I see that lenders are putting down what appears to be 12-months. I would like to know if the number of months are ever negotiated down. ?? It's for a residential single family home. I just wondering if that is something a real estate lawyer might know.

Number of months to be escrowed, to my knowledge, is not negotiable. However, depending upon your loan, you can possibly negotiate whether or not you need to escrow both or either of the real estate taxes and/or home owners insurance. Some banks do allow a borrower to pay these items directly, and do not mandate they be escrowed. However, if they are to be escrowed, all banks use 12 months, again, to my knowledge.

They made in over payment even though I told them several times it was too much. They never received their over payment back from the bank. So now they are saying our payment for the vehicle we purchased is incomplete and will not submit for registration. 6 months later now we still have no registration even though we paid for the vehicle we purchased. The problem isn't between the dealership and the bank. Sorry, but the bank is merely following the rules it must follow. The problem is between the dealership and you. If X makes an overpayment to Y by depositing too much money in Y's account at Bank Z, there is nothing Bank Z is permitted to do to correct X's mistake. The correction is up to Y. Banks don't make refunds without instructions from the account owner!

You should have had a real estate lawyer the instant you first found out there was a problem with your house (for most people, their biggest investment). It is certainly not an issue for an internet website where we don't have the documents, we don't know the title history, you could not fix it yourself if we did have this information, and you would not want to rely on that anyway. If you have your own title insurance (and you should have it), contact them ASAP and hope they can fix it and don't deny coverage because of a failure to notify them earlier.

If she has a Will, then that document says who gets her "household belongings," even though she did not make a specific gift of a particular item. The will should state who receives the rest and residue of her estate and that is who gets the household items. Your POA must be "durable" or it is invalid at the moment your sister became incapacitated. If it is a durable POA, you do not have the authority to decide who gets these items of her property.

A little over two years ago I purchased a home. When I went to have my plans ( addition of bath room) approved for a building permit, I learned that my neighbor's swimming pool was partially (700 sq. Ft.) on my side of the property line. I was told this was a zoning violation. I had a survey done and it agreed as to the encroachment. After hiring an atty, we had a hearing where the judge awarded me some funds for the 700 sq. ft. His ruling will be recorded and fixed the new property line along an existing fence line. But the judge did not order my neighbor to have the new line recorded by submitting the required line change documents at city zoning. There is a fee ($3,600.00)and a fine ($1,000.00)
My neighbor is an elderly woman and has no funds. My award will be recorded and is to be paid when the property is sold or changes ownership.
Question: Will the judges ruling be accepted in stead of the required documents at zoning and will I then be able to get a building permit...??

The attorney you hired should have taken care of that issue and made that part of your claim for damages. I do not know if he/she did; if they did not they may have committed malpractice. Certainly they should be asked to pay at least part of that cost, especially since it sounds as though it was an open and shut case where a settlement could have been negotiated with the neighbor [she will probably stay there until she dies so what ever you are paid by her does not come out of pocket as opposed to her heirs]. You need to call up the zoning department to see what they will do and allow. I do not see how that is a zoning violation as zoning deals with whether structures are allowable, not whether there is a trespass. What if you had given the neighbor permission to build on your property; could they deny her building the pool because it is not on her property -- no. As to your having to pay a fine for the violation, you did not violate anything, she did. But as to the line change you have agreed to it so the county may very well charge you as they supposedly are making you pay for the cost of their redrawing county documents showing where the new property line is.

