Unfortunately they filed 8 counts of theft, possession of controlled substance, possession of legend drug, and official misconduct (I worked at a post office). They put a bond of 7,000 cash only on it. Is there anyway if I get a laywer they can talk to the judge and make it to where if I turn myself in with my lawyer and want to cooperate they can lower the bond or get rid of it so when i turn myself in I can get an initial hearing and get right out, as long as I show up for court when I am supposed to? What are my options with that and what can a lawyer do about that?

Actually the real issue is not whether the ticket carries points in New Jersey, which it does, but rather if those points will attach to your license. I do not know what state you are from and it would depend on how your state handles out of state tickets. It is usually good to get a lawyer if you can afford one. He should too. You likely have a self defense case. I would not talk to the police without a lawyer. This thing will not go away just by you telling the police the truth. They will write down some of it, the parts that make you look bad, and the case will still go forward.

there there may have been no actionable misrepresentation but further facts may need to be disclosed regarding the car's condition as to exactly what you the buyer asked this salesguy and what exactly he told you in response.

Sure, it is a valid argument. I do not know that a judge will do that, since you won the arbitration anyway, so there is no harm. Head to the Cook County Law Library in Markham and start working on your jury instructions. You may also want to look at Mauet's book on trial technique.

The definition of Harass is different to different people. You gave the landlord permission to contact those people regarding your credit worthiness, and your business practices. Those people you listed as references may not have consented to being contacted by the landlord. Each of those people may file a Request for a Restraining Order, if the landlord threatened them. If the Landlord revealed private identifying information, you may have a claim against the landlord. If the person that contacted the references was not the landlord, but some other person collecting for the landlord, you have strong claims regarding the impropriety in collecting that alleged debt.

Obviously, paying the amount you owe, will be a string support to any case you choose to bring, or a defense to any brought by the landlord.

First, stop talking to these low-lifes. In order to get them to stop calling you at work, you need to tell them, in writing, to stop. Telling them verbally is not good enough.

The magic language that you use is "Please do not call me at work as my employer does not allow me to receive personal calls." And if you have no intentions of paying because the statute of limitations has expired, then you add to your letter that they are not to contact you anymore.

There is a provision in both the Fair Debt Collection Practices Act as well as Pennsylvania state law which states that if they know you are represented by an attorney, then they cannot contact you. Should you choose to hire me or any other attorney, the attorney can send them a cease and desist letter.

Your second issue concerns the debt itself. When was the date of your last payment? Where was the debt incurred, Pennsylvania or another state? What is the debt for? Credit cards, medical bills or something else? Who is the collector? Some are nice, some are ok and some are horrid, so it makes a difference.

If the debt was incurred in Pennsylvania and if has been 4 or more years since you made any kind of a payment, the statute of limitations is 4 years. In such case, I would pay nothing or make a very low offer to settle for 15% to 25% of the debt if and when you had the funds. Don't make the offer if you do not have funds. You also need to be careful as you do not want to revive the statute or acknowledge the debt, so I would suggest that you have an attorney do this when you are ready.

If the statute of limitations does not bar the debt, that means that the junk debt buyer or original creditor can still sue you. You need to find out how much is owed. You mention your budget. The more money that you can pay in a lump sum, the lower the settlement number will be. If you do not have the funds, save up until you have at least 50% of what the balance is and then try to settle the debt at that time. Depending on the creditor and the debt collector, if no lawsuit is filed, they will settle for anywhere between 20% and 50%. Once a lawsuit is filed, the percentage is between 50% and 80% in most cases. There are exceptions. Again, it is best to go through an attorney, as you want to make sure that you get a written agreement from them before you send them a penny.

I think you meant to say your father is your mother's "heir," that is, the person who was named in her will if she had one. "Beneficiary" means the person named to get the benefits in an insurance policy.

Usually, the policy will have language that controls where the benefits are paid, if the beneficiary dies first, and there's no "contingent" or "secondary" beneficiary. Typically, those clauses provide that the money goes to the insured's estate.

Unfortunately, that means that the proceeds can be subjected to inheritance taxes and has to go through the probate estate. Which is why people should ALWAYS have a contingent beneficiary named, and update their policies when a beneficiary passes.

You or your father should consult an attorney to review the actual language of the policy and find if anything can be done. State law may have some effect.

You need to go file a fee waiver and go to the family law facilitator to get help with the paperwork. I would submit his note (hopefully you have this all in writing) that he is sending her to you because it is in her best interests. You may need to do this ex parte (meaning that day or the next) if he tries to insist that you immediately return the child.

However, after five months of not hearing any updates and the "CEO" of the company constantly evading my questions of how much longer and even deliberately ignoring my e-mails all together, I decided to cancel the order and just be done with the whole ordeal.

About 1/3 of my original purchase was sent back but they are still keeping quite a bit of money because they "need to sell the product that I ordered" before I get the full refund. Which means I might as well be sitting in limbo until they decide to actually send my money back.

Given that I have paid them yet received no services or products (and am not expecting to anymore), is it legal for them to simply keep my money like this and if not, what can be done about it?

Notes: The full payment was $3,000 (though I got back $1k of it) and was the full price of the product. It was also payed for via debit card, if that makes any difference.

As such, I am effectively terminated at the close of each project (i.e. TV episode) until I am called for work on another project. For this reason, I believe Section 201.5 of the California Labor Code applies to me. According to Section 201.5(4)(b), I should receive any unpaid wages at time of termination by the next regular payday. (The employer has established every Thursday as a regular payday.) However, I frequently do not receive payment for 3 or 4 weeks after the work is performed.

Those issues have been reported to HR, but i was never contacted in regards to. One recent example I can give is before lunch my boss asked me a question and I gave him a thumbs up sign (meaning nothing more then your right) then I went to lunch. Coming back I was pulled aside by my boss and another manager and accused of not focusing and not caring about my job and among other things. The entire thing lasted about 10 minutes. An hour and a half later there was a letter that went around encouraging insubordination typed out by an employee passed out and signed by other employees (myself excluded) , keep in mind most if not all the employees who signed the letter thought that this letter came from management. Upper management made the entire department group up, making it a point to say to come to them if they have a problem and that the letter itself was "Slap in the face." and that no disciplinary action would be taken against the people who signed the letter or the guilty employee, who wrote the letter. It made me curious as to how one person could get away with what they called blatant disrespect and possibly getting others in trouble, but my thumbs up warranted 10 minutes of calling me unfocused and (to a lesser extent) incompetent.

The above is just one of many incidents. I haven't reported anything to HR just because the first incident I had nine months ago no one ever bothered to call me back or meet with me. I'm at the point where I would rather work at a hotel cleaning rooms then be where I am at. I am seeking other employment actively, but I don't want to be picked on in the mean time. Any answer will help, even if I'm over re-acting.

I was allegedly accused of taking my friends car and driving it from Atlantic City to Philadelphia. I paid the bail and have a court date for the 16th. I do not know what the court date is for like sentencing or whatever. I never went through the arraignment process. No one forced the driver to become involved to help the CI; meaning the authorities did not say if you want credit as a CI, you need to involve this civillian who had nothing to do with case. If you chose to assist the CI of your own volition, you may have done so at your own risk. If certain assurances were made by the authorities for your adssitance and you can prove that they were, you may have a valid claim. However, even in that scenario a lawyer would have to evaluate how you were harmed by the ineptitude of the authorities. I know it sounds ridiculous given the potential for harm but money is not awarded for potential harm only actual harm. I did not create the system before you comment harshly on my reply.
