject the check, and still meet them at the Mediation, and require them to give me double deposit which is 90*2=180?

In Ohio, you most certainly can refuse the check. Not only is it late, it is for an amount that is less than what is due. Make a photocopy of both sides of it and return it to the landlord either at the mediation or by certified mail.

This is a question that's perhaps better posed to a divorce or family-law attorney who deal with this kind of problem regularly, but I'll take a stab at it.

Most home loans contain so-called "due-on-sale" clauses that essentially terminate the loan and give the lender the right to collect what's due it when the house sells......but they aren't limited to ordinary cash-out sales; they also are triggered by any change in ownership, such as sale or gift or barter of a half interest to the other co-owner. Some lenders will give relief from such clauses (often for a fee), and most will in the case of a property split following a divorce decree.

Also, in a dissolution of marriage, the law provides that the couple's community assets AND community liabilities shall be divided equally. Once a dissolution of marriage (divorce) petition is filed, each party must submit to the other a preliminary disclosure of assets and liabilities, so there is supposedly transparency.

I think it is probably wiser to handle the entire division of property through the marital settlement agreement, where it will become part of a court order. Then neither party nor any lender can later attack it as not complying with the law....or at least later-on problems of this sort will be much less likely.

Our entire system of criminal and civil justice depends heavily on the basic honesty and integrity of good people to come forward with knowledge like this. In nearly every lawsuit, we rely on the adverse party to provide the documents and things that will ultimately make our case. If we allow the destruction of evidence to go on, it could be any one of us unjustly convicted or made to pay hefty civil fines that could bankrupt your business or family.

You must come forward this information and the people who have helped to hide or destroy evidence must be punished so that we can all live in a free, fair, and just society.

Your employer should give you a raise or a promotion or otherwise commend you for helping out, and nothing prevents you from suggesting that to them, but you cannot extract money from them in exchange for this information. It is essentially extortion and blackmail. Therefore you must view this as your civic and moral duty to disclose. You might even consider doing it anonymously, but I make no recommendation one way or the other on that.

Please also note that this situation could open you up to liability as an accessory to the destruction of evidence, witness tampering, obstruction of justice, hindering an official investigation etc...you get the idea. With that in mind, you might want to visit an attorney in person and pay for some very specific and confidential legal advice that you can NOT get here.

Your question raises a number of interesting issues that I find are intriguing so I will take a stab at answering it.

I cannot say that what you are proposing is legal, but, I can say that I am not aware of any law that says selling information of this sort is illegal. It could be problematical. If the defendants find out that you have relevant information after a lawsuit has been filed, they could simply summons you to give a deposition and you might then be forced to provide truthful testimony for nothing more than a nominal witness fee. Since the company can get the information for free if they really need it, why would they pay you for it. If they pay you for the infromation, it might later appear, or someone might allege, that they tried to improperly influence you.

It might be possible to avoid the disclosure of your identity by going through an intermediary. But, that might create another set of problems.

It does not sound to me like you would be engaged in extortion or blackmail by seeking payment for the information. Blackmail mail or extortion is usually based on the threat to disclose information or harm another person in order to improperly coerce the target to pay money. In your case, you would not be disclosing information that was helpful unless you received payment. This is quite different from blackmail or extortion.

It might be a violation of legal ethics for a lawyer to pay you for providing this information in some instances if you were viewed as a witness rather than an informer. This might limit the ability of the company to have their lawyer pay you, although they might be able to pay you directly. Legal ethics might prevent a lawyer from acting as an intermediary for you to propose selling the information you mention.

I don't think that you necessarily have any legal duty to come forward with your information. It might be the ethically correct thing to do. There could be a number of pros and cons from an ethical standpoint. As a practical matter, getting involved could be inconvenient for you.

If you really think there is an injustice that is taking place, it might be the right thing to let the coompany know. If you are an employee of the company, you might even have a duty of loyalty to your employer that might obligate you to disclose this information.