Close to the end of the second week after the accident I took it to another reputable shop after having been let down by the first shop for not being thorough in their assessment. After I got my motorcycle back I called the guy and told him the amount the shop quoted the damages plus labor for. He flipped and having already gone through 2 weeks of BS with this guy I called his insurance company the next day to file the claim. Two days after the claim,the field appraiser came out to do a visual inspection and then submitted an appraisal for $2000. I was not satisfied knowing that there were more damages to the bike and labor had not been considered. The appraiser went out about 2 weeks later to talk with the repair shop and then she submitted another "supplemental damages" appraisal for a total of $4500. I have both checks for that amount but am seeking 'loss of use' and possibly 'damage value'. I recently faxed a 'loss of use' and compensation for the damage estimate I paid out of pocket for. They denied the estimate I paid for claiming that the field appraisers 'estimate' is free.My argument is of course I am not qualified nor the field appraiser to know the full extent of the damages without technical knowledge in motorcycle mechanics(which is why I took it to the most reputable shop in my area.) In regards to 'loss of use",they only wanted to pay out $299.85(15 days x $19.99/day) despite the fact that I've been without my motorcycle for 38 days now! I was considering renting a vehicle but having no assurance of how much would be covered and fear of the insureds policy being the minimal for property damage I choose not too. However my wife and I have been really inconvenienced because we have only one car and have to take each other to and from work. Adding to more expenditures on gas since our motorcycle is our commuting vehicle.
I was also considering claiming 'diminished value' but am not too sure for a couple of reasons:
First,if the insureds policy is high enough to cover it.
Second,do I have to have my motorcycle completely fixed? Or to what extent? I cannot approve al the damages to be fixed since I do not know how my claim will turn out since only $4500 has been approved and that is about %60 what my bike was worth before the accident.
Lastly,if I can claim DV,and the insurance cannot cover it,can I go after the person who hit my motorcycle along with any "loss of use" amount not covered by the insurance company?
Any advice would be greatly appreciated! especially in regards to how I can properly be compensated for 'loss of us"?
I wanted to add that last I spoke with the adjustment team(since it's not just one adjuster apparently) they mentioned that in cashing either the last check for "supplemental damages" or both that would constitute the settlement of the claim. The guy I spoke with made an indirect mention that whatever has been paid out covers the damages and the rest is not part of the accident or that anything other "damages" I am claiming have to be on the supplemental damages appraisal.

As to your several questions:
1. While it makes sense, the courts have held that there is no compensation for diminished value. Even if a vehicle is restored back entirely to its pre-accident condition, it clearly has a lesser value as if you try to re-sell it everyone will offer less than the same vehicle not involved in an accident. So there is no way you can recover for that drop in value.
2. You are entitled to the cost of a similar vehicle for the reasonable amount of time it takes to repair your vehicle. The insurance company's argument that if you cashed any of the checks that would result in a settlement of the entire case is not necessarily correct [if check does not say that and you thought settling piecemeal, etc.] but you can turn it around by pointing that that is their position so until the issue of loss of use is resolved you can not afford to get the bike repaired as you would have to cash the check, so they are responsible for loss of use until a final settlement is made.
3. You are entitled to loss of use whether or not you have the motor bike repaired, as yo have still suffered the damage of the decrease in value measured by the cost of repair;
4. normally the cost of getting a repair estimate would not be recoverable, but argue to them that because their insured did not want to report the accident, you had to go and get an estimate as there was no one there from the insurance company to do it and their insured demanded an estimate.
5. The insurance company has no liability to you. It has a responsibility to it insured to try to settle the case within the policy limits and can be sued by its injured if it does not. Any suit by you is filed against the insured, and not the insurance company.

There is way more going on here than you describe. This sounds like a gift, but .... What, if anything was said at the time the money changed hands? Why does your father want repaid now? Does he need the money? Did you have a falling out with him?

If he is being a jerk, then I think on principle I would repay him and then tell him that given his actions, you want nothing further to do with him and I would make that happen. I would not let him see your kids if you have any now or in the future. I would treat him as if he was dead and let him realize his mistakes if he has any decency.
If you can't afford it, then sell the house, keep the money and tell him to go take a jump in the lake. A gift is a gift. If there is nothing in writing to establish this was a loan, then he can try to sue but he will not get very far. Nobody loans that kind of money without getting a promissory note. If you need additional time, you need to call the attorney who filed suit and ask for additional time. Otherwise they will seek default judgment against you. You should get the parking brake fixed, asap. Then call up the buyer and say that it is fixed, so hand over the money. If he does not do so, you can probably retain the deposit, except that you say that the only written agreement between you does not mention the $500 at all, so he could claim that it was a refundable deposit that you owe back to him. In any event, you have the money, so he will have to sue you for it.

I think we need more information on why you think you owed $60 and the vendor thinks you owed $900. This is the real issue here. Well thank you for writing back. The first thing I want to know is if the case has formally been filed in court? You have 3 years from the date of the incident to file suit or else the statute of limitations has run and you will be unable to recover for your injuries. Assuming that the case has been filed in court, even though you have a prior existing injury to the same leg does not mean that you are precluded for recovering for your current injury. A pre-existing condition can be made worse from another accident. So if you had bruising before and not a more serious injury that required surgery then you ought to be compensated for the additional injury sustained. That being said, the 90/180 rule your attorney is referencing usually is used for soft tissue injuries. Serious injuries, such as a fracture or torn ligaments, are enough to breach the serious injury threshold of the NYS Ins. Law. The surgery, coupled with your other injuries and treatment can be used to satisfy this requirement. Missing work, if any, is only one factor looked at in determining whether you suffered a serious injury. Did your surgeon state the the injury to the leg was caused by your accident? This is something else that needs to be assessed.

As a general rule, closing arguments do not factor in appeals, because arguments of counsel are not evidence. The jury is specifically told that statements and arguments of counsel are not evidence, evidence somes from the witness stand and exhibits properly introduced.
On rare occasions, a prosecutor will make an improper closing argument that prejudices the jury in how they decide the case. For example, a prosecutor may refer in closing argument to evidence that was suppressed, or insert his person opinion of the defendant's guilt, or may refer to an improper motive for conviction. In such a case, the duty of the defense counsel is to immediately object, at least move to strike the improper remark and obtain a corrective jury instruction telling the jury that what the district attorney said was improper and should be ignored. In an extreme case, the defense attorney can move for a mistrial.
But unless something like that happened during the ending stage of the trial, and a transcript of the closing arguments was specifically requested by the defense attorney, court reporters will not even bother to type up the closing arguments (or the opening statements as well, and for the same reasons).

You took a risk. People moving to Illinois and who intend to reside here are supposed to transfer title and plates to Illinois within 30 days of moving here. What you experienced is one main reason for the rule - otherwise Illinois authorities have no idea where to reach you. There is an old, old saying: "ignorance of the law is no excuse". You can hire an attorney and/or wait until a lawsuit is filed and then present your case to the judge, who may give you a "partial" pass or make you toe the line. You were not approved by your employer and then your employer appealed. Instead, you were approved by the State of Maryland and then your employer appealed the State's decision to award you unemployment benefits.
The reason your employer is appealing is very simple -- under Maryland law, you are not entitled to unemployment benefits if you were FIRED FOR CAUSE. You are only entitled to unemployment benefits if you were "laid off", for instance because your employer did not have enough work for you and they needed to cut back on their work force.
Stated another way, if you were fired because you couldn't get yourself to work on time (REGARDLESS OF THE REASON), then you will not get unemployment benefits. Why should you? Your employer hired you to do a job during certain hours and if you couldn't cut it, that's no one's fault but your own. The employer should not have to pay for your benefits when you didn't do the job. Conversely, if you were laid off for a reason NOT related to your work performance, you will likely win the appeal and get your unemployment benefits.
You will likely have a phone interview with a representative of the State of Maryland to determine WHY you were let go. If you admit that you were late and give the State some excuse about having morning sickness due to pregnancy and taking xanax and confirm that's the reason you were fired, you will likely not receive unemployment benefits. Do you see where I'm going with this?

I live Across the street from a golf couse and we have golf ball flyover and hit the houses and cars there is alot of damage that occurs. The biggest problem that we are having is me and the neighbors all have kids and the biggest concern is them getting hit. I contacted the golf course and they told me that they are not responsible for any damage that happens and they refuse to put any netting up. I would understand if I lived on the course but we are accross the street and there answer is that they were there first. That is not the best answer for me I moved into my home in a snow storm and did not find out how bad the problem was untill the spring. If I new the problem was this bad I would have never moved here I feel that I should not have to sell my home due to this when they could help out and fix the problem. Is there anything I could do????

You have to retain an attorney to bring a preliminary injunction against the golf course pending a decision on a permanent injunction regarding inadequate measures to prevent fly balls. Short of it, you could go to town hall and have all your neighbors sign a petition to address the problem in a meeting.

My bank hasn't set a foreclosure sale date yet, and they say i have to try and short sale it before they will accept a deed in lieu. The bankruptcy papers says I am absolved of all of my debt including both loans. Can I just quit claim the house to the bank or someone else to get my name off title to the property?

You cannot deed property to another person or entity without them accepting it. A deed is only effective upon delivery and acceptance. You could record a quitcliam deed to the bank, but it would result in record title not properly reflecting legal title. Why are you so anxious to get off title though? Why not live in it or rent it out until the bank forecloses? If you really just don't want the property and want to walk away, please contact me. I may have options for you.

You should talk to your bankruptcy attorney. When you file bankruptcy, the property that you own becomes part of the bankruptcy estate, which is usually administered by the bankruptcy trustee. The lender retains the lien on the property, regardless of any discharge.
